DATED JULY 12, 2005 FOR THE PROVISION OF ADDITIONAL PROFESSIONAL SERVICES NECESSARY FOR PRELIMINARY TRAFFIC COUNTS IN AN AMOUNT NOT-TO-EXCEED $5,602 FOR TFiE RIGHT-OF-WAY INFRASTRUCTURE IMPROVEMENTS PROGRAM NEIGHBORHOOD NO. 2 -NORTH SNORE ~, This Amendment No. 3 to the Agreement made and entered this ay of ~-u~~ ° 200 ~y and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of t State of Florida (hereinafer referred to as City), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and CALVIN, GIORDANO & ASSOCIATES, INC., having its offices at 1800 Eller Drive, Suite 600, Fort Lauderdale, Florida 33316 (hereinafter referred to as Consultant). RECITALS: WHEREAS, pursuant to Request for Qualifications (RFO) No. 41-03104-99100, the Mayor and City Commission adopted Resolution No.2005-25976, on July 27, 2005, approving and authorizing the Mayor and City Clerk to execute an Agreement with Consultant for Professional Services for the North Shore Neighborhood Right of Way Improvement Project (the Project); and WHEREAS, the Agreement provides for the planning, design, bidding and award, construction administration and reimbursables for the Project; and WHEREAS, the Agreement was executed for anot-to-exceed amount of $1,250,423; and WHEREAS, on September 6, 2006 Amendment No. 1 to the Agreement was executed to include the installation of "P3.2"classified water main replacements required by the City's Public Works Department; for a not-to-exceed amount of $151,032. for a total fee of 51,401,455; and WHEREAS, on February 23, 2007 Amendment No. 2 to the Agreement was executed to include the installation of bike laneslroutes required by the City's Public Works Department in a not to exceed fee of $8,640, for a total fee of $1,410,095; and WHEREAS, this Amendment No. 3 to the Agreement is to include preliminary traffic counts to facilitate Miami Dade approval of a reduced traffic study area while adequately satisfying Miarni Dade requirements; and WHEREAS, this proposal has been evaluated by Hazen & Sawyer, the City's Program Manager, and the CIP Office, and it has been established [ha[ [his additional service request is fair and reasonable; and WHEREAS, this Amendment No. 3 increases the Agreement fee by S5,602, for a total fee of $1,415,697; NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants. agreements, terms, and conditions herein contained, ~ nd other good and valuable consideration, the respect 4lnriarnibeach5244mb.524_datalCAPlt$aNlMigueflNorl6 ShoreiNorth Shore ROWlmprovemonts - Amendrnenf No 3 (dratry.doc and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECfiALS The above recitals are true and correct and are incorporated as a part of this Amendment No. 3. 2. MODIFICATIONS The Agreement is amended as defined in Schedule "A-3", attached herein. 3. OTHER PROVISIONS All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION The City and Consultant ratify the terms of the Agreement, as per this Amendment No. 3. Z~~-t"~ /~ \_ it ~ ~ ~ ~- 4lmiamibeach5241mb524_datalCAPlt$afAMigueflNoAfr ShorelNorrh Shore ROW fmprovernenls - A nendrr ~ 3 (draRJ.doc ' SCHEDULE "A- 3" SCOPE OF SERVICES Schedule "A" entitled, "Scope of Services", is amended as follows: ADD the following under Task 5 -ADDITIONAL SERVICES, after the language added for Amendment No.2 Task 5.4 - Preliminary Traffic Count: Preliminary review meetings wish Miami Dade Traffic mandated a traffic study be preformed for the subject neighborhood, stating that the proposed Tatum Waterway Drive one-way conversion, between 77"' Street and 79r Street, would result in ancillary impacts to the surrounding area, thus affecting the entirety of the neighborhood. The PM /CIP / AE team jointly agreed, during a meeting held November 14's, 2008, that the study area can likely be reduced to an area encompassing only ten intersections and two schools. The resulting consensus of the teams was that the Consultant, accompanied by City of Miami Beach Transportation Manager and the PM team sub-consultant Traffech Engineering, would schedule a meeting with Miami Dade Traffic to discuss and aggressively pursue approval of the reduced study. The subject preliminary Uaffic count was agreed to be required for backup substantiation of the CIP ! PM ! AE proposal to Miami Dade Traffic. Therefore the Consultant shall provide detailed services for producing the subject preliminary traffic count analysis as noted herein. Suhtask 5.4.1 -Data Collection: The Consultant shall perform six (8) hour turning movement counts, inclusive of fifteen (15) minute fuming movement volumes and fifteen (15) minute pedestrian volumes, at peak periods including periods coinciding with common school dismissal times. The counts shall betaken on Tatum Waterway Drive at 77`"Street and 79'" Street as well as on Dickens Avenue at 77t Street. The Consultant shall collect bi-directional hourly traffic count data for each approach of the roadway for a minimum period of 48 consecutive hours. The bi-direction counts shall be performed on Tatum Watervay Drive, between 77'" Street and 78'" Street. The Consultant shall obtain traffic signal timing data from Miami Dade Traffic and identify all schools within close proximity of the study area. All data collection must be performed during common school days and cannot be performed during weeks containing United States holidays. Subtask 5.4.2 -Existing Condition Review. The Consultant shall field review existing roadway conditions as it pertains to intersection geometry, lane arrangement and use, and other elements contributing to intersection operation, The Consultant shall provide an existing condition Level of Service (LOS) Analysis for peak periods as noted under Data Colfectiorr of this Amendment. TIME OF COMPLETION Additional services contemplated by his Amendment are to be completed within twenty-two (22) work days from the Notice to Proceed. The method of calculating fees for the aforementioned proposed additional professional architectural and engineering services is established in Exhibit'A-3' attached, based on estimated labor plus direct costs. The total fee proposed for this Scope of Work shall be on anot-to-exceed basis in the amount of $5,602. Invoicing will be monthly and based on hourly rates as defined in the current Agreement between Calvin, Giordano & Associates, Inc and the City of Miami Beach, COMPENSATION Original Agreement amount $1,250,423.
