2001-24535 RESO RESOLUTION NO. 2001-24535 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH TO RATIFY THE THREE- YEAR LABOR AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE FRATERNAL ORDER OF POLICE, WILLIAM NICHOLS LODGE NO.8, (FOP) FOR THE PERIOD FROM OCTOBER I, 2000 THROUGH SEPTEMBER 30, 2003, AND AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE THE AGREEMENT. WHEREAS, the City Manager has submitted to the Mayor and City Commission the Labor Agreement <Agreement) recently negotiated between the City of Miami Beach, Florida and the Fraternal Order of Police, William Nichols Lodge No, 8, (FOP) the bargaining agent certified by the Public Employees Relations Commission (PERC) for the employees covered by said agreement; and WHEREAS, the previous Labor Agreement was for a three year period from October 1, 1997 through September 30, 2000 and has expired; and WHEREAS, the Fraternal Order of Police bargaining unit ratified the attached Agreement and the City Manager recommends that the City Commission ratify and authorize the execution of the Agreement between the City and the Fraternal Order of Police Union; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the attached Labor Agreement between the City of Miami Beach and the Fraternal Order of Police, William Nichols Lodge No.8, (FOP) for the period from October I, 2000 through September 30, 2003, is hereby ratified and that the Mayor and City Clerk are hereby authorized to execute the Agreement. BACKGROUND On July 9, 2001, after over ten (10) session, negotiators for the City and FOP successfully concluded negotiations for a three (3) year collective bargaining agreement. The Union membership has reviewed the proposed Agreement and voted to ratify it as presented, While negotiators for the City and the Union were obliged to represent the best interests of their "clients", the shared goal was to produce an Agreement that guaranteed equitable and competitive compensation and working conditions, The following is a summary of the most significant changes from the previous Agreement. WAGES The term of the Agreement will extend for three (3) years from October 1, 2000 through September 30, 2003, Effective with the first full payroll period that begins on or after September 25, 2000, bargaining unit employees will receive a four percent (4%) salary Increase. Effective with the first full payroll period that begins on or after September 24, 2001, bargaining unit employees will receive a four percent (4%) salary increase, Effective with the first full payroll period that begins on or before September 30, 2002, bargaining unit employees will receive a four percent (4%) salary increase. Based on current, active employees the estimated cost for the wage increases are approximately $733,000 for Fiscal Year 200012001; approximately $1,551,000 for Fiscal Year 200112002; and approximately $2,389,000 for Fiscal Year 2002/2003, F:'HUMAIUBORlU!L\~2OOlN'<>p2000\2000FOPRaoh&tloneo.-luioAMemo.doo: AGENDA ITEM DATE R7K l-/g--{) I COMMISSION MEMORANDUM JULY 18, 2001 COMMISSION MEETING PAGE 2 In addition, bargaining unit employees will receive a forty dollar ($40,OO) a month pay supplement after December 2, 2000, for International accreditation pay and an additional ten dollars ($10.00) a month for state accreditation pay. This will cost $307,440 the first year, $475,800 the second year, and $475,800 the third year. This is in recognition of the department's efforts to become internationally accredited, Furthermore, it creates an incentive for unit members to continue to work at high levels to maintain the accreditation. In our effort to defray the City's operating expenses for the take-home vehicle program approved in 1994, all bargaining unit employees who are issued a take-home vehicle will now be assessed a user fee for each biweekly pay period in which they are assigned a vehicle, The fee is based on the location of the primary residence of the employees as specified below: Miami Beach Residents Dade County (Other than Miami Beach) Broward County Palm Beach County (as limited below) $0 (Per pay period) $25.00 (per pay period) $30.00 (per pay period) $45.00 (Per pay period) Five (5) sworn officers who reside in Palm Beach have been added to the take-home vehicle program and these employees will pay forty five ($45,00) per pay period. In addition, there will be no new vehicles to new sworn officers hired after the ratification date living in Broward or Palm Beach County. OTHER ECONOMIC ISSUES The "Must Use" cap has been changed so that an employee can accrue up to 360 vacation hours on retirement can receive a payout up to 480 hours, A post 1978 employee shall be entitled to a termination payout of up to one half (12) of accrued sick leave up to 480 hours on or before September 30,2001, and 600 hours on or before October I, 2001. The old payout was one half (Y2) of 360 hours. In addition to the above, a pilot sick leave buyback program will be implemented in the second year of the contract. Sellback of up to 60 hours annually with 3 incidents* of sick leave usage within the preceding twelve (12) month period d, Sellback of up to 40 hours annually with 4 incidents* of sick leave usage within the preceding twelve (12) month period * An incident is defined as no more than five (5) consecutive work days for the same illness/injury. Per past practice, employees will be reviewed annually under the City's performance merit plan, The merit plan for this bargaining unit will provide a five percent (5%) Step increase on the employee's anniversary date to those employees who receive a satisfactory evaluation during the rating period, A change will be in the Pension Plan so that members with 20 or more years of creditable service who are eligible to receive normal or early retirement benefits under the System may also purchase up to an additional six percent (6%) multiplier, in increments of three percent (3%), provided the combined total of additional years of creditable service purchased pursuant to paragraph (A), above, may not exceed 2 years if a member purchases an additional six percent (6%) multiplier, or 3 years if the member purchases an additional three percent (3%) multiplier. The cost for each additional three percent (3%) multiplier purchased shall be the same as the cost for each year of prior public safety service or military service. For purposes of this purchase, an employee may use the value of accrued sick and/or annual leave, valued at the employee's hourly rate at the time of purchase. The health insurance contributions are status quo, However, there will be a Joint Labor Management Committee to consider and make recommendations for alternative proposals regarding group health coverage and or alternative methods for determining amount of City's contribution to the FOP Health Trust, Changes in the promotions article: Any employee who applies for a promotion must have twenty- four (24) months of satisfactory service. Other changes were made to clarify the process.
