A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING
AN AMENDMENT TO THE ONE-YEAR ACTION PLAN
COMPONENT OF THE CITYIS CONSOLIDATED PLAN FOR
FEDERAL FUNDS FOR FISCAL YEAR 1995/96 AND
AMENDING THE CITY1S MIDDLE BEACH COMMERCIAL
FACADE REHABILITATION PROGRAM GUIDELINES
ELIMINATING THE TWO-TO-ONE REQUIREMENT OF THE
MATCHING GRANT.
WHEREAS, the City's Consolidated Plan (Plan) was adopted by the Mayor and City
Commission on July 26, 1995; and
WHEREAS, the One Year-Action Plan component of the Plan for Fiscal Year
1995/96 included the project description and budget of the City's Middle Beach
Commercial Facade Rehabilitation Program (Program); and
WHEREAS, the Program Guidelines were adopted by the Mayor and City
Commission on November 21, 1996; and
WHEREAS, a "Notice of Intent to Amend" the One-Year Action Plan component
of the Plan for Federal Funds for Fiscal Year 1995/96 by eliminating the two to one
matching requirement from the Program was published on Thursday, July 18, 1996; and
WHEREAS, this amendment does not change the priorities as outlined in the Fiscal
Year 1995/96 One-Year Action Plan for the purpose, location, beneficiaries, or the total
amount of funding of the Program; and
WHEREAS, the thirty day public comment period on the "Notice of Intent to Amend"
concluded on August 19, 1996, and no comments were received by the City; and
WHEREAS, such Notice indicated that the Program Guidelines would be amended;
and
WHEREAS, the attached Amendment to the Program Guidelines eliminates the two-
to-one requirement of the matching grant; and
SECTION VII
TERMS AND CONDITIONS FOR A FACADE RENOVATION GRANT
1. General
This section sets forth the required terms and conditions for a facade renovation
grant.
2. Grant Application Review and Grant Amounts
Federal CDBG Program funds are limited. Therefore, all rehabilitation projects will
be evaluated for feasibility and economic impact. Complete rehabilitation of building
facades, signage and awnings, as well as the correction of existing code violations is
encouraged. Applications are considered on a first come, first served basis; however,
those applicants submitting requests for funding that represent a maximum level of
renovation, shall be given priority.
Grant funds are available for eligible and approved projects on a 2/3 private, 1/3
CDEG 50/50 fnnilin, match.
The City Manager shall approve all grants under the Middle Beach Commercial
Facade Rehabilitation Program.
3. Points of ~eement
The applicant shall agree, as required by the related documents, to abide by all
applicable City, State and Federal regulations, and the following terms and conditions:
a. Work Write-ups - Assure that clearly written, well- organized work write-ups
are prepared which precisely define the rehabilitation work to be undertaken. The
Program's technical specifications should be included, or incorporated by reference in
the work write-up.
b. Cost Estimates for Work Specified - A cost estimate of reasonable project
costs which is prepared by a licensed contractor, architect or engineer, and is based
on the scope of work and technical specifications contained in the work write-up shall
be provided to the Program Administrator.
c. Contractor Selection - Under the Program, the applicant may select his/her
own cpntractor and does not have to use formal competitive bidding procedures.
However, the applicant must secure written estimates from three qualified
eligible contractors. The written estimates must be based on work write-ups that
precisely define the rehabilitation work to be undertaken. The applicant must provide
the Program Administrator with copies of these estimates, and slhe shall review the

WHEREAS, the Administration recommends approval of this Amendment to the
One-Year Action Plan for Federal Funds for Fiscal Year 1995/96 and to the Program
Guidelines.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City's One-Year Action Plan component
of the Consolidated Plan for Federal Funds for Fiscal Year 1995/96 and the Program
Guidelines for the City's Middle Beach Commercial Facade Rehabilitation Program, are
hereby amended to eliminate the two-to-one matching requirement.

ADMINISTRATION RECOMMENDATION:
It is recommended that the Mayor and City Commission adopt the attached Resolution
authorizing an amendment to the One-Year Action Plan component of the City's
Consolidated Plan for Federal Funds for FY 1995/96, and amending the City's Middle
Beach Commercial Facade Rehabilitation Program Guidelines by eliminating the 2 to 1
requirement of the matching grant.
BACKGROUND:
On July 26,1995 the City Commission adopted the One-Year Action Plan component of
the City's Consolidated Plan for FY 1995/96 which included the project description and the
budget of the Middle Beach Commercial Facade Rehabilitation Program (Program), a
matching grant program for facade improvements and the correction of code violations in
a commercial area on 41 st Street between Alton Road and Prairie Avenue. On November
21, 1995 the City Commission adopted the Guidelines for this Program.
During the review and approval process of the One-Year Action Plan, the Community
Development Advisory Committee (CDAC) imposed a matching requirement for the Middle
Beach Program that was more stringent than the matching requirements on the other two
commercial programs, i.e. the programs operated by the Miami Beach Development
Corporation (MBDC) south of Dade Boulevard, and the North Beach Development
Corporation (NBDC) in North Beach.

In accordance with the recent Legal Opinion #96-019 rendered by the City Attorney, the
2 to 1 matching requirement originally required by the CDAC can no longer be imposed.
The program will now be administered as a SO/50 matching grant program which will be
consistent with the other commercial revitalization programs. The Program will continue
to provide financial assistance to property owners and business owners who are desirous
of improving their building facades, business signage, awnings, and the correction of all
exterior code violations, and whose businesses serve the income-eligible residential area.
The SO/50 match requirement will be retro-active to the date when the guidelines were
originally adopted.
ANAL YSIS:
In order to accomplish this change, an amendment to the One-Year Action Plan for FY
1995/96 is needed. Therefore, on Thursday, July 18, 1996, a "Notice of Intent" to amend
the One-Year Action Plan component of the City's Consolidated Plan by eliminating the
2 to 1 matching requirement of the City's Middle Beach Commercial Facade Rehabilitation
Program was published for a 30-day public comment period which ended on August 19,
1996. No comments were received.
This amendment does not change the priorities as outlined in the FY 1995/96 One-Year
Action Plan, [lor the purpose, location, beneficiaries, or the total amount of funding of the
City's Middle Beach Commercial Facade Rehabilitation Project.
In addition to the amendment to the Action Plan, the Middle Beach Commercial Facade
Rehabilitation Program Guidelines must be amended to eliminate the 2 to 1 requirement
of the matching grant.
CONCLUSION:
It is recommended that the Mayor and City Commission adopt the attached Resolution
authorizing an amendment to the One-Year Action Plan for component of the City's
Consolidated Plan for federal funds for FY 1995/96, and amending the City of Miami Beach
Middle Beach Commercial Facade Rehabilitation Program Guidelines by eliminating the
2 to 1 requirement of the matching grant.
