RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY
AND 2201 COLLINS FEE, LLC, IN AN AMOUNT NOT TO EXCEED $525,000,
REPRESENTING THE CITY'S CONTRIBUTION TOWARD THE DESIGN,
DEVELOPMENT, AND CONSTRUCTION BY 2201 COLLINS FEE, LLC OF
THE BEACHWALK NORTH EXTENSION BEHIND THE W-HOTEL, AT 2201
COLLINS AVENUE, AND ALSO INCLUDING THE PORTION OF THE
BEACHWALK BETWEEN THE W-HOTEL AND THE 21ST BEACHWALK
STREET END; PROVIDED FURTHER THAT, NOTWITHSTANDING THE
CITY'S CONTRIBUTION PURSUANT TO THE AGREEMENT, 2201 COLLINS
FEE, LLC SHALL BE SOLELY RESPONSIBLE FOR ANY AND ALL
ADDITIONAL COSTS ASSOCIATED WITH SAID BEACHWALK EXTENSION
DESIGN AND CONSTRUCTION, THROUGH COMPLETION.
WHEREAS, the City is developing a series of bicycle/pedestrian/greenway
projects called the Atlantic Greenway Network, made up of two main trail systems: the
Beach Corridors, which extend in a northbound/southbound direction, running between
the erosion control line and the dune system; and the Neighborhood Trails, which extend
in east/west as well as north/south directions through the South, Middle, and North
Beach neighborhoods; and
WHEREAS, the Beachwalk North Extension will create anorthbound/southbound
multi-purpose public access corridor that will promote alternative transportation, via
bicycling or walking, and will serve as a connection to businesses, residential areas,
schools, parks, and beaches; and
WHEREAS, 2201 Collins Fee, LLC owns the property at 2201 Collins Avenue
and is developing W-Hotel South Beach on that site; and
WHEREAS, the Beachwalk North Extension will extend the existing beachwalk at
21St Street north to 23~d Street and run immediately east of the W-Hotel, Collins Park,
and west of the dune; and
WHEREAS, the City finds it beneficial to create a seamless and consistent
connection from the proposed beachwalk walk, east of 2201 Collins Avenue to the
existing beachwalk, with a northern terminus at 21St Street, and 2201 Collins Fee, LLC
has offered to remove the existing wooden boardwalk behind its property and replace it
with such a beachwalk; and
WHEREAS, accordingly, the Administration and 2201 Collins Fee, LLC have
negotiated the attached Agreement whereby 2201 Collins Fee, LLC agrees to design,
develop, and construct the beachwalk which would extend from the northern propert~r
line of 2201 Collins Avenue to the northern terminus of the existing beachwalk at 21 t
Street; and
WHEREAS, the City's funding contribution under the Agreement shall not exceed
$525,000, with 2201 Collins Fee, LLC agreeing to be responsible for any and all
additional costs as required to design, develop, and construct the proposed beachwalk
extension; and
WHEREAS, the City is contributing less than 50% of the total cost of the project
while 65% of the total infrastructure being built lies directly adjacent to City-owned
Collins Park and on a public street end, representing a net benefit to the City; and
WHEREAS, Administration recommends execution of Agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission of the City of Miami Beach, Florida, approving and authorizing the Mayor
and City Clerk to execute an agreement between the City and 2201 Collins Fee, LLC, in
an amount not to exceed $525,000, representing the city's contribution toward the
design, development, and construction by 2201 Collins Fee, LLC of the beachwalk north
extension behind the W-Hotel, at 2201 Collins Avenue, and also including the portion of
the beachwalk between the W-Hotel and the 21St Street Beachwalk street end; provided
further that, notwithstanding the City's contribution pursuant to the Agreement, 2201
Collins Fee, LLC shall be solely responsible for any and all additional costs associated
with said beachwalk extension design and construction, through completion.

Item Summa /Recommendation:
The City of Miami Beach is developing a series of bicycle/pedestrian/greenway projects called the Atlantic
Greenway Network (AGN). The AGN will consist of two main trail systems; the Beach Corridors, which extend in
a northbound/southbound direction, running between the erosion control line and the dune system; and the
Neighborhood Trails, which extend in an east-west aswell asnorth-south directions through the south, middle,
and north beach neighborhoods. Individual projects will be constructed and connected to create a continuous
trail network that is supportive of alternative transportation and community enhancement.
The 2201 Collins Fee, LLC owns the property at 2201 Collins Avenue and is currently developing the W-Hotel
South Beach Project on this site. 2201 Collins Fee, LLC voluntarily offered to replace the boardwalk in the area
immediately adjacent to its eastern property boundary with a beachwalk. City-owned Collins Park lies between
the 2201 Collins Avenue property and the northern terminus of the existing beachwalk at 21st Street. The City
found it beneficial to incorporate a seamless and contiguous connection between the proposed project and the
existing northern terminus of the beachwalk by extending the project south from the 2201 Collins Fee property
(the W-Hotel) to 21st beachwalk Street end. Thus, a gap in the beachwalk pathway is avoided and the
connection between 21st Street and 23rd Street is consistent and ADA accessible.
2201 Collins Fee, LLC would enter into an agreement with the City to design, develop, construct, and partially
fund a beachwalk east of the W-Hotel and Collins Park and on 22"d Street end (Attachment A). The total linear
footage of this project is approximately eight hundred and eighty-four (884) feet, which includes three-hundred
and four (304) feet of pathway adjacent to the W-Hotel private property and five-hundred and eighty (580) feet
of pathway adjacent to the City-owned Collins Park, and as part of the 22"d Street end (Attachment B). The total
cost for design and construction of the entire pathway is approximately $1,107,225. The total cost consists of
$952,370.79 for construction (Attachment C) and $154,854.96 for architectural and engineering. The City would
agree to fund a portion of the beachwalk construction in the maximum amount of five-hundred andtwenty-five
thousand dollars ($525,000), which includes atwo-hundred and fifty thousand dollar ($250,000) contribution
toward the contract price and the reimbursement amount equivalent to the collected Right-of-Way (ROW)
occupancy charges not to exceed two-hundred and seventy-five thousand dollars ($275,000). Thus, the City is
contributing 47% of the total cost of the project while 66% of the total infrastructure being built lies directly
adjacent toCity-owned Collins Park and on the public street end. The City is receiving a net benefit through this
agreement by obtaining the portion of the beachwalk adjacent to public property and the street end at a
substantial savings to the tax payers.

FUNDING
Funding for the City share of the project is in Fund 160, 2% Resort Tax Fund Balance, in
the amount of $525,000.
ANALYSIS
The City of Miami Beach is developing a series of bicycle/pedestrian/greenway projects
called the Atlantic Greenway Network (AGN). The AGN will consist of two main trail systems:
the Beach Corridors, which extend in a northbound/southbound direction, running between
the erosion control line and the dune system; and the Neighborhood Trails, which extend in
an east-west as well as north-south directions through the South, Middle, and North Beach
neighborhoods. Individual projects will be constructed and connected to create a continuous
trail network that is supportive of alternative transportation and community enhancement.
The boardwalk is an elevated wooden structure built in the mid-1980's that is dedicated
solely to pedestrian use and does not allow for the use of bicycles. The boardwalk structure
has a discrete lifespan and it will eventually be replaced in its entirety throughout the City.
The beachwalk projects consist of on-grade, ADA accessible pathways that support bicycle
use and other recreational activities that are in line with the goals of the AGN. Beachwalk
pathways can be constructed out of pavers or other durable material, as deemed
appropriate by the state regulatory authorities. Both the boardwalk and beachwalk lie on
State lands and are City-owned and maintained structures.
2201 Collins Fee, LLC owns the property at 2201 Collins Avenue and is currently developing
the W-Hotel South Beach Project on this site. 2201 Collins Fee, LLC voluntarily offered to
replace the boardwalk in the area immediately adjacent to its eastern property boundary with
a beachwalk. City-owned Collins Park lies between the 2201 Collins Avenue property and
the northern terminus of the existing beachwalk at 21st Street. The City found it beneficial to

2201 Collins Fee, LLC and the City have negotiated an agreement where 2201 Collins Fee,
LLC will design, develop, construct, and partially fund the beachwalk east of the W-Hotel
and Collins Park and on 22"d Street End (Attachment A). The total linear footage of this
project is approximately eight hundred and eighty-four (884) feet, which includes three-
hundred and four (304) feet of pathway adjacent to the W-Hotel private property and five-
hundred and eighty (580) feet of pathway adjacent to the City-owned Collins Park, and as
part of the 22"d Street end (Attachment B). The total cost for design and construction of the
entire pathway is approximately $1,107,225. The total cost consists of $952,370.79 for

The total project cost for the beachwalk section from 21St Street to 23rd Street of $1,107,225
is comparable to that which the City paid for the North Beach Recreation Corridor (NBRC).
The section of beachwalk built for the City by the W Hotel cost approximately $1,253 per
linear foot, while the cost of constructing the NBRC was approximately $1,163 per linear
foot. Some price difference is to be expected as the two beachwalk sections are built of
different materials, pavers in the case of the W Hotel section and a decorative concrete in
the case of the NBRC.
For the beachwalk section to be built by the W Hotel, the City would agree to fund a portion
of the beachwalk construction, in the maximum amount of five-hundred and twenty-five
thousand dollars ($525,000). This cost includes atwo-hundred and fifty thousand dollar
($250,000) contribution toward the contract price and the reimbursement amount equivalent
to the collected Right-of-Way (ROW) occupancy charges, not to exceed two-hundred and
seventy-five thousand dollars ($275,000). Thus, the City is contributing 47% of the total cost
of the project while 66% of the total infrastructure being built lies directly adjacent to City-
owned Collins Park and on the public street end. The City is receiving a net benefit through
this agreement by obtaining the portion of the beachwalk adjacent to public property and the
street end at a substantial savings to the taxpayers.
The Project began following Art Basel in December 2008 with the demolition of the existing
boardwalk wooden structure between 21St and 23rd Streets. The beachwalk extension is
currently well under construction and will ultimately extend the existing beachwalk at 21St
Street to the northern boundary of the property owned by 2201 Collins Fee, LLC, as
particularly described in the agreement. The project is currently in the final phase of
construction. The curbing associated with the project is complete and the pavers have all
been laid. Once the Florida Fish and Wildlife Conservation Commission (FWC) has
approved the turtle-friendly lights the contractor will install the electrical components to
complete the project. At this time, the City will reimburse 2201 Collins Fee, LLC only for the
portion of the project that is already complete. The beachwalk extension is an important
connector that will further expand the multi-purpose public access corridor already in
existence between 14tt' Place and 21St Street (Beachwalk I). In addition to the pathway, the
project will include the installation of native vegetation and sea-turtle friendly lighting.
Completion is expected in late spring.
CONCLUSION
The Administration recommends that the Mayor and City Commission of the City of Miami
Beach, Florida, adopt the Resolution approving and authorizing the Mayor and City Clerk to
execute an Agreement between the City and 2201 Collins Fee, LLC, in the estimated
amount of $525,000, representing the City's contribution toward the design, development,
and construction by 2201 Collins Fee of the beachwalk north extension behind the W-Hotel,
at 2201 Collins Avenue, and also including the portion of the beachwalk between the W-
Hotel and the 21St beachwalk street end; provided further that, notwithstanding the City's
contribution pursuant to the Agreement, 2201 Collins Fee, LLC, shall be solely responsible
for any and all additional costs associated with said beachwalk extension design and
construction through completion and appropriating $525,000 from the 2% Resort Tax Fund
Balance.
