A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING AND
APPROPRIATING THE THIRD AMENDMENT TO THE POLICE
CONFISCATION TRUST FUND BUDGET FOR FISCAL YEAR
2008/09 IN THE AMOUNT OF $88,065 TO BE FUNDED FROM THE
PROCEEDS OF STATE CONFISCATED FUNDS
WHEREAS, Section 932.7055, Florida Statutes, addresses the purpose and procedures to
be utilized for the appropriation and expenditures of the Police Confiscation TrustFund; and
WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for
appropriation and expenditures exist and the appropriation and expenditure of forfeiture funds is in
compliance with Section 932.7055, Florida Statutes, and the Guide to Equitable Sharing of Federally
Forfeited Property for Local Law Enforcement Agencies; and
Fund.
WHEREAS, funds in the amount of $88,065 are available in the Police Confiscation Trust

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission for the City of
Miami Beach hereby adopt the Third Amendment to the Fiscal Year 2008/09 Police Confiscation
Trust Fund Budget in the amount of $88,065, to be funded from the proceeds of State Confiscated
Funds as reflected in the attached Exhibit "A".

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Florida Statute 932.7055 provides for expenditures of forfeiture funds for law enforcement
purposes.
The Miami Beach Chief of Police, Carlos Noriega, has reviewed and identified the need for
the appropriation and has established that the expenditures of forfeiture funds are in
compliance with Section 932.7055, Florida State Statutes, and the Guide to Equitable
Sharing of Federally Forfeited Property for Local Law Enforcement Agencies. These
forfeiture funds have been deposited in the Police Confiscation Trust Fund. The City has
complied with all statutory procedures involved in the transaction of these funds.
CONCLUSION
The Administration recommends that the Mayor and City Commission adopt the Third
Amendment to the Operating Budget for the Police Confiscation Trust Fund for Fiscal Year
2008/09 in the amount of $88,065, to provide for the expenses listed in Exhibit "A".

STATE FUNDS:
TRAINING EQUIPMENT $ 20,000
Equipment needed to maintain and continue in-service training programs to include
protective tactical gear ($5,000), fitness equipment ($5,000), and replacement of
safety equipment which was purchased over 15 years ago ($10,000).
MOTORCYCLE FOG LIGHT SET - 15 SETS 5,230
This light helps provide additional visibility at night and in adverse weather conditions.
It also provides much needed additional visiblity for approaching traffic. In view of the
recent high speed accident that ocurred on a poorly lit highway, these lights are
necessary and beneficial. They are already being used by other departments.
LASERFICHE DATA STORAGE SOLUTION 24,335
This product will inventory and archive digital files stored on the Police area of the
Storage Area Network (SAN). This is necessary to save valuable storage space on
the network and provide a means to rapidly conduct searches for digital documents
throughout the entire Police Department.
CRIME PREVENTION INITIATIVES:
EXPLORER SUMMER PROGRAM-Summer Academy and youth program for 15 12,500
youths in the Police Explorer Program.
TEEN JOB CORP to employ at risk youths between the ages of 14-18, who are full 5,000
time students from low to moderate-income families living in Miami Beach and keep
them off the street during the reported peak hours of juvenile delinquent behaviors.
DRUG FREE YOUTH IN TOWN (D.F.Y.I.T.)to provide drug prevention programs and 10,000
activities for youths.
ADULTS AND YOUTH CHILDREN WITH UNMET NEEDS DESERVE ATTENTION 10,000
(AYUDA) to help improve the lives of children and families who are underserved
and/or at risk through education, life skills training, and programs that support self
sufficiency.
SUNFLOWER SOCIETY to provide art classes to youngsters in after-school programs. 1,000
