The subject ITB is hereby amended as follows: Questions and Answers Q1. On page PGD-001 between 5-03 and S-04 the plans depict 15" Storm water, but on PGD 031 the cross section shows 12" Storm water. This error is repeated between structures S-12A & S-13 and others. Please clarify? A1. The pipe size between structures S-03 and S-04 is 12"-diameter. Any other discrepancy, the size of the pipe shown on plan shall govern. Q2. Bid break down (Addendum #2 dated 11/03/08) does not correlate with the actual structures type or size of structures shown on the plans. A2. If in the opinion of the Contractor there are certain items on the Bid Breakdown that are not included in the project, the Contractor shall indicate "N/A" on the Form. At the same time, Contractor may include additional items to the Bid Breakdown, as appropriate. Q3. Bid break down (Addendum #2 dated 11/03/08) pg. 6 item 144 and item 145 does not correlate with any trees shown on the plans. No 18' Shade Trees or 18' Specimen Shade Trees are shown but yet they appear on the bid breakdown. Please specify if you want the unit prices for these two items to be included. A3. See A2 above. Q4. On Meridian Ave between 2"d St. and 3~' St. there is 2' of concrete in poor condition between proposed sidewalk and the property lines. Should the contractor add this additional 1300 SF of sidewalk replacement to our base bid? A4. NO. This area should not be added by bidders. Q5. On Meridian Avenue there are at least 4 large existing trees in which the roots have up °^ heaved the existing sidewalk causing a safety hazard to pedestrians. Upon removing ITB No. 48-07/08 South Pointe Phase II Addendum #4 November 10, 2008 Page 1 of 1 '~ sidewalk and installation of proposed sidewalk it will require the pruning of the aforementioned roots. Being that the removal of a large portion of the tree root structure may compromise the stability of the tree, should the Contractor include any of the additional cost for the possible removal of these large trees in his lump sum bid or will it be dealt with via Change Order? A5. The removal of these trees would only be considered as a last resource. Alternative options will be explored on a case by case basis in the field. Contractor shall follow Technical Specification Section 02931 -Tree Protection in particular attention needs to be given to the section 3.03 and 3.04 root and construction (canopy) pruning to ensure viability of trees. This section addresses root and crown pruning. Contractor shall follow the Guidelines established by the International Society of Arboriculture. It is recommended that a certified arborist be hired to follow these standards closely. Q6. Sheets LA016 to LA019 of the plans list encroachments which are either to be removed or to remain. A note at the bottom of these sheets reads, "Encroachments not labeled as ET-2 shall be either removed or remain as part of Base Bid." Can the City please clarify what work is required for both the ET-2 encroachments and those not labeled as ET-2 encroachments? A6. Encroachment tables clearly denote what items are to be removed or retained. Contractor shall refer to section 2020- Removal of Encroachments, in technical specifications. Q7. In Addendum #2, the answer to question #1-c reads. "The Contractor shall excavate ,,,~,, and remove unsuitable material to a depth of 24" below the bottom of the pipe, and to a depth of 36" below pavement grade where no pipe is installed." Q7a. Will any kind of geotextile fabric be required to be installed around the envelope of the excavation within the muck layer or between the muck layer and the clean subgrade material? Ala. Geotextile fabric conforming to AASHTO M288-00, Class 1 shall be installed around the envelope of the excavation between the muck layer and the clean fill. Installation shall be per manufacturer's recommendations. Q7b. Will the City provide an area in the near proximity of the project area where the muck (approx. 8000 CY) can be temporarily allowed to drain over a period of several days prior to hauling? A large area will also be needed to store the clean fill which will be needed on a daily basis to replace the unsuitable material being removed. Alb. The City will not provide any staging area for the Contractor. Bidders must make all arrangements for the necessary storage in the base bid. Q7c. Can the Contractor store this wet muck material in the City R.O.W on an adjacent street of the work zone for several days to allow it to dry prior to hauling? A7c. Refer to Section 01550, 1.01 C, 1.03, and 1.04 of the Technical Specifications. Q8. In Addendum #2, the answer to question #15 reads. "Use Asphalt Type S-1 2" thick throughout." Type S-1 Asphalt can only be laid in a minimum lift thickness of 1-1/4" ,~--~ ITB No. 48-07/08 South Pointe Phase II Addendum #4 November 10, 2008 Page 2 of 4 and a maximum thickness of 2-1/2" (see FDOT Spec. 334-1.3.1). This would mean that the 2" thickness of S-1 asphalt now required can only be placed in one lift. Would the City like to revert back to the requirement of 2" of S-III asphalt in 2 lifts or would they like the single 2" lift of S-1 asphalt? A8. Previous answer to the question is amended as follows: 2" thick asphalt shall be installed in two layers as follows: First (bottom) layer shall be 1-%" thick FDOT Type SP-12.5. Second (top) layer shall be 3/0" thick FDOT Type SP-9.5. Q9. The revised scope sheets sent by the City include the following items that we are requesting further clarification on: Q9a. Item 5 MOT -Will the City require off-duty police presence at any time during construction? Aga. Yes. At a minimum, Bidder's shall plan for an off-duty police officer where construction operations encroach on traffic lanes at the intersections of Alton Road, Lenox Avenue, Michigan Avenue, Jefferson Avenue, Meridian Avenue, Euclid Avenue, and 5m Street; as well as Second, Third, and Fourth Streets. (Previously responded to in A14 in Addendum No. 2) Q9b. Item 54 Bulk Excavation -What is the intent of this item? ,..,. A9b. If in the opinion of the Contractor there are certain items on the Bid Breakdown that are not included in the project, the Contractor shall indicate "N/A" on the Form. At the same time, Contractor may include additional items to the Bid Breakdown, as appropriate. Q9c. Item 55 Geosynthetic Reinforced Foundation -What is the intent of this item and where will it be required? A9c. The FOR has provided Boring Logs, however no Engineer will certify that this is a complete and accurate account of the type of material that will be encountered at every length and depth of the excavation require, which is why most Contracts, even Lump Sum Contracts, have a prevision for "Unforeseen Conditions". The City of Miami Beach is stating tha# it is the Contractor's responsibility to perform additional soil borings, but prior to bid can be unrealistic due to the costs and time involved. The City of Miami Beach has a report which indicates 2' to 12' below existing grade, organic material is revealed. The report has 30 SPT borings some stop at elevation 5', 8', and 12' below existing grade. Many of the test reports do not continue to good material, so it is even unclear if unsuitable material will extend beyond 12'. a) Can the City provide a specification for "Unforeseen Conditions" specifically for unsuitable material? ,r- b) Can cross-sections be provided indicating the soil layers? c) Specification, states to excavate and remove unsuitable material to a depth of 2' below the bottom of the pipe. A ; 3: a}According to Sheet WIVI-000, Construction Notes No. 11 states "Contractor to install additional valve (vdhere not shown on plans} at tees and crosses so that each leg of the tees and crosses will have an isolated valve. This vrork will be paid under the alternate bid item for isolation valves at all crosses and tees". For clarification, the total number of isolation valves in a tee will be three (;)and the total number of isolation valves in a cross will be four (4~ For example. if the plans show 2 valves in a tee, then that means that an additional isolation valve will be needed on.the other leg of the tee. b} See response to item: a) above. 14. Section 01570, 1.04, Flag Person or Off-Duty Officer Oversight. "As a minimum, the Contractor shall assume that the oversight will be required at the following locations: (CONSULTANT to detail the oversight requirements at individual intersections as per direction from Public Works Department.)" The price difference between a Flagger and an Off-Duty City of Miami Police Officer is very different. Can the Consultant provide this "detail", prior to bid so that the prices can be estimated according to the locations of work where the Consultant will require an Off-Duty Officer? A14: At a minimum, Bidder's shall plan for an aff-duty police officer where construction operations encroach on traffic lanes at the intersections of Alton Road, Lenox Avenue, Michigan Avenue; Jefferson Avenue, Meridian Avenue, Euclid Avenge, and 5"' Street; as well as Second, Third, and Fourth Streets. 15. Plan HS016, states to "See Specification", but I did see it in the sidewalk sections of the specifications. A15: Disregard the reference to specifica~ions. There is only one paver driveway as per the drawings. Pavers shall match existing. 17. What is the status of the DEP Permit for the Drainage Well? Who is the contact person at DEP that is processing the permit? A17: The ©EP Permit for the Drainage Well has not been appl€ed fo*. Obtaini:~g the DEP permit is tha respor_sibility of the Contractor and is typically pulled by the well driller. The bid price for the wells shall include obtaining the permit and providing the Reasonable Assurance Report required by FDEP. The addendum talks about milling 1" and overlaying a total of 1.5" of asphalt in the alleys (where the water mains go) but the restoration items in the water main . section of the schedule of values has no milling called out and the asphalt called for is 2" thick (#81). Does this mean we will be creating a 1" height ,•-, differences or do we feather in the 1"? There are no Milling and Resurtacing areas other than the Alley's, so what is Item #93 to be used for? At 8 locations, the water main installation extends beyond the milting and resurtacing area and the new pavement areas. There is a detail in the plans, WM 011 which explains the restoration required. However, does the City of Miami Beach Public Works have a requirement to restore full lane"? A41: The locations are to be restored according to the Construction Documents. 42. On 2"~ Street, as discussed at the Pre-Bid Meeting, the existing roadway's profile is not "level", for lack of another word. THE DEADLINE FOR THE RECEIPT OF BIDS IS HEREBY EXTENDED TO 3:00 PM ON NOVEMBER 7, 2008. Sealed bids will be received by the City of Miami Beach Procurement Division, 3rd Floor, 1700 Convention Center Drive, Miami Beach, Florida 33139, until 3:00 p.m. on the 7th day of November 2008. Questions and Answers: Q1: Page 48 of the Invitation to Bid lists the permits that the City has obtained for this project. There are several construction permits which are not listed here such as SFWMD Dewatering Permit (fee varies on amount of water pumped), DERM Dewatering Permits (fee varies on duration), etc. Are any additional permits which may be required for this project to be paid for or reimbursed by the City in a similar fashion? A1: Yes, Permits will be paid by the Contractor and reimbursed by the City. The Contractor shall be reimbursed only for the actual amount of the permit or impact fee levied by the municipality or agency. Q2: Will City or the Contractor be responsible for pulling the SFWMD Dewatering Permit? A2: The Contractor will be responsible for pulling the SFWMD Dewatering permit. Q3: If Contractor is required to pull SFWMD permit, will delays in the agency's processing of this permit be translated into a Contract Time Extension should the delay occur? SFWMD has been known to take up to 90 days to process this permit. A3: Two (2) Notices to Proceed will be issued for this Contract. The successful Contractor shall commence scheduling activities, permit applications and other preconstruction work within five (5) calendar days after the Project initiation date (the date of the First Notice Proceed). The Second Notice to Proceed will not be issued until the Contractor submits to the City all required documentation and the Contract is executed. The receipt of all the necessary permits by the Contractor and acceptance of a the full progress schedule, schedule of values, is a condition precedent to the issuance of the Second Notice to proceed to mobilize on the Project site and commence with physical work. (Refer to Article 2 of the Agreement, titled Contract Time). Q4: Please provide information on whether there are any known contamination areas within a '/4 mile radius of the work zone, regardless of whether the Contractor or City is pulling the SFWMD Permit. A4: To the best of our knowledge, there are no known contaminants within the project boundaries of the South Pointe Phase II Project. Contractor is to note Section 01010, article 1.04 Site Investigations. Appendix "A" of the Project Manual contains the "Report of Geotechnical Exploration" prepared by Nutting Engineers and dated September 2006 and Appendices B and C contains the Subsurface Investigation Reports prepared by FR Aleman. "~ Q5: Assuming Contractor is responsible for pulling the SFWMD Permit, will the City issue a Change Order for delays and/or additional compensation for any change in construction methods (i.e. sheet piling, monitoring wells, reduced pumping, Hazmat protection, etc.) required by SFWMD as a result of existing contamination? Perhaps the City should consider adding a Contingency for such occurrences. A5: In the event that during the course of the Work, the Contractor encounters subsurface or concealed conditions at the Project site which differ materially from those shown in the Contract Documents, or unknown physical conditions of the project site, of an unusual nature, which differ materially from that ordinarily encountered and generally recognized as inherent in the work of the character called for in the Contract Documents, the City will address in accordance with the Contract Documents. (Page 106 of the Contract Documents) Q6: The plans call for only the North half of 2"d Street to be fully reconstructed. However, there is a note on sheet 19 of the plans (Note 16) which states, "Pavement removal, in addition to the pavement scheduled to be removed as shown on these sheets, will be required to obtain the proposed grading. This pavement removal shall be part of the Contractor's Bid Price." Is it correct to interpret that the addition South portion of this roadway (an additional 1200 SY) may have to removed and replaced to matched to the North portion at no additional cost? A6: The Contractor shall remove the minimum amount of pavement (full ,,,,~, reconstruction including base, sub-base and asphalt), on the south portion of the 2"d Street roadway, as required to "meet and match" in order to obtain the proposed grading, at no additional cost. Q7: Note 3 under "Typical Reinforcement at Street Corners" on Sheet 50 of the plans states, "Reinforce sidewalks and ramps within a 35' radius with #4 at 6" O.C.E. W. bottom." Will this requirement supersede the Miami Beach minimum standards which have no such requirement? A7: The Contract Documents, in some cases, may supersede the minimum standards established by the Florida Building Code and/or the "Miami Beach minimum standards". In this particular, case, the typical reinforcement at street corners, is to remain as per the Contract Documents. Q8: The profile views of the water main plans depict specific lengths of pipe which are required to be restrained. This may be interpreted to mean that restraining is not required outside of these boundaries. Please clarify if only the portions delineated in the plans are to be restrained or if the City of Miami Beach standard to restrain all water main piping will be enforced. A8: Only what is shown on the profile will be restrained, and not the entire piping system, with the understanding that Section 02713 -Water Distribution System needs to be complied with, including but not limited to, article 2.05A.5, which states "Pipe and fitting 24-inches in diameter and smaller shall be push-on or mechanical joint pipe and mechanical joint fitting, with restrained joints, and concrete thrust blocks shall be used at all reaction points"(EMPHASIS ADDED) Q9: Note 27 under "Drainage Notes" on Sheet 3 of the plans states, "The material of storrnwater pipe shall be HDPE, except when the pipe cover is less than 21 ". In such cases the material of the pipe shall be RCP." Are we to assume that all piping can be HDPE as long as it has more than 21" of cover, or are we to follow the Miami Beach standard which states that HDPE Pipe can only be used for pipe with a 24" diameter or less A9: To the best of our knowledge, the project does not have any pipe sizes larger than 24" diameter. Addendum #1 will modify the "27" of cover" to read "24" of cove". HDPE Pipe may be utilized in pipe sizes up to 24" in diameter. In the event that the ground cover is less than 24" ,then the detail "Reinforced Concrete Slab" shown on drawing PG&D039 may be utilized, subject to the approval requirements part of the detail. Q10: Note 15 under "Paving Notes" on Sheet 3 of the plans states, "Compaction shall be accomplished by rolling with any type of equipment which will produce the required density." Does Miami Beach have an Ordinance minimizing the amount of vibration allowed in residential areas? If so, what measures will be required of the contractor to ensure that this requirement is met? A10: Contractor shall review the requirements of the Contract Documents, including . but not limited to Section 01010, article 1.27 Vibratory Compaction. Q11: In reference to detail 4 on sheet 197 of the plans, will the City enforce their ,,~,„ standard of requiring a "box within a box" to waterproof their electrical splices, or will other methods of waterproofing be allowed as long as N.E.C. requirements are met? Please note that this requirement forces the size of the pull box to be sufficient in size to fit the inner box. A11: The requirements of a "box within a box" to waterproof electrical splices is part of the Contract Documents. Please refer to sheet 197, drawing E015, detail 4. It is the intention of the Consultant to enforce that particular requirement. Q12: Although it is stated on Page 50 of the ITB that "Cost component of AWARD WILL BE BASED ON LUMP SUM BID SUBMITTED," it is not clear if the "For Information Purposes Only" unit quantity breakdown that is required to be submitted with the bid, will be utilized to compare with final quantities constructed for purposes of the City claiming a credit against the Contract Amount. Please clarify. A12: The unit quantity breakdown is FOR INFORMATIONAL PURPOSES ONLY, and will not be compared with the final quantities constructed for the purposes of claiming a credit to the City, or issuing a credit to the Contractor. However, the unit prices may be utilized in evaluating Change Orders, which will be subject to negotiations. Q13: Although the unit quantity breakdown is "FOR INFORMATIONAL PURPOSES ONLY", will discrepancies or errors by the Contractor in quantification or unit prices be grounds for an additive or deductive change order if it is not caught until after construction has commenced? A13: This will be a LUMP SUM CONTRACT. The unit quantity breakdown is for informational purposes only, and no additive or deductive change order will be given if there is an error in the quantities. Q14: Will a change order for additional scope or quantities than what is tabulated in the unit quantity breakdown be subject to a renegotiation of unit price? A14: The bid is a LUMP SUM BID. The unit quantity breakdown is for informational purposes only. Notwithstanding, the unit prices for Change Orders, for any out of scope work will be subject to negotiation of the unit prices. (Also refer to A12). Q15: Does the unit quantity breakdown total cost need to match the lump sum price submitted with the Bid? A15: Yes. The unit quantity breakdown must match the Grand Total Bid. Q16: Will the unit quantity breakdown be utilized as a schedule of values for progress payments or will a separate schedule of values be created based on a more broad organization of work. A16: The unit quantity breakdown will not be utilized as the Schedule of values for progress payments. A separate Schedule of Values will be required in accordance Section 01026 of-the Technical Specifications. Q17: Items #79, 83, and 84 in the Unit Price Breakdown on Page 54 of the ITB have the note (Contingency Item) after them. Please clarify if this is to mean that the money allotted in these items is subject to whether this work is done or if it will be paid regardless as part of the Lump Sum Contract. A17: The word "Contingency Item" is hereby removed by this Addendum to the ITB. Q18: Are the addendums issued from the first bidding of this project effective for this rebid? If so, please provide copies of these addendums so that they may be once again acknowledged by all bidders. A18: The previous Addendums are included as an Attachment to the Bid for informational purposes only. Q19: Is the concrete curb and gutter to be built with Grey colored concrete or Miami Beach Red concrete? A19: The concrete curb and gutter is to be built with "Grey colored concrete". Q20: Will the Contractor be responsible for hiring a company to perform density testing or will the City absorb that responsibility and cost? Please clarify. A20: Section 01410 -The section entitled "Testing Laboratory Services" of the Contract Documents identifies what tests will be provided by the CITY Q21: Are both 1" lifts of S-III Asphalt Roadway allowed to be applied in the same day under the same mobilization, or will the City require that the final lift be performed all at once at the end of the project under a separate mobilization? A21: Reference is made to Section 01010, article 1.06E.5., which reads in part "A '~"' roadway shall be considered substantially complete when all work is complete except for the final lift of asphalt'. The final lift shall be performed as part of the final completion of the project. Contractor is to patch around all existing and new structures as required to provide a smooth surtace. Q22: If separate mobilizations are required, will temporary striping be required for both lifts? A22: Temporary striping will be required immediately after the completion of the first lift and the final striping will be required after the final lift. Q23: Add Alternates #2 and #3 on Page 50 of the ITB have fixed values assigned to them. How does the City want to the Contractor to include any credit or addition to the costs that they determine for these items in their bid? Fixing these values force the Contractor to perform these alternates at a price determined by the City. A23: For Alternate Number 2, bidders must provide a unit price (per ton) for cleaning the existing storm drainage system as specified. For Alternate Number 2, bidders must provide a price for vacuum cleaning and reconstituting a single drainage well. An allowance will then be included in the Contract for these items. Q24: Are there any "black-out" dates, such as the period from Thanksgiving to New Years, in which the City will not allow the Contractor to perform work? If this is contained in a City Ordinance, please cite which Ordinance as a reference. A24: With the exception of Public Holidays, and City Code requirements, we are not aware of any "black-out" dates at this time. Please also refer to Section 01010-6 of the Technical Specifications. Q25: Note 21 under "Earthwork Notes" on Sheet 2 of the plans states, "It is the Contractor's responsibility to perform additional soil borings to verify the limits of unsuitable material on-site," and Note 4 in the same section states, "It is the Contractor's responsibility to verify the unsuitable material present on-site and include the removal and replacement of same in his bid." These two notes imply that the Contractor is responsible for whatever soil materials are encountered during construction and should somehow estimate and incorporate the removal and replacement of this material in his bid. Being as it is required that the Engineer determine whether the material is unsuitable, that the financial burden should not be placed on each bidding Contractor to perform additional borings, and being that soil borings only provide limited information on the actual soil conditions of the project site, will the City consider utilizing a contingency item to be paid by a unit price for actual quantities of unsuitable material removed so that the risk and cost differential between bidders for this particular item can be controlled to some extent? A25: For additional information, Contractor is referred to Section 01010, article 1.04 Site Investigation. Q26: Will award of contract be based on only the base bid, or on the base bid plus add alternates selected by the City? A26: The Award of Contract will be based on the Lowest and Best Bid. The evaluation as to the bidders' pricing will be based on Total Lump Sum Base Bid, plus; none, any or all the Alternates which will be selected at the City's sole discretion. Q27: Please refer to the insurance requirements, page 98/144, Section 7.1.4, "Builders Risk insurance is for the construction of and/or addition to above ground buildings or structures is/is not required." If there are no structures involved, then shouldn't this requirement be waived? A27: Yes. Q28: This project is LUMP SUM and per the Administrative Evaluation Process, page 29/144, states 60 points will be provided for the "BASE BID". a) Is the Base Bid only Division 1, Division 2, and Division 16? b) Since the Bid Tabs on pages 51 /144 to 57/144, have to be completed, do these sheets have to total the "BASE BID" amount? c) The Bid Tabs on pages 51/144 to 57/144; do not provide quantities. Will part of your evaluation be the quantities calculated by the Contractor and reviewed against what the FOR has already calculated? Can these quantities be provided as an addendum? d) After evaluation of the Administration of the "Base Bid", will the City Manager review the costs of the Add Alternates? There are no quantities for the add alternates, does the Engineer have an estimate of these quantities? Can this be provided as an Addendum? If one Contractor estimated one of these add alternates with a high quantity and a low costs, but the evaluation is based on another quantity the evaluation can be unbalanced. e) If the project is to a Lump Sum Project and the 60 points given to the Contractor with the "Lowest Base Bid", then no quantities should be required by the Contractor at Bid and evaluated. If the process is going to evaluate the Contractor on the quantities estimated with quantities estimated by the Engineer, can these quantities be provided as an Addendum? We understand that these are only an estimate, and the contractor should verify the quantities and will not be provided additional change orders for quantities that are wrong, only for items of work that are added to the contract. f) A Schedule of Payment Values is required after the return of the executed Agreement to the City. Isn't this the same as the Bid Tabs from Page 51/144 to 57/144? Or can it be different? A28a): The base bid plus none, any, or all of the add alternates at the City's sole discretion. A28b): Yes. I understand that many questions were raised at this meeting, however many more may be raised by the submittal of this change of 35 plans. a) When can we expect to see the 35 plan sheets that have been revised? b) No Quantities have been provided to date, with this revised plan, can we get a list of changes per plan sheet?
