A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, GRANTING AND AUTHORIZING THE
MAYOR AND THE CITY CLERK TO EXECUTE AN EASEMENT IN FAVOR
OF FLORIDA POWER AND LIGHT, AS REQUIRED FOR THE
PLACEMENT OF ASSOCIATED UNDERGROUND ELECTRICAL
CONDUITS THAT SERVE THE MULTIPURPOSE MUNICIPAL PARKING
FACILITY (MMPF), IN SUCH FORM AS SHALL BE APPROVED
SATISFACTORY TO THE CITY MANAGER AND THE CITY ATTORNEY'S
OFFICE.
WHEREAS, pursuant to Resolution No. 2007-26706, on October 17, 2007, the City
Commission awarded Invitation to Bid No. 34-06107 for the construction of the Multipurpose
Municipal Parking Facility (MMPF). in the amount of 526,769.000; and
WHEREAS, in order to expedite the work required to provide the electrical service to the
Project, the Ciry signed a letter of intent with Florida Power and Light (FPL) in February 2009 to
record the required easement within three (3) months; and
WHEREAS, the contractor has completed the installation of the electrical conduits in order to
accurately represent them in the legal description and easement sketch; and
WHEREAS, the easement must be approved for FPL to complete the installation of the
electrical service.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby grant and
authorize the Mayor and the City Clerk to execute an easement in favor of Florida Power And Light
for the placement of associated underground electrical conduits that serve the MMPF: in such form
as shall be approved satisfactory to the City Manager and the City Attorney's Office.

In order to expedite the work required to provide the electrical service to the project, the City signed a letter of
intent with FPL in February 2009 to record the required easement within three months. The contractor has
completed the installation of the electrical conduits and has documented their location in a legal description
and an easement sketch that are attachments to the easement.
The garage portion of the Project is expected to achieve substantial completion in July 2009. The executed
easement is required by FPL before the final electrical service connection is made.

POWER AND LIGHT FOR THE PLACEMENT OF ASSOCIATED
UNDERGROUND ELECTRICAL CONDUITS THAT SERVE THE
MULTIPURPOSE MUNICIPAL PARKING FACILITY.
Approve the Resolution
FUNDING
No funding is required in order to record the easements.
ANALYSIS
As per Resolution No. 2006-26327 on September 6, 2006, the City Commission approved theaddition of
a 7th parking level to the Multipurpose Municipal Parking Facility (MMPF). In order to expedite the
construction of the MMPF, the Administration decided to phase the construction of the garage and award
the construction of the foundation of the structure while the drawings were amended to include the 7th
floor and obtain the proper permits.
As per Resolution No.2007-26706 on October 17, 2007, City Commission awarded the contract to the
Tower Group pursuant to Invitation to Bid No. 34-06/07 for the now seven stories tall parking structure
and five stories office space MMPF in the amount of $26,769,000.
In order to expedite the work required to provide the electrical service to the project, the City signed a
letter of intent with FPL in February 2009 to record the required easement within three months. The
contractor has completed the installation of the electrical conduits and has documented their location in a
legal description and an easement sketch that are attachments to the easement.

CONCLUSION
The Administration recommends that the City grant and authorize the Mayorand the City Clerk to execute
the easement in favor of FPL forthe placement of associated underground electrical conduits that serve
the MMPF.
