2009-27063 Reso Inc.RESOLUTION NO. 2009-27063 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, GRANTING AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE EIGHT (8) INDIVIDUAL EASEMENTS IN FAVOR OF FLORIDA POWER AND LIGHT (FPL) FOR THE PLACEMENT OF TRANSFORMERS AND ASSOCIATED UNDERGROUND ELECTRICAL CONDUITS THAT SERVE SEVERAL WATER AND WASTEWATER PUMP STATIONS THROUGHOUT THE CITY FOR THE WATER AND WASTE WATER PUMP STATIONS UPGRADES PROJECT (WWWPSU), IN SUCH FORM AS SHALL BE APPROVED SATISFACTORY TO THE CITY MANAGER AND THE CITY ATTORNEY'S OFFICE. WHEREAS, as part of the Citywide WW WPSU, FPL was required to install electrical service to the upgraded andlor newly built pump stations; and WHEREAS, normally, FPL requires that easements granted to it and recorded priorto providing electrical service to newly constructed or renovated facilities; when the WWWPSU construction contract was awarded, the City and FPL agreed to approve it; and WHEREAS, the City agreed to approve and record all the subject easements (needed to construct the electrical services to all the stations) at the end of the project; this agreementwas needed due to the complexity and nature of these stations and the requirement of providing the service as expeditiously as possible and with the least possible service interruption: and WHEREAS, now that the WWWPSU is completed, FPL requires the City to grant the easements that currently service the following pump stations and their associated electric conduits: Pump Station 1, at 1051 Jefferson Avenue: Pump Station 10, at Belle Isle; Pump Station 21, at 971 71' Street; Pump Station 22, at the Normandy Golf Course; Pump Station 23, on 75'" Street and Dickens Avenue; Pump Station 27, at 5400 Collins Avenue; Pump Station 29; at 6310 Indian Creek Drive; and Pump Station W- 4 at 1050 Arthur Godfrey Road. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby grant and authorize the Mayor and the City Clerk to execute eight (8) individual easements in favor of Florida Power And Light for the placement of transformers and associated underground electrical conduits that serve several Water and Waste Water Pump Stations Upgrades Project, in such form as shall be approved satisfactory to the City Manager and the City Attorney's Office. Issue: Shall the City grant the easements? Normally, FPL requires that easements be recorded prior to providing electrical service to new constructed or renovated facilities. When the WWWPSU Project was awarded for construction, there was a verbal agreement between the City of Miami Beach and FPL. This agreement was needed due to the complexity and nature of these stations and the requirement of providing the service as expeditious as possible and with the least possible service interruption. The verbal agreement required the City to record all the easements at the completion of the Project. ADMINISTRATION RECOMMENDATION Adopt the Resolution. FUNDING No funding is required in order to record the easements. ANALYSIS On August 8, 1998, the City issued an Invitation to Bid (ITB) for the Water and Wastewater Pump Station Upgrades Project (Bid No. 99-97198), and on February 3, 1999, under Resolution No. 99- 23061,the City Commission awarded the construction contract for the project to Felix Equities, Inc., in the amount of $17,692,568. On June 7, 2002, as a result of the default of Felix Equities, the City terminated the contract, and entered into litigation against the contractor and its surety bonding company, United States Fidelity R Guaranty Company. During the course of the litigation, all sides agreed to settle the cases and in Resolution No. 2004-25765A, the City of Miami Beach approved the settlement amount. The City then procured a new contractor to resume the work that Felix Equities had started. Pursuant to Resolution No.2004-25465, the City Commission awarded the re-procurement contract to Widell Inc. (Widell), in the amount of $17,352,615, and work commenced throughout the City. On March 16, 2005, Resolution No.2005-25847 approved the appropriation of additional funds to include a new telemetry system and add miscellaneous scope to the project. As part of the Citywide WWWPSU Project, FPL was requested to install electrical service to the upgraded and/ or newly built pump stations without the standard recorded easement. Normally, FPL requires that easements be recorded prior to providing electrical service to new constructed or renovated facilities. W hen the W W W PSU Project was awarded for construction, there was a verbal agreement between the City of Miami Beach and FPL.
