SUBJECT: ADMINISTRATION AGREEMENT FOR MIAMI BEACH MARINA
BETWEEN CITY AND REDEVELOPMENT AGENCY
The Miami Beach Redevelopment Agency, in coordination and conjunction with the City of
Miami Beach, has been performing zoning, planning, administrative, consulting and .other
community .redevelopment functions and services within the City Redevelopment area. The
Redevelopment Agency's tax increment funds have also been the major source of funding for
the planning and legal services required in bringing the Miami Beach Marina construction
project to fruition.
On June 24, 1983, the City of Miami Beach, as owner, entered into a lease agreement with
Carner-Mason Associates, Ltd., as lessee, for the Miami Beach. Marina. The lease
agreement will result in a minimum annual guaranteed rent or an annual percentage rent of
gross income (whichever may be greater) being paid to the City. Over the first ten years of
the term, a minimum of $3,040,000 rent will accrue.
An Administration and Management Agreement for the Marina between the City, as owner,
and the Redevelopment Agency, as Administrator, has been drafted. The Administration
Agreement would result in the Redevelopment Agency: 1) taking responsibility for
managing, directing, supervising, coordinating and otherwise performing the administration
of the Miami~Beach Marina lease agreement on behalf of the City; 2) furnishing to the City
contract and lease administration, zoning and planning, and legal services and functions
within the Redevelopment area including the Marina and surrounding property; 3) receiving
the rental sum the City receives from Carner-Mason Associates, Ltd., for the Miami Beach
Marina during the first ten years of the term of the lease; such rental sums to be used solely
for community redevelopment purposes.
On July 20, 1983, both the City Commission and Redevelopment Agency approved in
principle entering into a Marina Administration Agreement.
The Administration Agreement further permits either party to cancel and terminate the
lease agreement upon the giving of 30-days written notice of its intention to so terminate.
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission approve the Administration
Agreement between the City of Miami Beach and the Redevelopment Agency for the City
Marina and authorize the Mayor and City Clerk to execute same in accordance with the "in
principle approval" given by the City on July 20, 1983.
