2009-27070 ResoRESOLUTION NO. 2009-27070 A RESOLUTION OF THE MAYOR AND CITY COMMISION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A JOINT PARTICIPATION AGREEMENT WITH MIAMI-DADE COUNTY FOR THE CONSTRUCTION OF THE VENETIAN CAUSEWAY STREETSCAPE IMPROVEMENT PROJECT. WHEREAS, Miami-Dade County (the County), through its Public Works Department, is managing the Venetian Causeway streetscape Improvement Project (the Project), which will consist of roadway improvements to include sidewalks, stormwater improvements, curb and gutters, raised landscape medians, bike lanes, decorative roadway lighting, tree planting, signalization, pavement markings, signage, and other streetscape improvements; and WHEREAS, in 1999, when the City General Obligation Bond (GO) was approved, an allocation, in the amount of $1,827,000, was included for streetscape improvements for the Venetian Causeway, from the City limits to Dade Boulevard; and WHEREAS, Resolution No. 2005-26020, dated October 19, 2005, approved an Interlocal agreement (ILA) between the City and the County, which delineated the parties respective rights in the implementation of the planning, design, and construction of the Project, including the City's contribution of $180,000 for design costs; and WHEREAS, the Project is at the 100% design level and the estimated construction cost is $7,868,688, which will be funded with County, City of Miami, and City funds, as well as with Federal funding; and WHEREAS, the City is the recipient of $1,000,000 in Federal Transportation Enhancement Program (TEP) funds for the Project, which the City has agreed to pass through to the County for the Project; and WHEREAS, the City is required to enter into a Joint Participation Agreement (JPA) with the County for the City's contribution for construction costs of the Project, in the amount of $2,564,179; of this contribution, $1,000,000 is from TEP Funds and $1,564,179 is from the balance of 1999 GO Bond funds; and WHEREAS, the Administration would recommend that the Mayor and City Commission approve the attached Joint Participation Agreement (JPA) with Miami-Dade County for the Venetian Causeway streetscape Improvements Project. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute a Joint Participation Agreement (JPA) with Miami-Dade County (MDC) for the construction of the Venetian Causeway streetscape Improvement Project. The County will begin the bid process to hire a licensed general contractor to construct the Project upon receipt of the notice to proceed from the Florida Department of Transportation (FDOT), which manages the federal funding. To date, Local Agency Program (LAP) Agreements for all federal funds have been executed with FDOT. The City must enter into a Joint Participation Agreement (JPA) with the County for the City's contribution for construction costs of the Project in the amount of $2,564,179. Of this contribution, $1,000,000 is from federal Transportation Enhancement Program (TEP) Funds and $1,564,179 is from the balance of 1999 GO Bond funds. Pursuant to the JPA, the City shall make payments to the County for the City's financial contribution on a reimbursement basis. The reimbursements are due to the County within thirty (30) days of City's receipt of a proper invoice. For the TEP Funds, the City will forward the County's invoices to FDOT for reimbursement. Upon receipt, the City will forward the funds to the County. THE ADMINISTRATION RECOMMENDS APPROVAL OF THE RESOLUTION. ADMINISTRATION RECOMMENDATION Adopt the Resolution. AMOUNT AND FUNDING Previously appropriated funding in the amount of $1,564,179 from FY 2005-06 2003 General Obligation Bonds and previously appropriated Transportation Enhancement Program (TEP) Fund in the amount of $1,000,000. BACKGROUND In 1999 when the General Obligation Bond (GO) was approved by the Mayor and City Commission, an allocation of $1,827,000 was included for the Venetian Causeway Streetscape Project (the Project) for improvements from the City limits to Dade Boulevard. The improvements were for streetscape and above the surface enhancements and did not contain any below ground utility improvements. The City determined that the proposed improvements for the Venetian Causeway necessitated an Interlocal Agreement (ILA) between the City, the City of Miami (Miami) and Miami-Dade County (County), since all three have some jurisdiction over the Venetian Causeway and are therefore involved in a part of the planned improvements. On October 2005, the City Commission approved an Interlocal Agreement (ILA) with the County, which delineated the obligations and rights that both parties would have in the implementation of the Project and how the funding contribution from the City will be incorporated. The ILA determined that the County will manage the design and construction of the Project. In a letter to the County dated November 21, 2003, the City agreed to provide the County with $1,827,000 for the Project (see Attachment 1, Contribution Letter). The ILA stated that the City will only fund that portion of the project that is within the City's Right of Way (ROW). The ILA also stated that the City would provide $180,000 towards the commissioning of a consultant to plan and design the Project in accordance to the Master Plan previously approved. From the $1,827,000 available, the City paid the County $180,000 for the design of the Project, and also paid $76,821 to Hazen and Sawyer for project management fees. The remaining funds available total $1,570,179 and the County has requested $1,564,179, leaving a balance for the City of $6,000. Venetian Causeway JPA May 13, 2009 Page 2 of 2 CURRENT STATUS The Project is at a 100% design level and will consist of roadway improvements to include sidewalks, stormwater improvements, curb and gutters, raised landscape medians, bike lanes, decorative roadway lighting, tree planting, signalization, pavement markings, signage, and other streetscape improvements on the Venetian Causeway. The estimated construction cost for the Project is $7,868,688, which will be funded with County, Miami, and City funds as well as with federal funding (see Table 1). The total funding available in the amount of $7,869,179 exceeds the estimated construction cost by $491.00. The County will begin the bid process to hire a licensed general contractor to construct the Project upon receipt of the notice to proceed from the Florida Department of Transportation (FDOT), which manages the federal funding. Genera( Obligation Bond funds can only be used for above-ground improvements inGuding the following: curb, gutter, and sidewalk replacement; tree planting and landscaping; lighting; and street resurtacing. General Obligation Bond funding can also t>e used to pay for the planning and design of these eligible improvements. General Obligation Bond funding cannot be used far the design or construction of water, sanitary sewer, stormwrater improvements, or the undergrounding of above-ground utilities such as e{ectric, telephone, and cable. The funding can also only be used within the City limits of the City of Miami Beach. In addition, the use of Genera! Obligation Bond funding must be approved by the City's General Obligation Band Oversight Committee which meets on the first Monday of each month and by the Miami Beach City Commission. In addition, the City of Miami Beach has allocated $550,000 in Road Impact Fees for the installation of traffic signals at the following locations: {1) Venetian Causeway and Diiido Drive; (2) Venetian Causeway and East Bridge; (3) Venetian Causeway and West Bridge; (4) Venetian Causeway and Rivo Alto Drive; (5) Venetian Causeway and San Marino Drive; {ti) Venetian Causeway and Island Avenue (E); and Venetian Causeway and Island Avenue (V1l). The City of Miami Beach remains committed to implementing the Venetian Causeway Improvement Project. It has been and continues to be the City's desire to enter into a joint agreement with the County and the City of Miami to implement this project. However, the City of Miami Beach also wants to ensure that various standards and procedures that have been developed to improve the project implementation process are utilized to the greatest extent possible in this project.
