13713RESOLUTION NO. 13713 A RESOLUTION CALLING A SPECIAL ELECTION, TO BE HELD ON NOVEMBER 7, 1972, FOR THE PURPOSE OF SUBMITTING A REFERENDUM QUES- TION AND PROPOSED CHARTER AMENDMENTS TO THE ELECTORATE OF THE CITY OF MIAMI BEACH, FLORIDA, FOR THEIR APPROVAL OR REJECTION. BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 - That a special election be and the same is hereby called and directed to be held in the City of Miami Beach on November 7, 1972, for the purpose of submitting a referendum question and the following proposed amendments to the Charter of the City of Miami Beach, for the approval or rejection of the electorate; the proposed questions being as follows: 1. SHALL THE CITY CHARTER BE AMENDED TO PROVIDE AS FOLLOWS: "THE PERSONNEL BOARD, NOT LATER THAN TEN DAYS AFTER RECEIPT OF SUCH APPEAL, SHALL FIX A PLACE AND A TIME FOR HOLDING A PUBLIC HEARING WITHIN A REASONABLE TIME THEREAFTER AT WHICH HEARING THE OFFICER OR EMPLOYEE SUSPENDED, REDUCED OR REMOVED SHALL HAVE THE RIGHT TO APPEAR AND BE HEARD IN PERSON, OR BY COUNSEL." 2. SHALL THE CITY CHARTER BE AMENDED TO PROVIDE AS FOLLOWS: "FROM AND AFTER THE PRIMARY ELECTION IN NOVEMBER 1971, ANY OFFICER OF THE CITY ELECTED BY THE PEOPLE THEN HOLDING SUCH OFFICE, AND WHO HAVING THERETOFORE OR THEREAFTER HAS HELD SAID OFFICE FOR A PERIOD OF EIGHT YEARS, HE SHALL, UPON THE TERMINATION OF HIS SERVICE, AND UPON HIS HAVING ATTAINED THE AGE OF 55 YEARS, BE PAID BY THE CITY DURING HIS LIFETIME, A SUM EQUAL TO 40% OF THE AMOUNT OF THE ANNUAL SALARY THAT HE WAS PAID BY THE CITY AT THE TIME OF THE TERMINATION OF HIS SERVICE, AND THE CITY SHALL LIKEWISE PAY TO SUCH OFFICER IN LIKE MANNER AND UNDER LIKE CONDITIONS A SUM EQUAL TO 50% OF SUCH SALARY IF SUCH OFFICER HAS SO SERVED FOR A PERIOD OF 12 YEARS; AND A SUM EQUAL TO 60% IF SUCH OFFICER HAS SO SERVED FOR A PERIOD OF 16 YEARS, AND A SUM EQUAL TO 80% IF SUCH OFFICER HAS SERVED FOR 20 OR MORE YEARS; AND WHEREBY THE SAID ELECTED OFFICER WILL CONTRIBUTE AN AMOUNT EQUAL TO THE AMOUNTS CONTRIBUTED BY THE GENERAL EMPLOYEES UNDER THE CITY'S GENERAL PENSION FUND." 3. SHALL THE CITY CHARTER BE AMENDED TO PROVIDE AS FOLLOWS: "THE CITY COUNCIL SHALL CAUSE TO BE PLACED ON THE BALLOT TO BE USED IN SAID PRIMARY ELECTION THE NAME OF ANY QUALIFIED ELECTOR OF THE CITY WHO, NOT MORE THAN FORTY-FIVE DAYS NOR LESS THAN THIRTY DAYS PRIOR TO SAID PRIMARY ELECTION, SHALL HAVE PAID TO THE CITY CLERK FOR THE CITY OF MIAMI BEACH A SUM EQUAL TO 7-1/2% OF THE ANNUAL SALARY OF THE OFFICE TO WHICH HE SEEKS ELECTION AS A QUALIFYING FEE OR UNLESS SUCH PERSON SHALL FILE WITH THE CITY CLERK NOT LESS THAN TEN DAYS PRIOR TO THE LAST DAY FOR QUALIFYING AS A CANDIDATE FOR SUCH OFFICE, A PETITION APPROVING HIS CANDIDACY SIGNED BY SUFFICIENT QUALIFIED AND REGISTERED VOTERS TO CONSTITUTE NOT LESS THAN TWO PER CENT OF THE NUM- BER OF SUCH VOTERS AS THE SAME SHALL BE ON THE DATE SIXTY DAYS PRIOR TO THE DATE OF THE PRIMARY ELECTION." SHALL THE CITY CHARTER BE AMENDED TO PROVIDE AS FOLLOWS: "COMMENCING WITH THE ELECTION IN NOVEMBER 1973, THERE SHALL BE NO PRIMARY ELECTION, AND COMMENCING IN NOVEMBER 1973 AND EVERY TWO YEARS THEREAFTER, THERE SHALL BE BUT ONE GENERAL ELECTION FOR COUNCILMEN AND THE MAYOR,AND THE CANDIDATES RECEIVING THE HIGHEST NUMBER OF VOTES CAST AT SAID ELECTION SHALL BE DEEMED ELECTED." 5. The referendum question to be submitted shall be as follows: "SHALL THE CITY OF MIAMI BEACH CHANGE ITS METHOD OF ELECTION TO DISTRICTING FOR THE PURPOSE OF ELECTING COUNCILMEN?" 6. SHALL THE CITY CHARTER BE AMENDED TO PROVIDE AS FOLLOWS: "THE CITY COUNCILMEN SHALL BE ELECTED FROM THREE COUNCIL DISTRICTS, AS SHOWN ON THE MAP ON FILE IN THE OFFICE OF THE CITY CLERK. THREE COUNCILMEN SHALL BE ELECTED IN NOVEMBER 1973; ONE BEING ELECTED FOR EACH DISTRICT NUMBERED I, II, AND III FOR FOUR-YEAR TERMS, AND AN ELECTION SHALL BE HELD IN LIKE MANNER EVERY TWO YEARS THEREAFTER. ONLY THOSE VOTERS RESIDING IN THE PARTICU- LAR DISTRICT MAY VOTE FOR CANDIDATES FOR COUNCILMAN QUALIFYING FOR ELECTION IN A PARTICULAR DISTRICT. CANDI- DATES FOR COUNCIL MUST RESIDE WITHIN THEIR DISTRICT AT LEAST SIX MONTHS, AND IN THE CITY AT LEAST ONE YEAR PRIOR TO QUALIFYING. THE MAYOR SHALL HOLD OFFICE FOR A TERM OF TWO YEARS, AND CANDIDATES FOR MAYOR NEED NOT RESIDE IN A PARTICULAR DISTRICT AND SHALL BE VOTED UPON BY ALL OF THE ELECTORS OF THE CITY. MEMBERS OF THE CITY COUNCIL HOLDING OFFICE PRIOR TO THE ELECTION TO BE HELD IN NOVEMBER 1973 SHALL HOLD OFFICE UNTIL THE EXPIRATION OF THE TERMS FOR WHICH THEY WERE ELECTED. "ANY MEMBER OF THE CITY COUNCIL INCLUDING THE MAYOR WHO CEASES TO BE A QUALIFIED ELECTOR OF AND RESIDE IN THE CITY OR WHO FOR A PERIOD OF SIX MONTHS FAILS TO ATTEND COUNCIL MEETINGS WITHOUT GOOD CAUSE SHALL IMMEDIATELY FORFEIT OFFICE. ANY COUNCILMAN WHO CEASES TO RESIDE IN THE DISTRICT FROM WHICH HE WAS ELECTED SHALL IMMEDIATELY FORFEIT HIS OFFICE. ANY ELECTED OR APPOINTED CITY OFFICIAL WHO HOLDS ANY OTHER ELECTIVE OFFICE, WHETHER FEDERAL, STATE, OR MUNICIPAL, SHALL FORFEIT HIS CITY POSITION. ANY APPOINTED OFFICIAL OR EMPLOYEE OF THE CITY OF MIAMI BEACH WHO QUALIFIES AS A CANDIDATE FOR ELECTION OF ANY FEDERAL, STATE OR MUNICIPAL OFFICE SHALL IMMEDIATELY FORFEIT HIS CITY POSITION. ALL SUCH VACANCIES SHALL BE FILLED IN THE MANNER PROVIDED IN THE CHARTER." 7. SHALL THE CITY CHARTER BE AMENDED TO PROVIDE AS FOLLOWS: "THE CITY COUNCILMEN SHALL BE ELECTED FROM THREE COUNCIL DISTRICTS, AS SHOWN ON THE MAP ON FILE IN THE OFFICE OF THE CITY CLERK. THREE COUNCILMEN SHALL BE ELECTED IN NOVEMBER 1973; ONE BEING ELECTED FOR EACH DISTRICT NUM- BERED I, II, AND III FOR FOUR-YEAR TERMS, AND AN ELECTION SHALL BE HELD IN LIKE MANNER EVERY TWO YEARS THEREAFTER. ONLY THOSE VOTERS RESIDING IN THE PARTICULAR DISTRICT MAY VOTE FOR CANDIDATES FOR COUNCILMAN QUALIFYING FOR ELECTION IN A PARTICULAR DISTRICT. CANDIDATES FOR COUNCIL NEED NOT RESIDE WITHIN THEIR DISTRICT. SHALL THE CITY CHARTER BE AMENDED TO PROVIDE AS FOLLOWS: "THE CITY COUNCILMEN SHALL BE ELECTED FROM SIX COUNCIL DISTRICTS, AS SHOWN ON THE MAP ON FILE IN THE OFFICE OF THE CITY CLERK. THREE COUNCILMEN SHALL BE ELECTED IN NOVEMBER 1973; ONE BEING ELECTED FOR EACH DISTRICT NUM- BERED I, II, AND III FOR FOUR-YEAR TERMS AND IN NOVEMBER 1975, THERE SHALL BE ONE COUNCILMAN ELECTED FOR EACH DISTRICT NUMBERED IV, V, AND VI FOR FOUR-YEAR TERMS, AND AN ELECTION SHALL BE HELD IN LIKE MANNER EVERY TWO YEARS THEREAFTER. THREE COUNCILMEN SHALL BE ELECTED IN NOVEMBER 1973; ONE BEING ELECTED FOR EACH DISTRICT NUM- BERED I, II, AND III FOR FOUR-YEAR TERMS, AND AN ELECTION SHALL BE HELD IN LIKE MANNER EVERY TWO YEARS THEREAFTER.
