RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, EXTENDING THE DEADLINE FOR
COMPLIANCE WITH ORDINANCE NO. 96-3045, REGARDING
RETROFITTING OF EXISTING HIGH RISE BUILDINGS WITH
SPRINKLERS OR ENGINEERED LIFE SAFETY SYSTEMS (AS OUTLINED
IN RESOLUTION NO. 96-22048), FROM SEPTEMBER 30, 2001, TO
JANUARY 1, 2002, TO COINCIDE WITH NEW STATE STANDARDS.
WHEREAS, the State of Florida has adopted a new Statewide fire code, entitled the
"Florida Fire Prevention Code", with the effective date of January 1, 2002; and
WHEREAS, said Fire Prevention Code outlines the schedule for compliance with the
requirements for retrofitting existing high-rise residential buildings; and
WHEREAS, said Fire Prevention Code supersedes all local ordinances; and
WHEREAS, said Fire Prevention Code mandates the submission of an intent to comply
within 180 days of implementation and up to 12 years for completed installation.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission hereby extend the deadline for compliance with Ordinance No. 96-3045, regarding
retrofitting of existing high rise buildings with sprinklers or Engineered Life Safety Systems (as
outlined in Resolution No. 96-22048) from September 30,2001, to January I, 2002 to coincide with
new State standards.

Adopt the Resolution.
ANALYSIS
In 1996, the Commission adopted Ordinance No. 96-3045 requiring compliance with the 1991
edition of the Life Safety Code, specifically the clause which required that all existing high-rise
residential properties be retrofitted with either a Full Automatic Sprinkler System or an Engineered
Life Safety System. This was followed by adoption of Resolution No. 96-22048 outlining a time
frame for compliance with a deadline of September 30, 2001. In the interim, the State of Florida has
written and enacted the Florida Fire Prevention Code, with an effective date of implementation of
January 1, 2002. This State Code further addresses the issue of sprinkler retrofit, and outlines a
schedule of compliance different from that of the local resolution.
The Florida Fire Prevention Code mandates that high-rise residential buildings provide either a fully
automatic sprinkler system or an Engineered Life Safety System within 12 years of adoption of the
code. It further requires that the affected properties file an "intent to comply" within 180 days of
implementation of the code. This will require the submission, and approval, of a plan for compliance
within that time frame. This is the same as has been required in the local resolution, but provides an
extended time frame. As this code supercedes all local legislation, this resolution is necessary to
bring our local resolution into alignment with the new State standard.
CONCLUSION
The City Commission should adopt this Resolution.
