A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF M1AMl BEACH, FLORIDA, IN SUPPORT OF
THE PASSAGE OF REVISION 9, "THE BASIC RIGHTS
AMENDMENT" TO THE FLORIDA CONSTITUTION' AND
URGING THE VOTERS OF MIAMI BEACH AND OF THE
STATE OF FLORIDA TO VOTE IN FAVOR OF PASSAGE OF
REVISION 9, "THE BASIC RIGHTS AMENDMENT" TO THE
FLORIDA CONSTITUTION, TID~ NOVEMBER 3,1998.
WHEREAS, the Florida Constitution Revision Commission has proposed R.evision 9 to
the Florida Constitution for consideration by the voters of the State of Florida during the election
to be held November 3.1998; and
WHEREAS, Revision 9, "The Basic Rights Amendment", would recognize the equality
ofwomcn and also protect the rights oftbose ofall national ori2ins; and
WHEREAS, the Florida Constitution CUlTently prohibits discrimination based on race,
religion or physical handicap, but not on gender or national origin, thereby ignoring a majority of
the people of florida~ and
WHEREAS, the Florida Constitution should recognize and protect the individual ri2hts
of all Floridians, especially in view if the wide diversity if the population of the State of Florida;
and
WHEREAS, Revision 9 would change the term "physical handicap" to the more
appropriate term "physic~ disability" in the Basic Rights provision of the Florida Constitution.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THE CITY OF MIAMI
BEACH SUPPORTS THE PASSAGE OF REVISION " "THE BASIC RIGHTS
AMENDMENT" TO THE FLORIDA CONSIUl1TION AND HEREBY URGES THE
VOTERS OF MIAMI BEACH AND OF THE STATE OF FLORIDA TO VOTE IN
FAVOR OF PASSAGE OF REVISION 9, "THE BASIC RIGHTS AMENDMENT" TO
THE FLORIDA CONSTITUTION, THIS NOVEMBER 3,1998.

REVISION 9 TO THE FLORIDA CONSTITUTION
The Commission on the Status of Women has requested that the City Commission
approve the attached resolution in support of Revision 9 to the Florida Constitution. This
Revision prohibits discrimination on the basis of gender and national origin. The Florida
Constitution currently prohibits discrimination on the basis of race, religion, or physical
handicap. The amendment also changes the words "physical handicap" to "physical
disability. "
Please place this item on the October 21, 1998 agenda for consideration by the
Commission. The Commission on the Status of Women has requested an afternoon time-
certain in order to address the Commission.

RECOMMENDATION
Approve the Resolution
BACKGROUND
The Florida Constitution Revision Commission has proposed a revISIon to the Florida
Constitution that would recognize the equality of women and prohibit discrimination based on
"national origin". It would also make a technical amendment to change the words "physical
handicap" to "physical disability". The proposal will appear as Revision 9 on the ballot on
November 3. 1998. The Florida Constitution currently prohibits discrimination based on race.
religion or physical handicap, but makes no mention of gender or national origin.
The Miami Beach Commission on the Status of Women strongly supports Revision 9 and is
working to ensure its passaie in November. We believe that the Florida Constitution should be
inclusive of all the diverse groups reflected in Florida's population. No one should be left out of
its legal protections, especially women. It would be truly fitting and appropriate if in 1998, when
the nation is celebrating the I 50th anniversary of the Women's Rights Movement in this country,
the people of Florida approve an equal rights amendment for women.
CONCLUSION
The City Commission should approve the resolution in support of the passage of Revision 9,
"The Basic Rights Amendment" to the Florida Constitution and urging the voters of Miami
Beach and of the State of Florida to vote in favor of passage of Revision 9, "The Basic Rights
Amendment" to the Florida Constitution, this November 3, 1998.
