REPEALER.
That all ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
SEVERABILITY.
If any section, subsection, clause, or provision of this ordinance is
held invalid, the remainder shall not be affected by such invalidity.
EFFECTIVE DATES.
The bi-weekly compensation set forth in Section 1 above shall be
effective the first full payroll period that begins on or after
September 25, 2000; the bi-weekly compensation set forth in
Section 2 above shall be effective the first full payroll period that
begins on or after September 24,2001; and the bi-weekly
compensation set forth in Section 3 above shall be effective the
first full payroll period that begins on or before September 30,
2002, respectively.

ADMINISTRATION RECOMMENDA TlON
The Administration recommends that the City Commission adopt the Ordinance on second and final
reading.
BACKGROUND
The first reading of the Ordinance took place on September 5. 2001.
On July 9, 2001, after over twenty (20) session, negotiators for the City and IAFF successfully
concluded negotiations for a three (3) year collective bargaining agreement.
The Union membership has reviewed the proposed Agreement and voted to ratify it as presented.
While negotiators for the City and the Union were obliged to represent the best interests of their
"clients", the shared goal was to produce an Agreement that guaranteed equitable and competitive
compensation and working conditions. The following is a summary of the most significant changes
from the previous Agreement.

WAGES
The term of the Agreement will extend for three (3) years from October 1, 2000 through September
30, 2003. Effective with the first full payroll period that begins on or after September 25, 2000,
bargaining unit employees will receive a four percent (4%) salary Increase. Effective with the first
full payroll period that begins on or after September 24, 2001, bargaining unit employees will receive
a four percent (4%) salary increase. Effective with the first full payroll period that begins on or
before September 30, 2002, bargaining unit employees will receive a four percent (4%) salary
increase.
Based on current, active employees the estimated cost for the wage increases are approximately
$455,910 for Fiscal Year 2000/2001; approximately $1,397,763 for Fiscal Year 200112002; and
approximately $1,423,168 for Fiscal Year 200212003.
In addition, bargaining unit employees will receive a forty dollar ($40.00) a per pay period
supplement after December 2, 2000, for advanced support responder pay and an additional ten
dollars ($10.00) effective October 1, 2001. This three (3) year accreditation pay program will cost
approximately $668,160. The union agrees to work with the City to attain accreditation through the
Commission on Fire Accreditation International. After accreditation is achieved, these payments
will be contingent upon maintenance of accreditation. Furthermore, it creates an incentive for unit
members to continue to work at high levels to attain and maintain the accreditation.
OTHER ECONOMIC ISSUES
Effective September 30,2002, the paramedic certification pay will increase from six percent (6%)
to seven percent (7%).
Effective January 2002 a one-half (V2) shift shall be added to the floating holiday and one-half ('h)
shift shall be added to the birthday holiday.
The "Must Use" cap has been changed so that an employee can accrue up to 360 vacation hours on
retirement can receive a payout up to 480 hours.
A post 1978 employee shall be entitled to a termination payout of up to one hundred percent (100%)
of accrued sick leave of up to 120 hours on or before September 30,2001, and fifty percent (50%)
of remaining accrued sick leave of up to 240 hours.
In addition to the above, a pilot sick leave buyback program will be implemented in the second year
of the contract. The program can be discontinued at the City Manager's sole discretion at the end
of the contract term.

a. Minimum balance of 360 hours (540 hours for shift employees) of
combined sick and vacation leave to participate in the pilot program
b. Sellback of up to 100 hours (150 hours for shift employees) annually with
0-2 incidents" of sick leave usage within the preceding twelve (12) month
period
c. Sellback of up to 60 hours (90 hours for shift employees) annually with 3
incidents" of sick leave usage within the preceding twelve (12) month
period
d. Sellback of up to 40 hours (60 hours for shift employees)annually with 4
incidents" of sick leave usage within the preceding twelve (12) month
period
e. Termination/retirement value at up to 120 hours paid at one hundred
percent (100%). With any remaining up to 240 hours paid at fifty percent
(50%).
.. An incident is defined as no more than five (5) consecutive work days for the same
illness/injury for non-shift employees and three (3) consecutive work days for the
same illness/injury for shift employees.
Overtime will now be calculated on a ninety-six (96) hours per pay period instead of eighty (80)
hours. This will mean considerable savings in overtime payments. The City will convert vacation
and sick leave to reflect these changes.
The parties also agree to meet and discuss minimum staffing as part of a Labor Management
Committee.
A change will be in the Pension Plan so that members with 20 or more years of creditable service may
purchase up to 2 years for prior firefighter experience and members with 20 or more years of
creditable service who are eligible to receive normal or early retirement benefits under the System
may also purchase up to an additional six percent (6%) multiplier, in increments of three percent
(3%), provided the combined total of additional years of creditable service purchased pursuant to
paragraph (A), above, may not exceed 2 years if a member purchases an additional six percent (6%)
multiplier, or 3 years if the member purchases an additional three percent (3%) multiplier. The cost
for each additional three percent (3%) multiplier purchased shall be the same as the cost for each year
of prior public safety service or military service. For purposes of this purchase, an employee may use
the value of accrued sick and/or annual leave, valued at the employee's hourly rate at the time of
purchase.
The health insurance contributions are status quo. However, there will be a Joint Labor Management
Committee to consider and make recommendations for alternative proposals regarding group health
coverage and or alternative methods for determining amount of City's contribution to the Firefighter
Health Trust.

Changes in the promotions article were made to clarify the process.
CONCLUSION
Ratify the attached collective bargaining agreement negotiated between the City of Miami Beach and
lAPP, and adopt the attached resolution authorizing the Mayor and City Clerk to execute the
Agreement.
