A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, WAIVING
DEVELOPMENT REGULATIONS PURSUANT TO SECTION 142-
425(d) OF THE LAND DEVELOPMENT REGULATIONS FOR THE
PROPOSED REGIONAL LIBRARY FACILITY, LOCATED IN THE
COLLINS PARK CULTURAL CAMPUS AREA, SAID WAIVER
REGARDING THE 24 OF THE 82 REQUIRED PARKING SPACES
FOR THE LlBRRARY FACILITY AS REQUIRED UNDER
CHAPTER 130 OF THE LAND DEVELOPMENT REGULATIONS.
WHEREAS, the new Regional Library facility, to be located on 22nd Street and Liberty
Avenue, Miami Beach is anticipated to commence construction in January 2002 and be completed
within 18 months thereafter; and
WHEREAS, this facility is an integral part of the Cultural Campus, which includes the
expansion and renovation of the Bass Musenm, the new Miami City Ballet facility and a proposed
renovation of the Rotunda; and
WHEREAS, in order for the Library to obtain final approvals on the plans permitting
review, it is necessary to waive certain development regulations pertaining to the Library facility's
required parking, pursuant to Chapter 130 of the City's Land Development Regulations, which has
been determined to be 82 parking spaces of which a waiver will be required for 24 parking spaces;
and
WHEREAS, 58 parking spaces will be provided on the Fruitstand and King parcels; and
WHEREAS, pursuant to Section 142-425(d) the Mayor and City Commission may waive
development regulations following a noticed public hearing advertised in a newspaper at least fifteen
(15) days prior to the hearing; and
WHEREAS, on September 5, 2001, the Mayor and City Commission adopted a Resolution
setting the public hearing to consider the development regulation waiver on today's date; and
WHEREAS, at this time, the proposed Regional Library facility construction docnments
have been reviewed and signed off by all permitting disciplines with exception of the Planning
Department approval for compliance with parking requirements; and
WHEREAS, waiver of development regulations for the 24 parking spaces, will enable final
plans approval and for a construction bid to be issued and award of construction contract will be
expected in November 2001.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby waive the above described development regulations pursuant to Section 142-
425(d) of the Land Development Regulations for the proposed Regional Library facility, located in
the Collins Park Cultural Campus area, said waiver being specifically for 24 of the 82 reqnired
parking spaces for the Library facility as required under Chapter 130 of the Land Development
Regulations.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
The new Regional Library facility, to be located on 22m! Street and Liberty Avenue, Miami Beach
is anticipated to commence construction in January 2002 and be completed within 18 months
thereafter. This facility is an integral part of the Cultural Campus, which includes the expansion and
renovation of the Bass Museum, the new Miami City Ballet facility and a proposed renovation of
the Rotunda.
In order for the Library to obtain final approvals on the plans permitting review, it is necessary to
waive certain development regulations pertaining to the Library facility's required parking, pursuant
to Chapter 130 of the City's Land Development Regulations, which has been determined to be 82
parking spaces of which a waiver will be required for 24 parking spaces. The 58 parking spaces will
be provided on the Fruitstand and King parcels.
Pursuant to Section 142-425 (d), the Mayor and City Commission may waive development

CONCLUSION
The Mayor and City Commission should adopt the resolution waiving the development regulations
pursuant to section 142-425 (d) of the Land Development Regulations for the proposed new
Regional Library Facility, located in the Collins Park Cultural Campus; said waiver regarding 24 of
the 82 required parking spaces for the Library facility as required under Chapter 130 of the Land
Development regulations.
