RESOLUTION No. 2001-24609
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING A
BUDGET AND APPROPRIATING FUNDS FOR THE POLICE
SPECIAL REVENUE ACCOUNT FOR FISCAL YEAR 2001102,
IN THE AMOUNT OF $51,600; SAID ACCOUNT FUNDED BY
UNCLAIMED EVIDENCE CURRENTLY HELD IN THE
POLICE SPECIAL REVENUE ACCOUNT.
WHEREAS, Section 705.105, Florida Statutes, "Procedure for Unclaimed Evidence," provides that
title to unclaimed evidence in the custody of the court from a criminal proceeding or seized as
evidence by and in the custody of a law enforcement agency, shall vest permanently in the law
enforcement agency sixty (60) days after the conclusion of the proceedings; and
WHEREAS, such funds have been in the custody of the Police Property Management Unit past the
sixty (60) day waiting period, and these funds have now been placed in the Police Special Revenue
Account, as provided by Resolution No. 90-19931, adopted on March 7, 1990.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that $51,600, which is currently being held in the
Police Special Revenue Account, be appropriated for the purpose of establishing the Operating
Budget for the 2001/02 Fiscal Year for Ihe purchase of items listed on Exhibit "A";

PROMOTIONAL ACTIVITIES related to law enforcement
programs sponsored by the Chief of Police including unfunded
Crime Prevention Programs like Big Brothers/ Big Sisters,
Take Your Child To Work Day, and miscellaneous expenses like
activities related to the Miami Beach Chamber of Commerce, the
American Heart Association, Annual Read Aloud Crowd for South
Pointe Elementary School, Community Crusade Against Drugs,
the South Beach Hispanic Chamber of Commerce, Kiwanis
Special Activities, Boys and Girls Club Events; purchase of
law enforcement related publications and funding strategic
planning sessions for the Command Staff

To further quality assurance in Cll 600-900 letters prepared
each month and sent out to victims of crime as a follow-up
measure and to relay information on solvability. Other Divisions
within the Department have also expressed an inlerest in making
use of this equipment

TRAUMA SHOOTING KITS
This is a survival first aid kit for immediate treatment of gunshot
or stabbing wounds. It is a nylon bag containing wound dressings,
tape and scissors. The kit is to be issued all officers and carried in
their patrol vehicles so that it will be available should the need
arise.
PROVIDE AND INSTALL NEW BOATLIFT
To protect the new boats recently purchased by the City for the
Marine Patrol Unit. This investment needs to be protected with
reliable quality hardware in the form oflifts/davits to protect
it from the marine environment when stored between shifts,
including DERM permits, approx. $3,000.
LOG CABIN NURSERY for horticultural service fee
to include weekly maintenance of the live foliage plants
throughout the Police Station and the North End Sub-Station

Adopt the Resolution.
ANALYSIS
Florida Statute 705.105 "Procedure for Unclaimed Evidence" provides that unclaimed evidence in
the custody of the court from a criminal proceeding, or seized as evidence by and in the custody of
a law enforcement agency shall become the property ofthat law enforcement agency 60 days after
the conclusion of the proceedings.
In March 1990 a special account was established, titled "Police Special Revenue Account" in the
Special Revenue Fund. Funds for this account are made available in the Police Property
Management Unit, as unclaimed evidence, in accordance with Florida Statute 705.105, outlined
above.
In accordance with Florida Statute 705.105, unclaimed evidence totaling $51,600, has been in the
custody ofthe Police Property Management Unit past the sixty (60) day waiting period. These funds
have now been placed in the Police Special Revenue Account, as provided in Resolution 90-19931,
passed on March 7,1990.
The Administration recommends that the Mayor and the City Commission adopt the budget for the
Police Special Revenue Account, and appropriate the amount of $51 ,600 to provide funds for the
purchase of miscellaneous items for the Police Department (Exhibit "A"). Such funds have been
deposited and are currently available from unclaimed evidence, in accordance with Florida Statute
705.105.
