2009-27115 ResoRESOLUTION NO. 2009-27115 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER, PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 29-08/09, FOR A CONCESSION AGREEMENT FOR THE MANAGEMENT AND OPERATION OF A CONCESSION FACILITY WITHIN THE STRUCTURE COMMONLY REFERRED TO AS THE "PAVILION BUILDING," LOCATED IN SOUTH POINTE PARK; AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE TOP-RANKED FIRM OF SB CAFE, LLC, D/B/A TOUCH CATERING, AND SHOULD THE ADMINISTRATION NOT BE ABLE TO NEGOTIATE AN AGREEMENT WITH THE TOP-RANKED FIRM OF SB CAFE, LLC, D/B/A TOUCH CATERING, AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH THE SECOND-RANKED FIRM OF THE OASIS, D/B/A ERRANDBOY DELIVERIES, LLC; FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT, UPON CONCLUSION OF SUCCESSFUL NEGOTIATIONS. WHEREAS, on March 18, 2009, the Mayor and City Commission approved the issuance of Request for Proposals (RFP) No. 29-08/09, for a Concession Agreement for the Management and Operation of a Concession Facility within the Structure Commonly Referred to as the "Pavilion Building" Located in South Pointe Park (the "RFP"); and WHEREAS, on March 27, 2009, the RFP was issued with an opening date of April 27, 2009; and WHEREAS, apre-proposal meeting to provide information to prospective proposers was held on April 13, 2009; and WHEREAS, BidNet and Bidsync issued bid notices to 20 and 618 prospective proposers respectively, the Procurement Division also distributed 544 notices all local bars, clubs, and restaurants in Miami Beach, resulting in the receipt of two (2) bids; and WHEREAS, the City Manager, via Letter to Commission (LTC) No. 129-2009, appointed an Evaluation Committee ("The Committee") consisting of the following individuals: • Gary Farmer -Cultural Affairs Program Manager, Cultural Arts; • Manuel Marquez Jr. -Revenue Manager, Finance; • Michele Merlo -Miami Beach Resident; • Jim Nourse -Miami Beach Golf Course Food and Beverage Manager; • John Oldenburg -Assistant Director, Parks and Recreation; • Ruth Remington -Miami Beach Resident; and WHEREAS, on May 19, 2009, the Committee convened for presentations, deliberations, and recommendations; and WHEREAS, SB Cafe, LLC, d/b/a Touch Catering, was the top-ranked firm, and The Oasis, d/b/a Errandboy Deliveries, LLC, was the second-ranked firm; and WHEREAS, the Committee also recommended that the City consider rejecting all bids and reissuing the RFP; and WHEREAS, the City Manager has reviewed the Committee's recommendation and performed his own due diligence relative to the RFP and proposals, and recommends that the Administration be authorized to negotiate with the top-ranked proposer, SB Cafe, LLC, d/b/a/ Touch Catering, and in the event negotiations with the top-ranked proposer are unsuccessful, that the Administration proceed to negotiate with the second-ranked proposer, The Oasis, d/b/a Errandboy Deliveries, LLC,. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City Manager, pursuant to Request for Proposals (RFP) No. 29-08/09, for a concession agreement for the management and operation of a concession facility within the structure commonly referred to as the "Pavilion Building," located in South Pointe Park; authorizing the Administration to enter into negotiations with the top-ranked firm of SB Cafe, LLC, d/b/a Touch Catering, and should the Administration not be able to negotiate an agreement with the top-ranked firm, authorizing the Administration to negotiate with the second-ranked firm of The Oasis, d/b/a Errandboy Deliveries, LLC; further authorizing the Mayor and City Clerk to execute an agreement, upon conclusion of successful negotiations. Item Summary/Kecommendation: During the November 19, 2004, City Commission meeting, the Mayor and City Commission adopted Resolution No. 2004-25741 approving the construction of a community room, public restrooms and concession facilities located in South Pointe Park. South Pointe Park opened to the public on March 22, 2009. At the February 17, 2009, meeting of the Neighborhoods/Community Affairs Committee, the Committee unanimouslyvoted to recommend thatthe concession providerwithin the South Pointe Park Pavilion be contracted through a Requestfor Proposals. Anyagreemententered into by the City will be for an initial term of two (2) years, with an option to renew for three (3) additional one (1) year terms, with said renewal terms being at the City's sole option and discretion. The Concessionaire shall operate and manage the concession area, which shall sell and/or provide non-alcoholic beverages and prepackaged and/or prepared foods with limited heating requirements. BidNet and Bidsync issued bid notices to 20 and 618 prospective proposers respectively. On May 19, 2009, the Committee convened, evaluated, and ranked the firms based on the following criteria: • 30 Points -Experience and Qualifications • 20 Points -Operational Expertise and Procedures • 25 Points -Financial Capabilities, Minimum Guarantee (MG), Percentage of Gross (PG) • 25 Points -Methodology and Approach While the Committee voted unanimously to recommend SB Cafe, LLC, it also suggested that the City consider rejecting all bids and reissuing the RFP. The majority of the Committee indicated that both firms did not provide sufficient details related to their business and staffing plans and efforts to provide effective customer service. Overall, given the Pavilion's high-profile location, the Committee believed that the operating vendor should have provided a more concise and structured plan to serve the park and its neighboring community. Notwithstanding, SB Cafe, LLC, d/b/a Touch Catering was recommended based on its overall presentation, experience, operational plan, and projected revenues to the City. The Committee's concerns related to preferred hours of operation, consistencyof staffing, etc. will be addressed through concession agreement negotiations. SB Cafe, LLC, d/b/a Touch Catering has over five (5) years of experience and currentlyoperates Meat Market Miami on Lincoln Road, and is Centerplate's social catering partner at the Miami Beach Convention Center. KEY INTENDED OUTCOMES SUPPORTED Increase resident satisfaction with availability of commercial service options ANALYSIS As tourism is vital to the economic well-being of the community and the availability of concession facilities is vital to tourism, the Administration initiated the design of concession facilities within the proposed multi-use structure at South Pointe Park. During the November 19, 2004, City Commission meeting, the Mayor and City Commission adopted Resolution No. 2004-25741 approving the construction of a community room, public restrooms and concession facilities located in South Pointe Park. Commission Memorandum -RFP 29-08/09 -South Pointe Pavilion Concession Agreement July 15, 2009 Page 2 of 5 SCOPE OF SERVICES The successful proposer will be authorized to conduct the following kinds of business (es) within the concession area, as provided herein, all at its sole cost and expense: PERMITTED USE(S): Operate and manage the concession area, which shall sell and/or provide the following: a) non-alcoholic beverages b) prepackaged and/or prepared foods with limited heating requirements will be negotiated based on the proposed menu. Byway of example, the City has allowed the following in other concession agreements: the use of steamers, warmers, microwaves, sandwich press and coffee maker. MENUS: Proposers shall develop menus for the following purposes: a) Park picnic menus b) Beachgoers menu of prepackaged items, and c) Party package menu for children SCHEDULE OF OPERATION: Successful proposer's operation shall be open in accordance with the schedule outlined below, weather and/or events of force majeure permitting. Days of Operation: seven (7) days a week, 365 days a year Hours of Operation: opening shall occur no earlierthan 7:00 a.m. and closing shall occur no later than 9:00 p.m. Any changes to the days or hours of operation require the prior written consent of the City Manager. This was based on a majority of the Committee indicating that both firms did not provide the sufficient level of details related to their business and staffing plans they would have preferred, as well as clearly delineating their efforts to provide effective customer service. Overall, given the Pavilion's high-profile location, the Committee believed that the proposers could have provided a more concise and structured plan to serve the park and its neighboring community. Notwithstanding, SB Cafe, LLC, d/b/a Touch Catering was recommended based on its overall presentation, experience, operational plan, and projected revenues to the City. The Committee's concerns, hours of operation, consistency of staffing, etc. can be and will be addressed through concession agreement negotiations. SB Cafe, LLC, d/b/a Touch Catering SB Cafe, LLC, d/b/a Touch Catering has successfully operated numerous concessions events, such as, Fashion Week, Art Basel, and the Sony Ericsson Tennis Tournament. The concessions varied from grab-and-go concessions to full sit-down menus. SB Cafe, LLC, d/b/a Touch Catering's management team has owned and operated the Boiler Room, which was a sports bar/cafe on the campus of the University of Colorado-Denver for five (5) years. This establishment catered to the university students, as well as patrons of the adjacent movie theater. Touch had indoor as well as outdoor seating (season permitting), in addition to a limited kitchen. The establishment did not have a hood in the kitchen, which led Touch to develop a menu with extensive variety in spite of the limitations, which is similar to the existing conditions at the Pavilion in South Pointe Park. As a catering company, SB Cafe, LLC, d/bJa Touch Catering is geared towards the high market and has been responsible for numerous Green Room setups at special events where VIP's and/or actors/entertainers were to be fed and catered to while awaiting to perform or speak. Touch has also proposed a kosher menu with the creation of Glatt Kosher Touch Catering under the supervision of Kosher Miami. SB Cafe, LLC, d/b/a Touch Catering has over five (5) years of experience and currently operates Meat Market Miami on Lincoln Road, and is Centerplate's social catering partner at the Miami Beach Commission Memorandum - RFP 29-08/09 -South Pointe Pavilion Concession Agreement July 15, 2009 Page 4 of 5 Convention Center. CITY MANAGER'S REVIEW After considering the review and recommendation of City staff, the City Manager exercised his due diligence and recommends to the Mayor and City Commission that the contract be awarded to SB Cafe, LLC, d/b/a Touch Catering. CONCLUSION The Administration recommends the award of contract to SB Cafe, LLC, d/b/a Touch Catering as the top-ranked firm, pursuant to Request for Proposals 29-08/09, for a concession agreement for the management and operation of a concession facility within the structure commonly referred to as the "Pavilion Building," located in South Pointe Park.
