This LTC is to inform you of the attached Resolution No. R2009-54 adopted by the City of
North Miami Beach, Urging the Florida State Legislature to prohibit persons from using any
electronic device while operating a motor vehicle.

A RESOLiiTiON OF THE MAYOR AND CITY COUNCIL
OF THE CITY OF NURTH MIAMI BEACH, FLORIDA,
URGING "i'HE FLORIDA STATE LEG[SLA'I'UItE TO
PROHIBIT PERSONS FROM USING ANY ELECTRONIC
COMMUNICATIONS DEVICE WHILE UYERA3'[NG A
MOTOR VEHICLE.
WHEREAS; text messaging while driving has become a daily distraction for a
generation of drivers hooked on instant communication and a menace to others on the road; and
WHEitblAS, a recent study by the Virginia Tech'fransportatian Institute, a vehicle safety
reseazch organization, reported that those who text while operating a motor vehicle arc 23 times
more apt to crash and to be more dangerous than fully alert drivers; and
R'HEREAS, the studies involving the use of electronic commtmications devices have
revealed that texting is much worse than driving at the legal alcohol limit; and
WHEREAS, currently, seventeen states make it illegal to send a text tttessage while
driving; and
WHEREAS, even though PIorida is not one of those seventeen states banning the use of
elecUnnic communications devices, some state representatives have tried but to nu avail to get a
bill passed for the past three yeazs; and
WHEREAS, the Mayor and City Council of the City of North Miami Beach recognize
the danger associated with texting while driving to all users of its road; and
WHEREAS, the passage of a bill to prohibit persons from using any electronic
communications device would greatly benefit all citizens within our state.

NOW, THEREFORE,
BE IT RESOLVED by the City Council of the City of North Miami Beach
Section 1. The Mayor and Council of the City of North Miami Brach, Florida, hereby
strongly urge the Florida State Legislature to pass legislation to prohibit persons from using any
electronic communications device.
Section 2. The Cih' Clerk is hereby directed to transmit a certified copy of this resolution
to all State Representatives, State Senators and ttic presiding Officers and Council members of
the municipalities in Miami-Dade County.
Section 3. "I'ite Mayor and Council of the City of North Miami Beach, Florida, hereby
direct the City's state lobbyists to advocate the necA for legislation set forth in Section 1.
APPROVED AND ADOPTED by the City of North Miami Beach City Council at the
regular meeting assembled this i'~ day of September, 2009.
