OFFICE OF THE CITY Iv1ANAGER
No. LTC # 25i-zoo9 LETTER TO COMMISSION
TO: Mayor Matti Herrera Bower and Members of the City Commission
FROM: Jorge M. Gonzalez, City Manager
DATE: September 22, 2009
SUBJECT: Cost of Red Light Infractions ~~~
At the September 10, 2009 City Commission meeting, an Ordinance was proposed for First
Reading which would have increased the civil penalty for a red light infraction in the City's
enforcement program from $125 for the first violation to $150 for the first violation. The
Ordinance was not passed by the City Commission on First Reading; however, the members
of the City Commission did inquire as to the amount of fine associated with the traditional
uniform traffic code moving violation, failure to stop at a traffic signal.
The fine for a violation of the State Uniform Traffic Code provision requiring a stop at a traffic
signal is $229 within the first thirty (30) days. After the thirty (30) days the fine increases to
$245. This is considered a moving violation and points are assessed to the driver's license as
a result of the infraction. Of the $229 or $245, the City receives approximately 60% with the
balance being retained by the County for various statutorily defined uses and court costs.
For Commission information, other common traffic violations and the resultant fines are as
follows:
• Speeding Violations
30 Davs After 30 Davs
Speeding 6 to 9 miles over the speed limit $129 $145
Speeding 10 to14 miles over speed limit $204 $220
Speeding 30 miles and over speed limit $354 $370
• General Moving Violations with the exceptions of speeding and failure to stop at a
traffic signal -first thirty (30) days $164, after thirty (30) days $180.
