2009-27157 ResoRESOLUTION NO. 2009-27157 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SUBMIT THE FOLLOWING APPLICATION FOR AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009 (ARRA) FUNDING: 1) U.S. DEPARTMENT OF TRANSPORTATION, FOR TRANSPORTATION INVESTMENT GENERATING ECONOMIC RECOVERY (TIGER) DISCRETIONARY GRANT FUNDS, IN AN AMOUNT NOT TO EXCEED $10,000,000 FOR A CITYWIDE BRIDGES PROGRAM; AND FOR THE FOLLOWING NON-ARRA FUNDS: 2) TOURIST DEVELOPMENT COUNCIL GRANT FUNDS, FOR FUNDING IN AN AMOUNT NOT TO EXCEED $25,000 FOR THE CITY'S SLEEPLESS NIGHT 2009 EVENT; 3) THE MIAMI BEACH VISITOR AND CONVENTION AUTHORITY (VCA) FOR FUNDING, IN AN AMOUNT NOT TO EXCEED $50,000 FOR THE CITY'S SLEEPLESS NIGHT 2009 EVENT; AND FOR THE FOLLOWING APPROPRIATION: 4) U.S. DEPARTMENT OF JUSTICE, OFFICE OF JUSTICE PROGRAMS FOR FUNDING IN AN AMOUNT NOT TO EXCEED $200,000 FOR THE CITY OF MIAMI BEACH TEEN CLUB, GANG AND DRUG PREVENTION PROGRAM; AND, 5) APPROVAL OF THE FOLLOWING LOCAL AGENCY PROGRAM AGREEMENT WITH FLORIDA DEPARTMENT OF TRANSPORTATION, FOR FUNDING IN AN AMOUNT NO TO EXCEED $570,000 FOR THE MIDDLE BEACH RECREATIONAL CORRIDOR; FURTHER APPROPRIATING THE ABOVE FUNDS, IF APPROVED AND ACCEPTED BY THE CITY, AND AUTHORIZING THE EXECUTION OF ALL NECESSARY DOCUMENTS RELATED TO THESE APPLICATIONS WHEREAS, the U.S. Department of Transportation's TIGER grant program provides ARRA funding for highway or bridge projects, including interstate rehabilitation, the reconstruction of overpasses and interchanges, bridge replacements, seismic retrofit projects for bridges and road realignments; and WHEREAS, the Administration is proposing to apply for funding from the TIGER Discretionary Grant funding for a Citywide program, which will incorporate renovation of the following bridges: West Avenue Bridge, 77th Street Bridge over Biscayne Point Canal, Pine Tree Drive Bridge over La Gorce Canal, Holocaust Memorial Bridge, Biarritz Drive Bridge over Normandy Waterway, Fountain Street Bridge over Biscayne Bay; and WHEREAS, the Department of Transportation has established a minimum award amount of $20 million but the minimum can be waived to allow for smaller projects, therefore, the City will request a waiver, pursuant to the guidelines in order to apply for these funds; and WHEREAS, funds may be used for up to 100% of project cost, and request does not require matching funds; and WHEREAS, this project supports the key intended outcome ensure well-maintained infrastructure. WHEREAS, the Administration requests approval to submit a grant application to the Transportation Investment Generating Economic Recovery (TIGER) Discretionary Granit Program for funding in an amount not to exceed $10,000,000. for a Citywide bridges program; and WHEREAS, the goal of Sleepless Night 2009 is to strengthen South Florida's reputation as a top cultural tourism destination by becoming a major annual signature event, on par with Art Basel Miami Beach and the South Beach Wine and Food Festival; and WHEREAS, Sleepless Night 2009 will present over 150 free arts and entertainment experiences at 100 different locations concentrated in four zones within the City; and WHEREAS, this grant requires a $1:$1 match which will be funded through corporate support for the event and the project supports the key intended outcome increase community rating of cultural activities; and WHEREAS, approval is requested to submit a grant application to Miami-Dade County's Tourist Development Council for funding in an amount not to exceed $25,000 for the City's Sleepless Night 2009 event; and WHEREAS, the VCA provides funding for special events, promotions, activities and festivals which will stimulate tourism for Miami Beach and the Administration proposes submitting an application to the VCA for Sleepless Night 2009; and WHEREAS, this grant requires a $1:$1 match, which will be funded through corporate support for the event and the project supports the key intended outcome increase community rating of cultural activities; and WHEREAS, the Administration requests approval to submit a grant application to the Miami Beach Visitor and Convention Authority (VCA) for funding in an amount not to exceed $50,000 for the City's Sleepless Night 2009 event; and WHEREAS, the U.S. Department of Justice's Office of Justice Program (OJP) is the primary provider of federal criminal justice funding to state and local jurisdictions; and WHEREAS, the City has previously received appropriations from OJP for the last two years in the amounts of $49,351 (Fiscal Year 2006/07) and $648,403 (Fiscal Year 2008/09) and the legislature has approved $200,000 for this successful program for Fiscal Year 2009/10; and WHEREAS, matching funds are not required to support this appropriation and this program supports the key intended outcome enhance learning opportunities for youth; and WHEREAS, the Administration requests approval to accept funding from the Office of Justice Program for funding in an amount not to exceed $200,000 for the Teen Club, Gang and Drug Prevention program; and WHEREAS, the Administration requests approval to execute a Local Agency Program Agreement with Florida Department of Transportation (FDOT) in an amount no to exceed $570,000 for the Middle Beach Recreational Corridor Project; and WHEREAS, the funds will be used to design a beachwalk pathway that will known as the Middle Beach Recreational Corridor (MBRC) between 23~d and 64th Streets in Miami Beach which will link the existing beachwalk projects in South Beach to the recently completed North Beach Recreational Corridor; and WHEREAS the funding was an appropriation from the Legislature and does not require matching funds and this project supports the key intended outcome enhance mobility throughout the City. Supporting Data: 1) The federal standard for bridge repair is usually based on a sufficiency rating of close to 50 and at last inspection, the recommended bridges for funding all had sufficiency ratings of less than 74 out of a possible 100, however, conditions have deteriorated since the inspection; 2) and 3) In the 2009 survey, 24% of residents rated the availability of cultural activities as 'too few', 69% of resident believe that the tourism industry contributes 'about the right amount' to their quality of life, 24% of residents rated Arts and Culture as one of the services the City should strive not to reduce; and, nearlytwo-fifths of all residential respondents surveyed, 37.3%, feel the "18 years of age and under" demographic should benefit most from limited resources during tough economic times; 4) 85% of residents rated recreation programs as either `excellent' or `good', 18% of residents rated recreation programs as one the services the City should strive not to reduce; 5 63.7% of residents stated that there were "too few" bike aths/lanes. Sleepless Night 2009 will present over 150 free arts and entertainment experiences at 100 different locations concentrated in four zones within the city. Included in the event are free museum admissions, indoor and outdoor art installations and performances, architectural tours, dance and dancing, theater, music, slam poetry, film, fashion, acrobatics, comedyand other cultural offerings. Outdoor stages will be erected at five locations. This grant requires a $1:$1 match which will be funded through corporate support for the event.
