WHEREAS, on May 18, 2005, the Mayor and City Commission approved Resolution No. 2005-25902, authorizing the execution of an A/E Agreement with Chen and Associates, Inc. (Consultant), in snot-to-exceed amount of $2,017,009, to provide urban design, architecture, landscape architecture, engineering and construction administration services for the South Pointe Phase III, IV, and V, Right-of-Way (ROW) Neighborhood Improvement Project (the Project); pursuant to RFQ No. 08-03/04; and WHEREAS, the Project includes improvements to the stormwater system, water system, roadways, streetscape, landscaping, traffic calming, pedestrian lighting, and linkages within the public right-of-ways; and WHEREAS, the Project limits, in general, are bounded by Ocean Drive to the east; Washington Avenue to the west; 5th Street to the north; and South Pointe Drive to the south, and also includes, Alton Road south of 5th Street; Jefferson Avenue south of 1St Street; Commerce Court, Commerce Street and Biscayne Court, between Jefferson and Washington Avenues; «..d WHEREAS, on April 11, 2006, the City Commission approved Resolution No. 2006-26172, approving the Basis of Design Report (BODR); and WHEREAS, in December 2006, during the Project design phase, the Public Works Department requested the implementation of bike lanes, in accordance with the "bike master plan" that was being developed; and WHEREAS, Amendment No. 1 to the Agreement was executed on March 14, 2007, to implement bike lanes along Alton Road, South Pointe Drive, and Ocean Drive, in the amount of $73,256; and WHEREAS, upon further analysis of the current scope of work for the Project, the Administration has determined that additional design engineering will be required to address the stormwater collection and disposal system at alleyways and drainage "hot spots", reconstruction of select roadways and alleyways, and to install an approximate 2,100 additional linear feet of water mains; and WHEREAS, the City Administration and Consultant have negotiated an additional fee for the work in the amount of $94,320, plus an additional $13,000 for approval reimbursables; and WHEREAS, this item was recommended for approval by the, Capital Improvement Projects Oversight Committee (CIPOC) at its August 31, 2009 meeting. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute Amendment No. 2 to the Agreement between the City and Chen and Associates, Inc., dated May 18, 2005, in the negotiated amount of $94,320, plus an additional amount of $13,000, for approved reimbursables, for the provision of additional design services for the reconstruction of roadways and alleyways, provision of stormwater collection and disposal system at alleyways and drainage "hot spats",.and additional water main replacements, for the South Pointe Phase III, IV and V Right of Why Neighborhood Improvement Project; with previously appropriated funding from South Pointe capital Fund 389. Completing the South Pointe Phase III, IV, and V Improvement Project will upgrade the sidewalks, streets, and stormwater drainage in this area. Issue: Should the City Commission approve the additional services for Chen and Associates, Inc.? Item Summary/Recommendation: On April 22, 2009, the City Manager's recommendation for the award of the construction contract to Central Florida Equipment was presented to the City Commission; the item was deferred to its May 13, 2009, meeting; and subsequently withdrawn from the May 13, 2009 Commission meeting, to allow further consideration by the Administration. The City Commission took into consideration that residents, bidders, and members of the Commission, raised questions regarding the current project scope of work, including stormwater and pavement improvements. In addition, since many of the bids received by the City were significantly lower than the available construction budget, this provided the City with an opportunity to revisit the current scope of work, and to include those items deemed necessary to address the concerns raised by residents and the City Commission. In May 2009, the City Administration requested that Chen and Associates (Chen) conduct an analysis to identify additional improvements to the stormwater collection and disposal system at alleyways and drainage "hot spots", roadway and alleyway reconstruction; and additional watermain replacements. On May 22, 2009, Chen and Associates provided the City with the scope required to address the additional infrastructure in the Project for review and evaluation. The total additional construction costs, has been estimated at $2,353,000. At the June 3, 2009, Commission meeting, upon further review, the City Administration recommended the rejection of all bids, and the re-issuance of a new Invitation to Bid. The new ITB will be issued once the modified scope of work is finalized. On July 1, 2009, Chen submitted a Detailed Scope of Work, and a Fee Schedule. The original additional services fee requested by Chen for the additional scope of work was $181,249. The CIP and City Manager Office staff held further discussions and negotiations with Chen, to refine the additional scope of services needed. The refinement of the scope resulted in the fees being negotiated down to $121,232, and eventually, to $107,320, including approved reimbursable expenses. In order to re-issue the project for bids, approval of the Amendment Number 2, to the original Agreement between the City and Chen and Associates, is necessary to provide additional design services for these improvements not originally included in the South Pointe Phase III, IV and V Right of Way Neighborhood Improvements Project. FUNDING Previously appropriated funds for this Amendment are available in the amount of $107,320, for Design and Engineering fees in the South Pointe Capital Fund 389-2333-061357. ANALYSIS On May 18, 2005, the Mayor and City Commission approved Resolution No. 2005-25902, authorizing the execution of an A/E Agreement with Chen and Associates, Inc. (Consultant). The services to be provided under the Agreement includes, planning, urban design, bid and award, and construction administration services for the South Pointe Phase III, IV, and V, Right-of-Way (ROW) Neighborhood Improvement Project (the Project); pursuant to RFQ No. 08-03/04. Project Limits The Project limits, in general, are bounded by Ocean Drive to the east; Washington Avenue to the west; 5th Street to the north; and South Pointe Drive to the south. It also includes Alton Road, south of 5th Street; Jefferson Avenue, south of 1St Street; Commerce Court and Commerce Street; and Biscayne Court between Jefferson and Washington Avenues. Scope of Work The current Project Scope of Work includes improvements to the stormwater collection and disposal system, including the construction of sixteen (16) gravity wells; water distribution system upgrades; roadway milling and resurfacing; streetscape enhancements, such as City Commission Memorandum - CHEN AND ASSOCIATES AMENDMENT N0. 2 -SOUTH POINTE PHASE 111, IV V September 9, 2009 Page 2 of 5 additional landscaping, irrigation and up-lighting; traffic calming installations, such as bulb outs and mid-block crosswalks; signage and pavement markings; additional pedestrian lighting; and enhanced pedestrian linkages. Planning and Design Phases On August 23, 2005, the Consultant was issued the Notice to Proceed (NTP) with the Planning Phase of the Project, which resulted in the development of the Basis of Design Report (BODR). The BODR was presented as an informational item to the General Obligation (GO) Bond Oversight Committee on April 3, 2006, and to the Historic Preservation Board (HPB) on April 10, 2006. On April 11, 2006, the City Commission approved Resolution No.2006-26172, and officially adopted the BODR. By approving the BODR, the City Commission accepted the design concept contained therein, and officially concluded the Planning Phase of the Project. Chen was then given authorization to proceed with the Design Phase of the Project. In December, 2006, during the project design process, the Public Works Department's Transportation Division requested the implementation of bike lanes in accordance with the bike master plan that was being developed. Amendment No. 1 to the Agreement, in the amount of $73,256, was executed on March 14, 2007, to implement bike lanes along Alton Road, South Pointe Drive, and Ocean Drive. Bid Process On September 5, 2008, Chen submitted the 100% Contract Documents, including an estimate of probable construction costs for the City's review, and completed the permitting process in early 2009. On February 2, 2009, the Invitation to Bid ("ITB") No. 17-08/09 was issued, and on March 13, 2009, the City received seven (7) bids from the following contractors: Horizon Contractors, Inc., Central Florida Equipment Rentals, Inc. (Central Florida), Ric-Man International, Inc. (Ric-Man), Munilla Construction Management, Corp. (MCM), Unitech Builders Corp., Ric-Man Construction, Inc., and Man-Con, Inc. The tendered prices ranged from $8,560,372.22, to $15,984,027.40. On March 26, 2009, the Technical Review Panel (TRP), as well as support staff from the City's Program Manager, Hazen and Sawyer, and the Design Engineer of Record (EOR), Chen and Associates, convened to review, evaluate and rank the bids submitted for the Project. Following review of the packages and interview of the seven contracting firms, the TRP determined that it could not rank HCI as the top-ranked, even though they submitted the lowest bid amount. Although Central Florida Equipment & Rentals Inc., had the second lowest bid price, they also had three (3) third place overall rankings, and two (2) fourth place overall rankings, compared to Ric-Man's three (3) first place overall rankings and two (2) second place overall rankings, from the TRP. Ric-Man's overall strength in its submittal, risk assessment plan, and past performance surveys; their presentation and interview of key personnel; as well as it's demonstrated past performance in similar neighborhoods; resulted in their higher overall ranking. The TRP recommended Ric-Man as the lowest and best bidder. Ric-Man's grand total lump sum bid was $11,151,947.74. City Manager's Review After considering the review and recommendation of City staff, the City Manager exercised his due diligence and recommended to the Mayor and City Commission the award of a City Commission Memorandum - CHEN AND ASSOCIATES AMENDMENT NO. 2 -SOUTH POINTE PHASE lll, IV V September 9, 2009 Page 3 of 5 contract to Central Florida Equipment Rentals, Inc., because in his review the City Manager could not find a significant difference between Ric-Man and Central Florida in their ability to perform the work. However, Central Florida Equipment Rental's bid was $639,891.89 lower than Ric-Man's bid. April 22, 2009, May 13, 2009, and June 3, 2009, City Commission Meetings On April 22, 2009, the City Manager's recommendation for the award of the construction contract to Central Florida Equipment was presented to the City Commission, and the City Commission deferred the item to its May 13, 2009 meeting. The item was subsequently withdrawn from the May 13, 2009 City Commission meeting, to allow further consideration by the Administration. Re-Assessment of the Current Scope of Work Upon further analysis of the current scope of work, combined with on-site evaluations conducted on May 12, 2009, and May 15, 2009, with the City Administration, and Chen and Associates (Chen), it was agreed that the following items would be further investigated in order to determine the extent of the additional engineering design, and the associated construction cost: stormwater Collection and Disposal System at Alleyways and Drainage "Hot Spots" The current stormwater design for the alleyways proposes inverted. valley gutters, and identifies a high point at the mid-point of the alleys, with slopes to the intersection of the streets and avenues, for catch basin collection. City staff expressed concerns that there may be some ponding even with the current proposed design. Consequently, Chen was requested to review the proposed drainage of alleyways for the potential of installation of additional catch basins at mid-point locations, to further enhance the collection of stormwater. Staff also confirmed that the alleyway between Collins Avenue and Ocean Drive, south of 1St Street, is to be included in the scope of work, as this alleyway was previously identified to be vacated by the City. ^ Addition of stormwater improvements to a drainage "hot spot" flooding area in the vicinity of 1St Street and Jefferson Avenue. This area was not previously included in the scope of the Project since a Developer had recently made improvements. 1St Street is not in the current scope of the Project. ^ Addition of stormwater improvements to a drainage "hot spot" along South Pointe Drive, between Washington Avenue and Alton Road, and an area south of South Pointe Drive, along Washington Avenue. ^ Addition of stormwater improvements to a drainage "hot spot" along the South Pointe Drive, between Ocean Court and the "Sunrise Plaza". A portion of this area was to be improved by a Developer, however, the Developer is idle and the infrastructure is required. Roadways and Alleyways ^ Budget restrictions made the full roadway reconstruction unfeasible during the initial planning and design phases of the Project. However, the current bid environment provides opportunities to address these issues. Chen will identify specific roadway sections that require reconstruction due to evident failure of the base, and/or sub- base, as opposed to the milling and resurfacing specified in the current scope of work. Areas identified for reconstruction in the initial site investigation include Collins Court and Ocean Court; Ocean Drive, from South Point Drive to 2"d Street; Collins Avenue, from South Pointe Drive to 1St Street; 1St Street, east of Washington Avenue; South Pointe Drive, between Washington Avenue and Ocean Drive; and Commerce Court and Biscayne Court. Additional Watermain Replacement Following the site investigation, the Public Works Department (PWD) identified additional water mains to be replaced along Biscayne Court, from Alton Road to Washington Avenue (Approx. 500 linear feet); Commerce Court, from Alton Road to Washington Avenue (Approx. 600 linear feet); and on Ocean Court, from South Pointe Drive to 2"d Street (Approx. 1000 linear feet). On May 22, 2009, Chen provided the City with an assessment of the scope required to address the additional work in South Pointe Phase III, IV, and V Project, as outlined above, including the estimated construction costs and the associated design and engineering fees. The estimated construction costs for the roadway reconstruction, alleyways stormwater improvements, and Watermain replacement was $2,353,000. On July 1, 2009, Chen submitted a Detailed Scope of Work (see Schedule A-2) and a Fee Schedule (see Schedule B-Amendment 2). The original additional services fee requested by Chen for the additional scope of work was $181,249. The final negotiated fee for the aforementioned additional scope of work is $94,320, plus an additional amount of $13,000, for approved reimbursable expenses. The City's CIP and the City Manager's office have evaluated and negotiated the Consultant's additional services fee proposal and find it to be fair and reasonable. This item was presented at the August 31, 2009, Capital Improvement Projects Oversight Committee (CIPOC) meeting, where it was recommended for approval. CONCLUSION: The Administration requests the approval of a Resolution of the Mayor and City Commission of the City of Miami Beach, Florida, approving and authorizing the Mayor and City Clerk to execute Amendment No. 2 to the Agreement between the City and Chen and Associates, Inc., dated May 18, 2005, in the negotiated amount of $94,320, (plus an additional $13,000 for approved reimbursables), for the provision of additional design services for the reconstruction of roadways and alleyways, provision of stormwater collection and disposal system at alleyways and drainage "hot spots", and additional water main replacements, for the South Pointe Phase III, IV, and V Right of Way Neighborhood Improvement Project; with previously appropriated funding from South Pointe Capital Fund 389. No.2 MEMO.doc SCHEDULE "A-2" SCOPE OF SERVICES Schedule "A" entitled, "Scope of Services", is amended as follows: ADD the following under TASK 5 -ADDITIONAL SERVICES: "Task 5.5 -Additional Design Services -Reconstruction of Roadways and Alleyways Design: Based upon a site investigation in conjunction with CITY Staff, rights-of-way were identified which require additional design efforts for roadway reconstruction. The rights- of-way identified are as follows: 1. 1st Street, between Washington Avenue and Ocean Drive; 2. South Pointe Drive, between Alton Road and Ocean Drive; 3. Ocean Drive, between North of 1st Street and South Pointe Drive; 4. Collins Avenue, between North of 1st Street and South Pointe Drive; 5. Alleyways: a. Commerce Court, between Jefferson Avenue and Washington Avenue; b. Biscayne Court, between Alton Road and Washington Avenue; c. Collins Court, between South Pointe Drive and 5th Street; and d. Ocean Court, between South Pointe Drive and south of 5th Street (Ocean Court between 1st Street and South Pointe Drive was originally removed since it was to be vacated for the Viceroy Project (Block 1 Project)). The CONSULTANT shall provide professional services, in general accordance with the base scope of services, for the design and permitting of proposed roadway reconstruction segments as listed above and identified in the attached Exhibits. This task is limited to the design and permitting for roadway reconstruction segments only; no additional streetscape will be provided. The CONSULTANT shall amend the current construction documents to include these improvements. The CITY will allocate additional funding to support these improvements into the project construction budget. Professional services to be provided by the CONSULTANT shall include: • .Perform detailed design for the reconstruction of the identified roadway segments. • ,Incorporate the detailed design and cost estimate into the contract documents for South Pointe Bid Packages 12 D, E, & F. Revised contract documents will be completed at 90% and 100% stages. Task 5.6 -Additional Design Services -Additional stormwater Evaluation. Desian and Permitting: Based upon a site investigation in conjunction with CITY Staff, rights-of-way and hotspots were identified which require additional design efforts for stormwater design. CONSULTANT shall incorporate the additional stormwater areas into the existing ICPR computer model for analysis and design. The drainage collection and disposal system will be designed to handle a 5-year 1-day storm event. This effort shall include all modeling efforts necessary to verify compliance with noted model requirements. The hotspots and rights-of-way identified are as follows: 1. Ocean Drive and South Pointe Drive (hotspot). 2. Washington Avenue and South Pointe Drive (hotspot). 3. Jefferson Avenue and 1st Street (hotspot). 4. Alleyways: a. Commerce Court, between Jefferson Avenue and Washington Avenue. b. Biscayne Court, between Alton Road and Washington Avenue. c. Collins Court, between South Pointe Drive and 5th Street. d. Ocean Court, between South Pointe Drive and south of 5th Street. The CONSULTANT shall provide professional services, in general accordance with the base scope of services, for the design and permitting of additional stormwater as listed above and identified in the attached Exhibits. This task is limited to the design and permitting for additional stormwater only. The CONSULTANT shall amend the current construction documents to include these improvements. The plans will not include profiles. The CITY will allocate additional funding to support these improvements into the project construction budget. Basis of Scope: • .Revisions/Addendums to the BODR are not included; • The City shall provide video inspections or reports of existing outtalls, from the most upstream catch basin to the outfall terminus; • .Pump station design is not part of the scope; • Analysis of adjacent properties stormwater system and/or models is not included (e.g. Apogee, Block 1, Block 51, Continuum, etc.); stormwater profiles are not included, per CMBPW. Task 5.7 -Additional Design Services -Additional Watermain Replacements Design and Permitting: As provided by CITY staff, the CITY would like to include additional watermain replacements within the South Pointe Bid Packages 12 D, E, & F project which will require additional design and permitting efforts. The additional watermain replacement segments are as follows: 1. Biscayne Court from Alton Road to Washington Avenue. 2. Commerce Court from Alton Road to Washington Avenue. 3. Ocean Court from South Pointe Drive to 2nd Street. The CONSULTANT shall provide professional services, in general accordance with the base scope of services, for the design and permitting of additional watermain as listed above and identified in the attached Exhibits. This task is limited to the design and permitting for additional watermain replacement only. The CONSULTANT shall amend the current construction documents to include these improvements. The CITY will allocate additional funding to support these improvements into the project construction budget. Professional services to be provided by the CONSULTANT shall include: • , PerForm detailed design and permitting of additional watermain replacements as identified above. Incorporate the detailed design and cost estimate into the contract documents for South Pointe Bid Packages 12 D, E, & F. Revised contract documents will be completed at 90% and 100% stages. Task 5.5, Task 5.6 & Task 5.7 Additional Design Services: Permitting, Deliverables and Schedule: Permitting - At the 90% design stage, CONSULTANT shall prepare applications and such documents and design data as may be required to amend approvals from all such governmental authorities that have jurisdiction over the Project. The CITY will pay all permit fees.
