WHEREAS, municipal government is the government closest to most citizens and has a tremendous daily impact upon its residents; and WHEREAS, city government is administered for and by its citizens and is dependent upon public commitment to, and understanding of, its many responsibilities, and that city officials and staff share the responsibility to pass along their understanding of public services and their benefits; and WHEREAS, Florida's citizenry receives public services from the state, county, school district and other governments, educating Floridians of all ages as to the structure and function of all the levels of government and how to be wise consumers of such services is critically important; and WHEREAS, under the leadership of League President Carmine Priore, the Florida League of Cities, Inc. and its member cities have joined together to teach students and all citizens about municipal government through a variety of projects, resources and information; and WHEREAS, this initiative makes resources available to cities and their citizens to utilize in furthering their goals for civic education. AFFIRMING SUPPORT FOR AND A PARTNERSHIP WITH THE 2010 CENSUS. WHEREAS, the U.S. Census Bureau is required by the U.S. Constitution to conduct a count of the population, and provides a crucial opportunity to help shape the foundation of our society and play an active role in American democracy; and WHEREAS, the members of the Florida League of Cities are committed to ensuring every resident is counted; and WHEREAS, more than $300 billion per year in federal and state funding is allocated to communities, and decisions are made on matters of national and local importance based on 2010 Census data, including health care, community development, housing, education, transportation, social services, employment and much more; and WHEREAS, census data collected in 2010 will determine how many seats each state will have in the U.S. House of Representatives, as well as the redistricting of state legislatures, county and city commissions, and voting districts; and WHEREAS, the 2010 Census creates hundreds of thousands of jobs across the nation; and WHEREAS, every Census Bureau worker takes a lifetime oath to protect confidentiality and ensure that data identifying respondents or their household not be released or shared for 72 years; and WHEREAS, a united voice from businesses, government, community-based and faith-based organizations, educators, media and others will allow the 2010 Census message to reach a broader audience, providing trusted advocates who can spark positive conversations about the 20 ] 0 Census. OPPOSING AMENDMENT 4 ON THE 2010 GENERAL ELECTION BALLOT, WHICH PROPOSES AN AMENDMENT TO THE FLORIDA CONSTITUTION REQUIRING THAT EVERY AMENDMENT TO A CITY'S OR COUNTY'S COMPREHENSIVE PLAN BE SUBJECT TO A VOTE OF THE RESPECTIVE CITY'S OR COUNTY'S ELECTORATE. WHEREAS, a proposed constitutional amendment sponsored by Florida Hometown Democracy, Inc. will be placed on the 2010 general election ballot as "Amendment 4"; and WHEREAS, this proposed constitutional change would subject every amendment to a local government comprehensive plan to a vote of the local, government's electors; and WHEREAS, planning and growth management decisions in Florida's municipalities are presently made through a representative form of democracy in which elected governing bodies are entrusted to make policy decisions on behalf of their constituents; and WHEREAS, in 198, the Florida Legislature enacted Chapter 163, Part II, Florida Statutes, the "Local Government Comprehensive Planning and Land Development Regulation Act," mandating that each municipality adopt a comprehensive plan to manage and guide the use and development of property within the municipality; and WHEREAS, the intent of the Act is to empower local governments, including municipalities, to preserve, promote, protect and improve the public health, safety, comfort, good order, appearance, convenience, law enforcement, fire prevention and general welfare; to prevent the overcrowding of land and avoid undue concentration of population; to facilitate the adequate and efficient provision of transportation, water supply, sewer treatment, schools, parks, recreational facilities, housing and other services; and to conserve, develop and protect natural resources within their jurisdictions; and WHEREAS, the Act requires extraordinary public notice, review, comment and hearings before a comprehensive plan maybe adopted or amended by a municipality; and WHEREAS, municipal comprehensive plans are adopted and amended by a municipal governing body only after significant review and input from the public, professional planners and municipal staff; and WHEREAS, the elected body's decision to amend, or the manner in which to amend, a comprehensive plan is based upon legal requirements as well as policy issues that require a balancing of the needs and desires of the overall community; and WHEREAS, the Florida League of Cities, Inc. finds that the Hometown Democracy amendment will trample minority interests and ignore the community's long-term planning needs and goals, including affordable housing measures, urban infill measures, redevelopment initiatives and the development of essential infrastructure; and WHEREAS, the Florida League of Cities, Inc. finds that the Hometown Democracy amendment will subject important planning and policy decisions to potentially misleading and inflammatory media campaigns; and WHEREAS, the Florida League of Cities, Inc. finds that the Hometown Democracy amendment will require the unnecessary expenditure of additional municipal revenues to fund numerous elections on comprehensive plan referenda; and WHEREAS, the Florida League of Cities, Inc. finds that the Hometown Democracy amendment will require the unnecessary expenditure of additional municipal revenue to fund the defense of lawsuits filed by persons aggrieved by the outcome of comprehensive plan amendment elections; and WHEREAS, these unnecessary costs will be borne by the citizens of Florida's cities and counties either through increased taxes or decreased municipal services. NOW, THEREFORE, BE IT RESOLVED BY THE FLORIDA LEAGUE OF CITIES, INC.: Section 1. That the Florida League of Cities, Inc. urges Floridians to carefully consider the potential adverse consequences of Amendment 4 before voting in the 2010 general election. Section 2. That the Florida League of Cities, Inc. urges Florida's municipal residents to exercise their existing rights to influence the quality of life in their city by participating in the development and amendment of its comprehensive plan. Section 3. That the Florida League of Cities, Inc. urges Florida's residents to regularly attend public hearings, workshops and meetings and otherwise take an active role in shaping local policies that affect growth within their communities. Section 4. That a copy of this resolution be provided to the membership of the Florida League of Cities, Inc. and other interested parties. SUPPORTING PROPOSALSTOAMENDFLORIDA'SCONSTITUTION TO PROVIDENEW STANDARDS THATMUSTBEFOLLOWED WHEN REDRAWING THE BOUNDARIES OF OUR CONGRESSIONAL, STATE HOUSE AND STATE SENATE DISTRICTS. WHEREAS, under current law, the state Legislature redraws the boundaries of our congressional, state House and state Senate districts every 10 years following the census; and WHEREAS, current law requires the districts to be roughly equal in population and contiguous, but does not require the districts to respect or utilize the geographical boundaries of Florida's municipalities; and WHEREAS, as a result, scores of Florida's municipalities are split into multiple districts, making it unnecessary for legislators to be responsive to Florida's municipalities and to respect the interests of Florida's municipalities; and WHEREAS, a group called FairDistrictsFloridahri proposed amendments to Florida's Constitution to provide new standards the state Legislature must follow when redrawing the boundaries of-our congressional, state House and state Senate districts; and WHEREAS, the current standards in large part require the redrawn districts to be compact and respect and utilize the geographical boundaries of Florida's municipalities while assuring racial and language minority voters have an equal opportunity to participate in the political process; and WHEREAS, the proposals will provide an incentive for future legislators to be responsive to Florida's municipalities and to respect the interests of Florida's municipalities. NOW, THEREFORE, BE IT RESOLVED BY THE FLORIDA LEAGUE OF CITIES, INC.: Section 1. That the Florida League of Cities, Inc. hereby endorses and otherwise supports the initiatives of FairDistrictsFlorida to amend the Florida Constitution to provide standards the state Legislature must follow when it redraws our congressional, state House and state Senate districts. Section 2. That the Florida League of Cities, Inc. encourages Florida's citizens to support the two petitions that are currently getting signatures in an effort to get the proposals placed on the 2010 general election ballot. RECOGNIZING FALLS PREVENTION AWARENESS DAY ON SEPTEMBER 22, 2009. WHEREAS, it is estimated that more than 3.3 million Florida residents are age 65 and older; and WHEREAS, the single greatest desire for many elder Floridians is to have the opportunity to "age in place" in the independence, safety, security, comfort and privacy of their own homes; and WHEREAS, it is estimated that more than 125,000 hospital-treated injuries from falls occur annually among Floridians 65 and older, with medical charges exceeding $1.8 billion; and WHEREAS, falls are the leading cause of injury-related deaths, hospitalizations, emergency department visits and extended health care facility accident-related admissions among Floridians 65 and older; and WHEREAS, among Floridians 65 and older, falls account for more than 70 percent of all fractures treated and released from emergency departments; and WHEREAS, falling and fear of falling can lead to depression, loss of mobility and loss of functional independence; and WHEREAS, injuries from falls are a preventable community health problem; and WHEREAS, falls prevention education is a key first step to increasing public awareness regarding elder falls prevention and home safety; and WHEREAS, cost-effective home modification and community strategies are available to improve safety and lessen the likelihood of falls and the debilitating injuries that can result; and WHEREAS, implementing elder falls prevention strategies is an effective tool for reducing the stresses associated with providing caregiver services; and WHEREAS, the Florida Department of Elder Affairs' Communities for a Lifetime initiative, the Florida Department of Health Office of Injury Prevention and the Florida Area Agencies on Aging, in partnership with Florida communities and residents, are working to increase awareness of this issue and encourage Florida residents to take steps to protect those who are at risk of falling. NOW, THEREFORE, BE IT RESOLVED BY THE FLORIDA LEAGUE OF CITIES, INC.: Section 1. That the Florida League of Cities, Inc. joins the Florida Departments of Elder Affairs and Health in recognizing Falls Prevention Awareness Day on September 22, 2009. Section 2. A RESOLUTION OF THE FLORIDA LEAGUE OF CITIES, INC. SUPPORTING THE HOMEOWNERS' DEFENSE ACT OF 2009, WHICH ADDRESSES THE GROWING CRISIS IN THE AVAILABILITY AND AFFORDABILITY OF HOMEOWNERS' INSURANCE. WHEREAS, Florida has a history of catastrophic disasters, including hurricanes, tornadoes, floods, etc.; and WHEREAS, although catastrophic disasters occur infrequently, they will continue to occur and are predictable; and WHEREAS, such disasters generate large economic losses and a major component of those losses comes from damage to and destruction of homes; and WHEREAS, as a result of the numerous disasters that have hit Florida over the years, homeowners' insurance premiums have escalated and the insurance coverage has been curtailed; and WHEREAS, federal legislation has been filed entitled the Homeowners' Defense Act of 2009, H.R. 2555, by Congressman Ron Klein (D-FL-22) and S. 505 by Senator Bill Nelson (D-FL), which proposes to address the growing crisis in the availability and affordability of homeowners' insurance in Florida and around the country; and WHEREAS, the legislation would create a national catastrophe risk consortium to help homeowners prepare for and recover from the damages caused by natural hazards, stabilize the catastrophe insurance market, and avoid widespread insurer insolvencies after amega-catastrophe by encouraging the creation of public catastrophic funds. NOW, THEREFORE, BE IT RESOLVED BY THE FLORIDA LEAGUE OF CITIES, INC.: Section 1. That the Florida League of Cities, Inc. urges members of i:he Florida congressional delegation to support H.R. 2555 and S. 505. Section 2. WHEREAS, a proposed constitutional amendment sponsored by the Florida Legislature will be placed on the 2010 general election ballot as "Amendment 2"; and WHEREAS, Amendment 2 proposes a change to the Florida Constitution to provide an additional ad valorem tax exemption for deployed military personnel serving in a foreign country; and WHEREAS, the proposed tax exemption would be prorated based on the number of days deployed on a military operation outside of the United States, in the previous year; and WHEREAS, Florida cities recognize the sacrifices of our troops while serving in a combat zone and the fiscal challenges they face being away from home for a significant period of time; and WHEREAS, this shortfall in revenues affecting city budgets will be a small price to pay for the sacrifices made by courageous members of the armed forces serving on our behalf, and should be supported by the taxpaying citizens. NOW, THEREFORE, BE IT RESOLVED BY THE FLORIDA LEAGUE OF CITIES, INC.: Section 1. That the Florida League of Cities, Inc. supports Amendment 2. Section 2.
