AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AMENDING THE CODE
OF THE CITY OF MIAMI BEACH, BY AMENDING CHAPTER 106,
ENTITLED "TRAFFIC AND VEHICLES," BY AMENDING ARTICLE
II, ENTITLED "METERED PARKING," BY AMENDING DIVISION 1,
ENTITLED "GENERALLY," BY AMENDING SECTION 106-55,
ENTITLED "PARKING RATES, FEES, AND PENALTIES;" BY
AMENDING PARKING METER RATES NORTH OF 23RD STREET;
PROVIDING FOR CODIFICATION, REPEALER, SEVERABILITY,
AND AN EFFECTIVE DATE.
WHEREAS, currently there is a mixed rate structure for parking meters north of 23~d
Street, with the rate of $0.50/hour for off-street and remote parking, and $1.00/hour for
both on-street and off-street metered parking in commercial corridors of 41St Street, 71St
Street and Normandy Drive; and
WHEREAS, as part of the FY09/10 budget process, on July 21, 2009, the Finance
Committee recommended to increase the hourly parking meter rate in the Parking Zones
that are currently $0.50/hour to $1.00/hour; and
WHEREAS, the amendments set forth below are necessary to accomplish the
above objective.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. Chapter 106, "Traffic and Vehicles," Article I I, "Metered Parking," Division 1,
"Generally," Section 106-55, "Parking Rate Fees, and Penalties," of the Code of the City of
Miami Beach, Florida, is hereby amended as follows:
CHAPTER 106
TRAFFIC AND VEHICLES
ARTICLE II. METERED PARKING
DIVISION I. GENERALLY
Sec. 106-55. Parking rates, fees, and penalties.
(a) Parking meter rates and time limits.
(1) South Beach Parking Zone: All metered parking south of 23rd Street (Dade
Boulevard), from Ocean Drive to the westernmost parking lane of Alton Road,
between South Pointe Park and 17th Street; and from 17th Street to 21st Street
(Sunset Harbour Drive), from Alton Road to the westernmost parking areas along
Purdy Avenue and to Biscayne Bay, shall be at the rate of $1.25 per hour. All
metered parking in the South Beach Parking Zone shall be enforced from 9:00 a.m.
until 12:00 midnight, seven days per week.

$1.00 per hour for off-street and on-street metered parking in the commercial
corridors of 41st Street, 71st Street and Normandy Drive. All metered parking north
of 23rd Street shall be enforced from 8:00 a.m. until 6:00 p.m., seven days per
week.
SECTION 2. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and
it is hereby ordained that the provisions of this ordinance shall become and be made part
of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be
renumbered or relettered to accomplish such intention, and the word "ordinance" may be
changed to "section", "article", or other appropriate word.
SECTION 3. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are
hereby repealed.
SECTION 4. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the
remainder shall not be affected by such invalidity.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect ten (10) days following adoption.

On September 10, 2009, the City Commission approved a Parking Rate Ordinance amendment on first
reading. This amendment would provide for an increase in the hourly rate for meter parking north of 23rd
Street in the areas that are currently at $0.50/hour.
Currently there is a mixed rate structure for parking meters north of 23rd Street, with the rate of $0.50/hour
for off-street and remote parking, and $1.00/hour for both on-street and off-street metered parking in
commercial corridors north of 23~d Street. As part of the FY09/10 budget process, on July 21, 2009, the
Finance Committee recommended to increase the hourly parking meter rate in the Parking Zones that are
currently $0.50/hour to $1.00/hour. In addition to providing consistency in the parking rate structure, this
increase would generate additional revenue in an estimated amount of $570,000 that would be utilized for
future capital projects.

Finance and Citywide Committee -July 21, 2009:
Commissioner Libbin suggested that the meters which currently charge $0.50 per hour should be
increased to $1.00 per hour. Discussion ensued. The Committee recommended that the $0.50 parking
meter rate increase for mid and north beach be included in the FY 2009/10 Proposed Operating
Budget.
Transportation and Parkinct Committee -September 14, 2009:
The committee voted 5-3 against the increase of rates north of 23`d Street.

ADMINISTRATION RECOMMENDATION
The Administration recommends that the Mayor and Commission approve the amendment
of the ordinance on second reading.
ANALYSIS
Currently there is a mixed rate structure for parking meters north of 23rd Street, with the rate
of $0.50/hour for off-street and remote parking, and $1.00/hour for both on-street and off-
street metered parking in commercial corridors north of 23rd Street. As part of the FY09/10
budget process, on July 21, 2009, the Finance Committee recommended to increase the
hourly parking meter rate in the Parking Zones that are currently $0.50/hour to $1.00/hour.
In addition to providing consistency in the parking rate structure, this increase would
generate additional revenue in an estimated amount of $570,000 that would be utilized for
future capital projects.

On September 14, 2009, the Transportation and Parking Committee discussed the proposed
increase and their recommendation was not to increase the rates. The vote was 5-3 against
the increase of rates north of 23rd Street.

CONCLUSION
In order to implement the necessary rate structure to support the parking system, the
Administration recommends that the Mayor and City Commission amend Chapter 106,
entitled "Traffic and Vehicles," by amending Article II, entitled "Metered Parking," by
amending Division 1, entitled "Generally," by amending Section 106-55, entitled "Parking
Rates, Fees, and Penalties;" by amending parking meter rates north of 23rd Street; providing
for codification, repealer, severability, and an effective date.
The Ordinance amendments would provide for an increase from $0.50/hour to $1.00/hour in
parking meter rates for off-street and remote parking north of 23rd Street.
