2009-27172 ResoRESOLUTION NO. 2009-27172 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 1, IN A NEGOTIATED NOT-TO-EXCEED AMOUNT OF $34,894, TO AN EXISTING AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND OMARCIO CLEANING SERVICES, INC.; DATED JULY 16, 2008, FOR JANITORIAL SERVICES. WHEREAS, on July 16, 2008, the Mayor and City Commission accepted the recommendation of the City Manager pursuant to Request for Proposals (RFP) No. 04- 07/08 for Janitorial Services; and WHEREAS, upon further negations, the Mayor and City Clerk executed agreements with Diamond Contract Services, Inc., Omarcio Cleaning Services, Inc., and Vista Building Maintenance Services, Inc., on October 1, 2008; and WHEREAS, the Normandy Isle Pool Facility has been included as part of the list of facilities noted in the scope of work for RFP No. 04-07/08; and WHEREAS, Omarcio Cleaning Services, Inc. submitted the lowest bid to maintain the Normandy Isle Pool Facility, and WHEREAS, the Agreement shall be effective as of August 1, 2009, to September 30, 2010; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve the Amendment, pursuant to Request for Proposals (RFP) No. 04-07/08, for Janitorial Services, and authorize the Mayor and City Clerk to execute Amendment No. 1, in a negotiated not-to-exceed amount of $33,894 to an existing. At the time, the Normandy Isle Pool facility was not included in the facilities list noted in the scope of work for RFP No. 04-07/08, but was maintained by Omarcio Cleaning Services, Inc., on a monthly basis. The proposed Amendment in the amount of $33,894 serves to include the Normandy Isle Pool facility in the facilities list noted in RFP No. 04-07/08. The purpose of RFP No. 04-07/08 was to establish a contract, by means of sealed Proposals, for a qualified provider of janitorial services. The Contractor shall provide all supervision, administrative and technical support, labor, subcontractors, materials, supplies and equipment (except as otherwise provided), and shall plan, schedule, coordinate and assure effective completion of all services described herein. The Contractor shall be fully responsible for providing customer service, quality control and all other services listed herein. Unless otherwise specfied, the Contractor will determine how often the work is to be performed, how much labor is needed to perform the tasks, what methods will be used to complete the job and which supplies, materials and equipment are needed. The results of the work performed under this contract will conform to the Quality Requirements and the Public Area Cleanliness Index These performance- based specifications express the City of Miami Beach's requirements in the form of Quality Requirements. These work requirements are provided as the City of Miami Beach's best gauge of the minimum quality standards to be met. The Contract Coordinator expects that upon daily or periodic inspections that these minimum standards will be met or exceeded. In addition to the listed facilities in the scope of work, the Contractor must maintain to the level of "cleanliness,"as defined in RFP No. 04-07/08, the Contractor shall include the Normandy Isle Pool facility, located at 7030 Trouville Espalande, Miami Beach, Florida, 33141, as part of its agreement with the City. On June 29, 2009, the Procurement Division requested proposals from the current Janitorial Contractors to manage the Normandy Isle Pool facility. As a result, the Procurement Division received the following two (2) bids on July 10, 2009: • Omarcio Cleaning Services, Inc. $2,421/monthly $33,894/14-month term • Vista Building Maintenance Services, Inc. $2,450/monthly $34,300/14-month term Property Management selected Omarcio Cleaning Services, Inc., the lowest bidder, to maintain the Normandy Isle Pool facility. As a result, effective on August 1, 2009, the City is currently saving $531.56 on a monthly basis under the new Agreement and $7,441.84 over the 14-month term. This Amendment No. 1 to the above subject Agreement is made and entered into this 1 sc day of August, 2009, by and between the CITY OF MIAMI BEACH, FLORIDA, and OMARCIO CLEANING SERVICES, INC.; and hereby amends the Agreement as follows: In addition to the listed facilities, the Contractor must maintain to the level of "cleanliness" as defined in RFP No. 04-07/08, the Contractor shall include the Normandy Isle Pool facility, located at 7030 Trouville Esplanade, Miami Beach, Florida, 33141, as part of its agreement with the City, at the monthly cost of $2,421.00. 2. The City and the Contractor agree that all other provisions of the Agreement shall remain unchanged and in full force and effect. This Amendment supersedes and governs any prior negotiations, correspondence, or conversations applicable to the matters contained herein, and there are no commitments, agreements, or understandings concerning the subject matter of this Amendment that are not contained in this document.
