2009-27191 ResoRESOLUTION NO. 2009-27191 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING RESOLUTION NO. 2003-25376, WHICH APPROVED THE BASIS OF DESIGN REPORT (BODR) FOR THE BISCAYNE POINT RIGHT-OF-WAY PROJECT; SAID AMENDMENT AMENDING THE BODR AS FOLLOWS: 1.) ON STILLWATER DRIVE, SUBSTITUTING THE SWALES WITH A TWO-FOOT WIDE STRIP OF PERMEABLE PAVERS AND REDUCED PLANTING AREAS; 2.) FOR THE BISCAYNE POINT ISLAND 77T" STREET ENTRYWAY, KEEPING AND RESTORING THE EXISTING OBELISK AND ITS MEDIAN, PROVIDING UP- LIGHTING TO THE OBELISK, ELIMINATING THE FOUR PROPOSED PERGOLAS AND PROPOSED WALLS, AND ADDITION OF PAVERS TO THE BISCAYNE POINT BRIDGE APPROACH, ON BOTH SIDES OF THE BRIDGE; 3.) FOR THE TATUM WATERWAY BRIDGE, PROVIDING PEDESTRIAN LIGHTING AND ENHANCING BRIDGE BARRIER WALLS WITH A COLORED CONCRETE NAUTICAL THEME MOSAIC; AND 4.) PROVIDING NEIGHBORHOOD SIGNAGE ON 77T" STREET, BETWEEN DICKENS AVENUE AND TATUM WATERWAY DRIVE, AND AT CRESPI PARK. WHEREAS, the City and its consultant, The Corradino Group, met with the Biscayne Point residents at two Community Design Workshops (CDW) held, respectively, on September 19, 2002 and January 9, 2003, with the object of sharing proposed neighborhood improvements and receiving feedback from the residents; and WHEREAS, as a result of the CDW's a Basis of Design Report (BODR) was presented and approved by the General Obligation Bond Oversight Committee on August 4, 2003, and by the City Commission on October 15, 2003, via Resolution No. 2003-25376; and WHEREAS, the City retained EAC Consulting, Inc. to prepare the necessary construction documents; and WHEREAS, a Community Design Review Meeting (CDRM), was held on February 06, 2008, at which the 60% design was presented and discussed with the residents; and WHEREAS, the City received several requests from residents and sub-neighborhood home owners associations, for various modifications to the project, that were material deviations from the previously approved BODR; and WHEREAS, the residents of the Stillwater Drive sub-neighborhood requested modifications to the BODR that involved the elimination of proposed swales; and WHEREAS, a consensus was reached to substitute the BODR proposed swales with a two foot wide stripe of permeable pavers, including also a smaller green area located by the neighbors' boundary lines; and WHEREAS, the residents of the Biscayne Point Island and Biscayne Beach sub- neighborhoods requested modifications to the BODR that primarily dealt with entryway features and signage; and WHEREAS, as a result of meetings with the Biscayne Point Island HOA, the HOA represented that the only modifications to the BODR that they are proposing for the entryway to Biscayne Point Island at 77th Street and Hawthorne Avenue are to keep and restore the Obelisk; provide up-lighting for the Obelisk; keep the proposed walls along the entryway to (item of contention); keep the proposed paver crosswalks; and remove the four proposed pergolas at the entryway to Biscayne Point Island, and the addition of pavers to the Biscayne Point bridge approach, on both sides of the bridge; and WHEREAS, as a result of meetings with the Biscayne Beach HOA, the HOA represented that the only modifications to the BODR that they are proposing are eliminating the proposed walls along the entryway to Biscayne Point Island (item of contention); install an illuminated neighborhood monument sign on the south side of 77th Street; immediately east of the Tatum Waterway Bridge; provide pedestrian lighting similar to existing Noremac Bridge; install a monument sign at Crespi Park identifying Biscayne Beach; and enhance the Tatum Waterway Bridge with an architectural design element; and WHEREAS, it was also agreed to enhance the lighting and to add a colored concrete nautical theme mosaic to the interior barrier walls of Tatum Waterway bridge; and WHEREAS, it was also agreed to place wayfinding neighborhood signage on 77th Street, between Dickens Avenue and Tatum Waterway Drive; and NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve an amendment to Resolution No. 2003-25376 amending the Biscayne Right of Way Project BODR as follows: 1.) on Stillwater Drive, substituting the swales with a two foot permeable pavers and reduced planting areas; 2.} for the Biscayne Point Island 77th Street entryway, keeping and restoring the existing obelisk and its median, providing up-lighting to the obelisk, and eliminating the four proposed pergolas and proposed walls, and the addition of pavers to the Biscayne Point bridge approach, on both sides of the bridge; 3.) for the Tatum Waterway bridge, providing pedestrian lighting and enhancing the bridge barrier walls with a colored concrete nautical theme mosaic; and 4.) providing neighborhood signage on 77th Street, between Dickens Avenue and Tatum Waterway Drive, and at Crespi Park. Item summa iKecommenaatlon: The Biscayne Point neighborhood is comprised of three sub-neighborhoods: Biscayne Beach, Biscayne Point Island, and Stillwater Drive. On 09/19/2002 and 01 /09/2003, two Community Design Workshops (CDW) were held with the residents, consequently a BODR was generated and on 08/04/03 it was approved by the General Obligation Bond Oversight Committee, and by the City Commission on 10/15/03 (Resolution No. 25376). F~4C Consulting, Inc. was subsequently hired by the City to design the neighborhood improvement project following the recommendations established in the BODR and the project is approaching the 90% design stage. Although the sub-neighborhood HOAs actively participated during the planning process, in recent months, the City has received several requests from residents and HOAs, for modifications to various project design elements that were included in the previously approved BODR. Consequently, a number of discussions have been held with residents and representative of the three HOAs during recent months to address these requests. It is important to note that the after several meetings with the neighbors, the City has been successful in reaching an amicable resolution with the Stillwater HOA with respect to the swales issue. It was agreed to substitute the swales with a two feet wide strip of permeable pavers, and to create smaller landscaped areas adjacent to the pavers, between neighboring lots or bordering the property lines. The Biscayne Point HOA has requested the City to: keep/restore the existing obelisk in its existing location; eliminate the four pergolas from the proposed entryway feature; keep the proposed walls along the entryway to Biscayne Point island (Item of contention),and enhance the lighting on the bridge adjacent to Biscayne Point Island. The Biscayne Beach HOA has requested the City to: install an illuminated neighborhood monument sign on the south side of 77th Street, and enhance the Tatum Waterway Bridge with an architectural design element. Biscayne Beach HOA representatives would like to pursue a prominent artist to lend his/her expertise to develop the design. Staff recommends that the following elements would remain or be incorporated in the Project: for the 77th St. entryway -keep and restore the obelisk, provide up-lighting for the obelisk, keep the paver crosswalks, and remove the proposed four pergolas and proposed walls at the entryway to Biscayne Point Island; for the 77th Street Bridge on Tatum Waterway -enhance barrier walls with a colored concrete mosaic; and provide pedestrian lighting; and provide neighborhood signage along 77th Street, between Dickens Ave and Tatum Waterwa Dr. and at Cres i Park. FUNDING The proposed modifications to the BODR should not have a significant impact on the streetscape component of the Project budget, as some of the proposed modifications involve deletion of elements previously included in the BODR. ANALYSIS Background The Biscayne Point Neighborhood is comprised of the following three sub-neighborhoods, each of which has its own home owners association (HOA): ^ Biscayne Beach ^ Biscayne Point Island ^ Stillwater Drive Please refer to Attachment No.1 for a graphical representation. Planning Process The Corradino Group was retained to provide planning level services for the Biscayne Point neighborhood and it resulted in the preparation of the neighborhood's BODR. This planning process consisted of among other tasks, two (2) Community Design Workshops to review and finalize preliminary design elements. The Community Design Workshops were held on: ^ September 19, 2002 ^ January 9, 2003 These efforts resulted in the preparation of the BODR and the referenced document was presented and recommended for approval by: ^ General Obligation Bond Oversight Committee on August 4, 2003 ^ City Commission on October 15, 2003 (Resolution No. 2003-25376) EAC Consulting, Inc. was subsequently hired by the City to design the neighborhood improvement project in accordance with the BODR. On February 6, 2008, a Community Design Review Meeting (CDRM) was held with the Biscayne Point residents to present the 60% design completion plans. At that meeting, residents from the Stillwater Drive sub- neighborhood expressed their concern with the loss of parking that would result from the creation of swales along their street. In consideration of the unique differences among the sub-neighborhoods, staff proceeded to schedule separate resident meetings for each of the sub-neighborhoods. Following is the result of these sub-neighborhood resident meetings. Stillwater Drive BODR Modifications The Stillwater neighborhood requested the removal of the BODR proposed swales, located along both sides of Stillwater Drive. The swales are green areas adjacent to the sidewalks that: ^ Improve the collection and treatment of storm water. ^ Create landscape areas along the sidewalks that beautify the street and contribute green space to the community ^ Serve as traffic calming devices. It is important to note that after several meetings with the neighbors, the City has been successful in reaching an amicable resolution with the Stillwater HOA with respect to the swales issue. It was agreed to substitute the swales with atwo-foot wide strip of permeable pavers, and to create smaller landscaped areas adjacent to the pavers, between neighboring lots or bordering the property lines. The benefits of this option are: ^ Minimizes loss of on street parking spaces, (an important item to the community). ^ Permeable pavers provide for parking surface as well as storm water conveyance. ^ This alternative also promotes green space in the community. ^ The resulting narrower street width promotes traffic calming. Biscayne Point Island BODR Modifications The general concern between the Biscayne Point and the Biscayne Beach HOAs is the extent, character, and location of the Biscayne Point entryway signage. The Biscayne Point BODR recommends a new Biscayne Point entryway as shown in Attachment 3. The BODR proposes four (4) pergolas, paver crosswalks, enhanced landscaping, walls along the north and south right of way, and monument entry signage in lieu of the existing obelisk/median illustrated in Attachment 4. The HOA has represented that the only modification to the BODR that they are proposing is as follows: Entryway at 77~' Street and Hawthorne Avenue - Keep and restore the Obelisk - Provide up-lighting for the Obelisk - Keep the proposed walls along the entryway to Biscayne Point Island (Item of contention) - Keep the proposed paver crosswalks - Remove the four proposed pergolas at the entryway to Biscayne Point Island Biscayne Beach BODR Modifications The HOA has represented that the only modifications to the BODR that they are proposing are as follows: ^ Eliminate the proposed walls along the entryway to Biscayne Point Island (Item of contention) ^ Install an illuminated neighborhood monument sign on the south side of 77~' Street, immediately east of the Tatum Waterway Bridge. The neighborhood monument sign would be similar in appearance to the neighborhood monument signs found in the Normandy Shores, Sunset Islands and La Gorce Island neighborhoods. The referenced neighborhood monument sign would predominantly identify the general neighborhood as Biscayne Point with less prominent lettering for the three (3) sub- neighborhoods -Biscayne Beach, Biscayne Point Island and Stillwater Drive. ^ Provide pedestrian lighting similar to existing Noremac Bridge. ^ Install a monument sign at Crespi Park identifying Biscayne Beach. ^ Enhance the Tatum Waterway Bridge with an architectural design element. Staff is evaluating an option of using colored concrete to create a nautical theme mosaic on the interior bridge bamer walls. Biscayne Beach HOA representatives would like to pursue a prominent artist to lend his/her expertise to develop the design. At the August 31, 2009 Capital Improvement Project Oversight Committee (CIPOC) meeting, the contentious item regarding the proposed walls at the 77~' Street entrance to Biscayne Point Island was not discussed/opposed by the Biscayne Beach HOA representatives. A representative from the Biscayne Beach HOA advised staff after the adjournment of the Commission Memorandum, September 9th, 2009 Biscayne BODR Changes Page 4 of 4 CIPOC meeting that they will not support the construction of the proposed walls at the 77th Street Biscayne Point Island entry. Please note that the adjacent property owners to this improvement have objected to the construction of the proposed walls (refer to Attachments 3 and 4). STAFF RECOMMENDATIONS Staff recommends that modifications proposed herein be approved and that the proposed walls at the 77th Street Biscayne Point Island entry be deleted from the BODR and be replaced with enhanced landscaping. Should they not be approved, staff recommends that the infrastructure elements of the neighborhood improvement project proceed to final design, permitting and construction so that critical infrastructure needs are met. Please note that the entryway feature would remain as existing during the construction of the infrastructure should the latter approach be taken. This approach allows ample opportunity for the HOAs to finalize their approach while the neighborhood improvement project proceeds into construction. Another benefit is that actual construction costs will be ascertained via this approach so that forthcoming decisions with respect to modifications and new requests may be evaluated and finalized. CONCLUSION Based on the aforementioned, the Administration recommends that the Mayor and City Commission approve an Amendment to Resolution No. 25376, which approved the BODR for the Biscayne Point Right-of-Way Project; said amendment amending the BODR as follows: on Stillwater Drive, substituting the swales with atwo-foot wide strip of permeable pavers and reduced planting areas; for the Biscayne Point Island 77th Street entryway, keeping and restoring the existing obelisk and its median, providing up-lighting to the obelisk, eliminating the four proposed pergolas and the proposed walls; for the Tatum Waterway Bridge, providing pedestrian lighting and enhancing bridge barrier walls with a colored concrete nautical theme mosaic; and providing neighborhood signage on 77~' Street, between Dickens Avenue and at Tatum Waterway Drive and at Crespi Park.
