CURRENT:
(3) Retail stores for off-premises consumption. The minimum distance separation between retail
stores primarily selling alcoholic beverages for consumption off the premises as a main permitted
use shall be 300 feet.
PROPOSED:
Retail stores for off premises consumption. The minimum distance separation between retail
stores selling alcoholic beverages for consumption off the premises as a permitted use shall be
1,500 feet. The minimum distance separation between any retail store selling alcoholic beverages
for consumption off the premises as a permitted use shall be 1,500 feet to any educational facility,
Place of Worship, museum (whether public or private), filling station, public park or public
beach.
SUPPORT:
Orange County v Costco Wholesale Corporation (No. SCO1-382) - In 2002, the Florida Supreme
Court, in upholding Orange County's 5,000 foot prohibition between licensed package liquor
sales businesses, cites Edward John Williams, who had been the director of the Orange County
Planning Department, who stated:
"the problem with. aggregating such businesses was not necessarily an evil
inherent in the stores themselves, but primarily rested in the secondary effects
associated with such business operations. He stated that allowing such stores in
close proximity to each other "lowers residential property values and creates an
extraordinary amount of traffic in and about those residential areas." He opined
that, because there are certain problematic activities (such as drinking in the
parking lots, fights, and driving while intoxicated) typically associated with
package stores...."
