A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE
MAYOR AND THE CITY CLERK TO EXECUTE AN UNDERGROUND
UTILITY EASEMENT TO FLORIDA POWER AND LIGHT AT THE
NORMANDY SHORES GOLF COURSE CLUB HOUSE FOR THE
INSTALLATION AND MAINTENANCE OF CONDUIT AND A
TRANSFORMER THAT WILL SERVE THE CLUB HOUSE.
WHEREAS, on March 5, 2009, ITB No. 21-08/9 was issued for the construction of a
replica Club House at the Normandy Shores Golf Course; and
WHEREAS, on May 13, 2009: the Mayor and City Commission authorized the award of
a contract for the construction of the replica Club House to John Moriarty & Associates of
Florida (JMA), Inc., in the amount of S1:934,427; and
WHEREAS, the City issued Notice To Proceed No. 1 on June 24, 2009 authorizing JMA
to begin pre-construction activities; and
WHEREAS, the City issued Notice To Proceed No. 2 on August 7, 2009 authorizing
JMA to begin construction; and
WHEREAS, FPL has determined that a new transformer and conduit are needed in
order to meet the electrical needs and provide adequate electrical service to the new club house
building: and
WHEREAS, FPL requires the City to grant FPL an underground utility easement
running from the service drop pole on the eastside of Biarritz Drive, north of Shore Lane, to the
southeast comer of the new club house building, in order to maintain service access to the new
transformer and electric conduits; and
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission hereby approve and authorize the Mayor and the City Clerk to grant the attached
easement to Florida Power and Lighi for the installation and maintenance of conduit and a
transformer that will serve the club house

During the reconstruction of the Normandy Shores Golf Course Club House, FPL determined that a new
transformer and associated electrical conduits were needed. FPL requires that that an easement be
granted authorizing it to construct and maintain these facilities.
Since the original conduit and transformer are not in an easement. it was decided to place the new conduit
along a more efficient route that is shorter and avoids the club house parking lot. This wilt benefit both the
City and FPL.

Record the easements.
FUNDING
No funding is required to record the easement.
ANALYSIS
On March 5, 2009. ITB No. 21-0819 was issued for the construction of a replica Club House
at the Normandy Shores Golf Course. The pre-bid conference was held on March 20, 2009.
Bids were opened on April 9, 2009. On April 14 and 15, 2009: a Technical Review Panel
convened, evaluated, and ranked the bidders. The Technical Review Panel unanimously
recommended to the City Manager that the low bidder, John Moriarty & Associates of Florida
(JMA), Inc. be awarded the contract.
At the May 13, 2009 Commission Meeting, the Mayor and City Commission authorized the
award of a contract to JMA in the amount of $1,934,427 for the construction of a replica Club
House, as recommended by the City Manager.
The City issued Notice To Proceed No. 1 on June 24, 2009 authorizing JMA to begin pre-
construction activities. The City issued Notice To Proceed No. 2 on August 7, 2009,
authorizing JMA to begin construction. The Club House is on schedule for completion by the
September 9, 2010 due date.
As work progressed, FPL determined that a new transformer and conduit were needed. FPL
requires that an easement be granted authorizing it to construct and maintain these facilities.
Since it was discovered that the old FPL conduit and transformer are not in an easement, it
was decided to use a more efficient route that is shorter and avoids the club house parking
lot. This will benefit the City and FPL. The CIP Office had a survey prepared (attached) that

describes the easement to be recorded per FPL requirements.
CONCLUSION
The Administration recommends that the City record the easement for FPL in order to power the
replica Club House for Normandy Shores Golt Course.
