Administration Recommendation: Approve the Resolution subject to f nalization of the Lease Agreement between
LRI of South Florida, Ltd., and the City of Miami Beach for the Electric Shuttle Charging Station; subject to the
developer's meeting the terms and conditions conveyed in the Vacation Agreement and Covenant Running with
the Land in Lieu of Unity of Title and Tenant Restrictions; and subject~to the developer's deeding the vacant lot on
Lenox Avenue adjacent to the alley, to the City on an unconditional basis.

ACTION: Resolution No. 96-22186 adopted authorizing conditional vacation. Motion made by Commissioner
Kasdin approving the vac tion subject to the following amendments: 1) that before the vacation occurs and before
the breaking of escrow LRI obtain title on both properties, except as provided in vacation agreement; 2) that a
building permit is pulled by September 30, 1997, except for circumstances recited in the written agreement; 3)
delays are to be documented at time of occurrence; if not documented, they will be waived; that the City Attomey
draft clarifying language regarding the procedure for documenting or waiving government delays; 4) City may use
the lot south of the Chase Building until deeded or until transaction Is undone. Seconded by Commissioner
Gottlieb; vote:7-0. Signature page of Vacation Agreement "Exhibit B" ~,to be corrected to include signature by
"Developer". LRI to produce status reports every 30 days. R. Nachliriger and Harry Mavrogenes to review
financial documentation and report back to the City Manager in writing. Harry Mavrogenes to designate project
manager for business transactions. City Attorney to review and prepare loan documentation.
