2010-27326 RESOLUTION NO. A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING RESOLUTION 2009- 27279, SUBJECT TO AND EFFECTIVE UPON APPROVAL BY MIAMI- DADE COUNTY, INCREASING THE PRESENT FIRE RESCUE TRANSPORT FEES FROM $330 TO $358.67 FOR BASIC LIFE SUPPORT, FROM $380 TO $425.93 FOR ADVANCED LIFE SUPPORT 1, AND FROM $490 TO $616.47 FOR ADVANCED LIFE SUPPORT 2, AND MAINTAINING THE CURRENT FEES FOR ALL EXPENDABLE MEDICAL SUPPLIES, WITH SERVICES NOT TO BE WITHHELD DUE TO A PERSON'S INABILITY TO PAY. WHEREAS, the City of Miami Beach Fire Department serves as the provider of fire rescue transport services, and in order to comply with the provisions of the Code of Miami- Dade County, Florida, Chapters 4-7 Ambulance and Medical Transportation-Rates, proposed emergency transport fees are subject to and effective upon approval by Miami-Dade County; and WHEREAS, this Resolution adopts the same fee schedule passed on September 9, 2009 in City of Miami Beach Resolution 2009-27279 and conforms to the changes Miami-Dade County made to Section 4-7 of the Code of Miami-Dade County on January 21, 2010; and WHEREAS, the current fees for transport services are as follows: Basic Life Support $330.00 Advanced Life Support 1 $380.00 Advanced Life Support 2 $490.00 Mileage Charge/per Mile $ 7.50 Cardiac Monitoring $ 25.00 I.V. / I.O. $ 25.00 Intubation $ 25.00 Oxygen $ 30.00 Spinal Immobilization $ 25.00; and WHEREAS, it is necessary to raise the established Fire Rescue Transport Fees for Basic Life Support, Advanced Life Support 1, and Advanced Life Support 2, due to increased operation expenses and to become uniform with Miami-Dade County Fire Rescue Services as follows: Basic Life Support $358.67 Advanced Life Support 1 $425.93 Advanced Life Support 2 $616.47; and WHEREAS, all fees for expendable medical supplies shall remain the same; and WHEREAS, notwithstanding the above increased fees, no individuals shall be deprived of Fire Rescue Transport Services due to the inability to pay for such services. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that, subject to and effective upon approval by Miami-Dade County, Resolution 2009-27279 is here by amended, increasing the present fire rescue transport fees, but maintaining the current fees for all expendable medical supplies as follows: Basic Lffe Support $358.67 Advanced Life Support 1 $425.93 Advanced Life Support 2 $616.47 Mileage Charge/per Mile $ 7.50 Cardiac Monitoring $ 25.00 I.V. / I.O. $ 25.00 Intubation $ 25.00 Oxygen $ 30.00 Spinal Immobilization $ 25.00 with services not to be withheld due to a person's inability to pay. Supporting Data (Surveys, Environmental Scan, etc.-: According to the 2009 Community Survey 96.8% of residents rated the overall quality of City Fire as excellent or good; and according to the Environmental Scan, in 2008 the Fire De artment received 22,640 calls and 16,599 of them were rescue related. The City Commission adopted resolution 2009-27279 increasing the Fire Rescue transport fee effective upon approval by Miami Dade County. In the interim, Miami Dade County passed ordinance 10-02 on January 21, 2010, which amended section 4-7 of the Code of Miami Dade County Florida to provide that rates charged by municipal ground ambulance certificate holders shall be determined by resolution adopted by City Commission providing that approved rates become effective when filed with the Consumer Services Department. This resolution adopts the same fee schedule passed on September 9, 2009 with an effective date of February 03, 2010 and conforms to the changes Miami Dade County made to section 4-7 of the code of Miami Dade County on January 21, 2010. The Fire Department Fire Rescue Transport Fees will provide needed revenue to offset the growing cost of supplies and fuel in FY 2009/10. The proposed schedule balances consumer and industry needs and will have minimal impact on consumers due to the fact that ambulance transports are typically paid for by Medicare, Medicaid and private insurance. As for uninsured and underinsured patients who are unable to pay, it remains the policy of the City of Miami Beach not to pursue payment, and their outstanding balances are not collected. By amending Resolution 2009-27279 the proposed fee schedule, which is subject to and effective upon approval by Miami-Dade County and any subsequent ammendments that the County shall make to the fee shedule, the City of Miami Beach enhances the ability of the Rescue Division to provide the best possible service to the stakeholders of the City of Miami Beach. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS The City Commission adopted resolution 2009-27279 increasing the Fire Rescue transport fee effective upon approval by Miami Dade County. In the interim, Miami Dade County passed ordinance 10-02 on January 21, 2010, which amended section 4-7 of the Code of Miami Dade County Florida to provide that rates charged by municipal ground ambulance certificate holders shall be determined by resolution adopted by City Commission, providing that approved rates become effective when filed with the Consumer Services Department. This resolution adopts the same fee schedule passed on September 9, 2009 with an effective date of February 03, 2010 and conforms to the changes Miami Dade County made to section 4-7 of the Code of Miami Dade County on January 21, 2010. The Miami Beach Fire Rescue Department transport fees provide needed revenue to offset budgetary costs. The proposed annual budget for the Rescue Division for Fiscal Year (FY) 2009/10 is $14,057,582. Revenue for Rescue Transports is projected to be $1,300,000 at the current fees as set by the City Commission. By amending Resolution 2009-27279 which is subject to and effective upon approval by Miami Dade County and the increases that may be amended from time to time by the County, the City will be able to further offset the operating costs of the Rescue Division. It is anticipated that the County will raise their transport fees this FY although the amount of the increase has not been set as yet. CONCLUSION The Administration recommends that the Mayor and City Commission adopt the attached resolution approving and authorizing the transport fees as set by the County and future amendments to the rates as set by the County. T Agenda Item No. 7(C) Page 2 between one or more private ambulance providers and Miami-Dade County; or, (3) by resolution adopted by the Board approving a lower uniform rate to provide private inter-facility transfer of indigent or Medicaid patients to or from astate-designated and licensed rural hospital, as specified in Section 395.602(2)(e)4, Florida Statutes, where said rate has been negotiated by the hospital and a private certificate holder. Rates established by this chapter shall be applicable throughout Miami-Dade County, both in the incorporated and unincorporated areas, without regard to any municipal boundaries. Every ambulance shall have posted in a conspicuous place, readily visible to the occupants, a schedule showing all authorized rates. (b) Ambulance and air ambulance rates. All ambulance and air ambulance rates shall be established by the commission after public hearing. The manager shall investigate all requests for rate changes and prepare a report for the commission's consideration. (c) Private ground ambulance rates. It is the intention of the Board of County Commissioners, and it is hereby ordained that the provisions of this ordinance, including any sunset provision, shall become and be made a part of the Code of Miami-Dade County, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. Section 4. This ordinance shall become effective ten (10) days after the date of enactment unless vetoed by the Mayor, and if vetoed, shall become effective only upon an override by this Boazd.
