A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE AMENDMENT NO. 4 TO THE EXISTING
PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES
AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND EAC
CONSULTING, INC. (EAC), FOR ADDITIONAL DESIGN SERVICES ASSOCIATED
WITH THE STORMWATER SYSTEM DESIGN, IN A NOT TO EXCEED AMOUNT
OF $113,984; FOR THE BISCAYNE POINT RIGHT-OF-WAY INFRASTRUCTURE
IMPROVEMENT PROJECT; WITH FUNDING FROM STORMWATER BOND FUND
428 FOR DESIGN, IN THE AMOUNT OF $113,964, PREVIOUSLY
APPROPRIATED IN THE FISCAL YEAR 2003.2004 CAPITAL BUDGET.
WHEREAS, on July 27, 2005, the Mayor and City Conunission adopted to Resolution No.
2005-25973, approving and authorizing the Mayor and City Clerk to execute an Ayreernent with
EAC Consulting Inc., for Professional Architectural and Engineering Services for the Biscayne
Point Neighborhood Right of Way (ROW) Improvement Project (the Project); and
WHEREAS, the Agreement provides for the planning, design, bidding and award,
constriction administration, and reirnbursables for the Project; and
WHEREAS, the Agreement was executed for arr amount of $1,186,807; and
WHEREAS, Amendment No. 1 to the Agreement, in the amount of $129,325 was approved
as per Resolution No. 2006-26133, for a total fee of $1,316,132; and
WHEREAS, Amendment No. 2 to the Agrearnenl, in the amount of $24,924 was approved
adrninislralively, for a total Agreement fee of $1,341,056; and
WHEREAS, Amendnrerrt No. 3 to the Agreement, in the amount of $27,000 was approved
as per Resolution No. 2009-26979, for a total Agreement fee of $1,368,056; and
WHEREAS, EAC's "Pump Station Conceptual Modeling Letter Report" identifies the need
for pumps and additional connecting pipes different than those indic;aled in the BODR; and
WHEREAS, Staff have evaluated EAC's supporting documentation for additional
stormwater work and concurs with the need for additional stormwater work; and
WHEREAS, al ibis lime, the City has negotiated Amendment No. 4, to the existing
agreement with EAC for the provision of additional design and construction administration services
associated with the stormwater System, including the addition of three (3) pump stations and the
necessary pipes and structures needed to corrrply witty regulatory agencies' requirements: and
WHEREAS, City Staff and the Special Assistant to the City Manager have nret several
times with EAC to negotiate the fees for Amendment No. 4. Negotiations resulted in important
savings for the Cily in the amount of $101,725 approximately 47% less than EAC's original
proposal of $215,709; and
WHEREAS, this Amendment No. 4 includes the additional design services for the storm
water system in the not to exceed amount of $113,984; and
WHEREAS, Amendment No. 4 increases the contracted fees in a arnourtl total of
$113,984, for a total contract fee of $1,482,040: and
WHEREAS, funding from Stomiwater Bond Fund 428 for Design, in the amount of
$113,984, previously appropriated in the Fiscal Year 2003-2004 Capital Budget; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and Cify Commission hereby approve
and authorize the Mayor and City Clerk to execute Amendment No. 4 to the existing Professional
Architectural and Engineering Services Agreement between the City of Miaml Beach ,Florida
and EAC Consultiny, Ina, for additional design services associated with the stormwater system
design, in a not to exceed amount of $113,984, for the Biscayne Point ROW Infrastructure
Improvement Project, with funding from stormwater Bond Fund 428 for Design, in the amount of
$113,984, previously appropriated in the Fiscal Year 2003-2004 Capital Budget.

1. SCOPE OF SERVICES
Schedule "A" entitled, "Scope of Services", is amended as follows:
ADD the following under Task 5 -ADDITIONAL SERVICES
Task 5.6-Drainage AssessmenU Study
The Consultant shall provide detailed design services for producing a set of contract
documents (specifications and drawings) as needed for the construction of additional
stormwafer work within the Biscayne Point Neighborhood. In this effort, the Cvnsullanl
shall be bound by the requirements stipulated in Task ?_ -Design Services as adopted via
Resolution No.2005-25973, on July 27, 2005, for the Biscayne Point Neighborhood Right
of Way Improvement Project.
The Additional Tasks are:
1. Incorporation of drainage pump stations.
2. Determination of minimum number of drainage pump stations and implement on
project considering available Right of Way (Easement) for placernenl and
associated costs.
3. Provision of Drainage Gravity /Injection wells to dispose only the water quality
volume associated with the 5 year-24 hour storm.
4. Provision outfall connection for all proposed drainaye systems.
5. Investigate, Evaluate and ascertain the condition of existing outfall pipes,
easernenls and determine viability for use as part of the proposed drainaye
improvements.
6. Limit maximum stages for the 5 year- 24 hour storm to the lower of the RAN
elevation or crown of existing roadway.
Task 5.7- Construction Drawings and Technical Specifications
EAC will provide full desiyn of construction drawinys and technical specifications related to
the recommendations of the drainage assessment study Task 5.4 . The full construction
drawinys related will require the (ollowiny addition plan sheets as well as modifications to
the following:
a. Cornplele engineering design of pump stations as necessary for the disposal of
stormwafer runoff via injection wells and positive outfall to Biscayne Bay. Cut
Engineering plans and drawings for the new pump stations layvul and associated
stormwater collection system.
b. Revisions to existing stormwafer collection system layout to accommodate the
proposed desiyn approach. Please note that based on project coordination
meeting, the development of constnrction drawings approach will assume that a
typical pump station layout will be used for all pump stations regardless of size,
with a tabulation showing specific information relative to all the pump stations to he
utilized on the project.
c. Pump Station Miscellaneous Details and Notes.
d. Pump Station Electrical Plans, layout, Service Points, Coordination with FPL and
Public Works, Electrical Details and alt miscellaneous work to achieve complete
construction documents and operable systems.
e. Technical Specifications related to Pump Stations Specifications.
f. Pump Station Mechanical/Structural drawings and applicable details.
g. Modifications seven (7) sheets of 90% complete water main (WM) design and
drawings based on revisions to storrnwaler collection system layout.
h. Modlfications to four (4) sheets of 90% paving and grading (PG) design and
drawings based on revisions to stonnwater collection system layout.
Task Ci.4.1 -Construction Administration Services for additional Stormwater work as
described above in Task 5.7
Task 4.1 -Supplemental Bid /Award and Construction Support Services
Supplemental Bid and Award as well Construction Administration services as required
due to the potential for additional oversight resulting from the increased improvements
and construction duration.
Task 6.7 -Reproduction Services
It is agreed that there are no additional tees resulting from Reproduction services
associated with the additional Stormwater work and Stillwater Drive Swale modification.
2. TIME OF COMPLETION
Additional design services contemplated by this Amendment are to be completed within
the base Agreement schedule, adopted via Resolution No. 2005-25973, on July 27, 2005
between the City and Consultant.
3. PAYMENT AND COMPENSATION
Compensation: The method of calculating fees for the atorementioned proposed
additional professional architectural and engineering services is based on the provisions
established in Article 7 of the Ayreernenl with Consultant.

On January 6, 2009, Amendment No. 2 in the amount of $24,924 was executed administratively for addilio
stormwater system modeling services to determine the most feasible solution available for the project; as a resul

FUNDING
Project funding from Stormwater Bond Fund 428 (Account No.428-2321-061357), in the
amount of $113,984, was previously appropriated in Fiscal Year 2003-2004 Capital Budget.
BACKGROUND
Ort October 15, 2003, the Mayor and City Commission approved the Basis of Design Report
(BODR) for the Infrastructure Improvement Proyrarn for the Biscayne Point Neighborhood
prepared by The Corradino Group Inc., via Resolution No. 2003-25376. The City terrninaled
its relationship with The Corradino Group Inc., on September 24, 2004.
On October 13, 2004, the City Commission issued a Request for Qualifications (RFQ) to
select another consultant to complete the Biscayne Point Neighbofiood Improvement
Project.
On July 27, 2005, the Mayor and the City Commission adopted Resolution No. 2005-25973,
approving and authorizing the Mayor and City Cleric to execute an Ayreernenl with EAC
Consulting, Inc., for Professional Services for the Biscayne Point Neighborhood Right-
of-Way Improvement Protect in the amount of $1,186,807.
On March 8, 2006, the Mayor and City Commission adopted Resolution No. 2006-26133

approving and authorizing the Mayor and Cily Clerk to execute Amendment No.1 to the
existing agreement with EAC for the design and pemiitfing of an additional 11,000 linear feel
of water main infrastructure required by the City's Public Works Department. Amendment
No.1 increased the original design contract value by $129,325, fora total fee of $1,316,132.
On January 6, 2009, Amendment No. 2 was executed administratively for additional
stormwater system modeling services to find the most feasible solution available for the
project. Amendment No. 2 increased the original design contract value by $24,924, for a
total fee of $1,341,056.
On January 28, 2009, [he Mayor and City Commission adopted Resolution No. 2009-26979,
approving and authorizing the Mayor and City Clerk to execute Amendment No.3 to the
existing agreement with F~4C for additional Professional A/E Services for the inclusion of
Pavement Markings and Signage drawings which were not included in the original design
contract. Amendment No. 3 increased the original design contract value by $27,000, for a
total tee of $1,368,056.
Additional stormwater Design: Amendment No. 4
The City's Comprehensive stormwater Management Plan identified the priority drainage
basins within the City. Basin 142 is the only priority basin within the Biscayne Point
neighborhood; it includes all of Stillwater Drive and the northern part of Biscayne Beach from
midway hetween 83rd Street and 84th Street up to the Biscayne Bay north shoreline.
Attachment No.2 shows the boundaries of Basin 142. All of the proposed stormwater
improvements in the neighborhood were identified to occur within the boundaries of this
basin.
The BODR prepared by The Corradino Group Inc., identified approximatelytwenty-two (22)
gravity wells and stormwater conveyance infrastructure in the amount of $1,355,640. This
recommendation was based upon preliminary engineering analyses and limited
topographical data. A full topographical survey and additional field investigations were not
performed until the design phase, which occurred after September 24, 2004, when The
Corradino Group Inc., was released by the City and EAC was retained.
Based on the new topographic survey's data and the results from a seven (7) inrh diameter
test well, on March 19, 2008, EAC presented a preliminary hydraulic model of Basin 142.
The model's results indicated that the stormwater improvements described in the BODR
would not meet the standard Miami-Dade County Department of Environmental Resources
Management (DERM) and City of Miami Beach (CMB) stormwater requirements. EAC's
analysis also indicated prat approximately four (4) new pump stations were needed to fully
comply with the DERM and City requirements. The estimated necessary stormwater
construction cost almost tripled.

After staff reviewed EACs' stormwater analysis it was observed that the hydraulic model did
not comply fully with the City's Comprehensive Storrnwater Master Plan which requires larger
pipes than the ones proposed by EAC; therefore on July 22, 2008, the City requested EAC to
revise their preliminary modeling approach to the drainage design in order to complywith the
City's Comprehensive Stomiwater Master Plan. Subsequently on July 30, 2008, EAC
presented a revised modeling approach to the drainage system, to meet the DERM and City
requirements, using the 5-year/24 hour design storm event. The revised model again
projected the need for four (4) pump stations in order to have an effective stormwater
system.

The scope of work of Amendment No. 4 includes the additional design services for the
stormwater system as identified in EAC's PSCMLR in the amount of $113,984.
City Staff and the Special Assistant to the City Manager have met several times with EAC to
negotiate the fees for Amendment No. 4. Negotiations resulted in important savings for the
City in the amount of $101,725 approximately 47% less than EAC's original proposal of
$215,709. Savings were the result of:
• Clarification of the scope of work associated with the additional
professional services.
• Revision of the estimated number of work hours associated with each
task.
• Adjustment of the consultant's hourly rates to match the fees the City is
currently accepting for similar projects.
EAC's revised proposal of November 9, 2009 (Attachment No. 1) reflects the not to exceed
fee of $113,984 and describes all the required additional professional services identified in
EAC's PSCMLR. Amendment No. 4, increases EAC's total contract fee in anot-to-exceed
amount of $113,984 for a total contract amount of $1,482,040, representing approximately
10 % of the total estimated construction cost of approximately $14,8UU,000.

CONCLUSION
The Administration recommends that the Mayor and Cily Commission adopt a resolution
of the Mayor and City Commission of the City of Miami Beach, Florida, approving and
authorizing the Mayor and Cily Clerk to execute Amendment No. 4 to the existing
professional architectural and engineering services agreement between the City of Miami
Beach, Florida and EAC Consulting, Inc., for additional design services associated with the
storrnwaler system, in a not to exceed amount of $113,984, For the Biscayne Point ROW
