AND ENGINEERING (A / E) SERVICES AGREEMENT

THE CITY OF MIAMI BEACH, FLORIDA
AND
EAC, CONSULTING INC.
DATED JULY 27, 2005
FOR THE PROVISION OF
PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES FOR THE BISCAYNE
POINT RIGHT OF WAY INFRASTRUCTURE IMPROVEMENT PROJECTS.
his Amendment No. 4 to the above referenced Agreement is made and entered this day of
c ur~r n! r"L-, 2009, by and between tfre CITY OF MIAMI BEACH, a Municipal Corporation existing
under the laws of the State of Florida, having its principal offices at 1700 Convention Center Drive,
Miami Deach, Florida 33139 (heminafter reterred to as Cit~), and EAC,CONSUL7ING INC., a
Florida Corporation, having its principal office at 815 NW 57 Avenue, Suite 402, Miami, Florida,
33126 (hereinafter referred to as Consultant).
RECITALS:
WHEREAS, on July 27, 2005, the ~4ayor and City Commission adopted to Resolution No.
2005-25973, approving and authorizing the Mayor and City Clerk to execute an Agreementwith EAC
Consulting Inc., for Professional Architectural and Engineering Services for the Biscayne Point
Neighborhood Right of Way (ROVJ) Improvement Project (the Project); and
WHEREAS, the Agreement provides for the planning, design, bidding and award,
construction administration, and reimbursables for the Project; and
WHEREAS, the Agreement was executed for an amount of $1,186,807; and
WHEREAS, Amendment No. 1 to the Agreement, in the amount of $129,325 was approved
as par Resolulion Nu. 2006-26133, for a total fee of $1,316,132; and
WHEREAS, Amendment No. 2 to the Agreement, in the amount of $24,924 was approved
administratively, for a total Agreement tee of 51,341,056; and
WHEREAS, Amendment No. 3 to the Agreement, in the arnountof $27,000 was approved as
per Resolution No. 2009-26979, for a total Agreement fee of $1,368,056; and
WHEREAS, EAC's "Pump Station Conceptual Modeling Letter Report" identifies the need for
pumps and additional connecting pipes different than those indicated in the BODR; and
WHEREAS, Staff have evaluated EAC's supporting documentation for additional stormwater
work and concurs with the need for additiona! storrnwater work; and
WHEREAS, at this time, the City has negotiated Amendment No. 4, to the existing
agreement with EAC for the provision of additional design services associated with the Stormwater

System, including the addition of three (3) pump stations and the necessary pipes and structures
needed to comply with regulatory agencies' requirements; and
WHEREAS, this Amendment No. 4 includes the additional design services for the stormwater
system in the not to exceed amount of 5113,984; and
WHEREAS, Amendment No. 4 increases the contracted fees in a amount total of $113,984,
for a total contract fee of 51,482,040; and
WHEREAS, funding from Stormwater Bond Fund 428 for Design, in the amount of 5113,984,
previously appropriated in the Fiscal Year 2003-2004 Capital Budget; and
NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises,
covenants, agreements, terms, and conditions herein contained, and other good and valuable
consideration, the respect and adequacy are hereby acknowledged, do agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this Amendment
No. 4.
2. MODIFICATIONS
The Agreement is amended to include the necessary professional services to the Biscayne
Point Neighborhood Right-Of-Way Improvement Project Services associated with design
services for the stormwater system as Ident~ed in EAC's "Pump Station Conceptual
Modeling Letter Report" ,and described in EAC's revised proposal dated October 1, 2009,
and attached as Attactrment No. 1 f~ereto, the Consultant shall provide the services required
pursuant to this Amendment No. 4, in the negotiated total amount of $113,984.
3. OTHER PROVISIONS
All other provisions of the Agreement remain unchanyed.
4. RATIFICATION
7"he City and Consultant ratify the terms of the Agreement, as per this Amendment No. 4.

- Supplemental Engineering Services Proposal (Amendment 4}
Dear Mr. Perez:
Pursuant to the protect coordination meeting held June 30t", 2009 at the C.LP Conference Raom,
please find as follows our associated scope of engineering services and tee proposal to undertake
the requisite engineering services for the following supplemental tasks identified and required for
the project. The proposed scope of services is based on the conceptual study performed by EAC
Consulting Inc., previously approved by the City.
Task 1-System-wide Drainage Analyses. Modeline. Computations and Recommendations
This comprises of the effort to revise the design approach to storm water management design,
by incorporating the following:
a. Incorporation of drainage pump stations as necessary especially it areas of low topography
and high susceptibility to flooding.
b. Complete civil, mechanical, structural and electrical engineering design of pump stations as
necessary for the disposal of storm water runoff via injection wells and positive outfall to
Biscayne Bay.
c. Provision of Drainage Gravity /Injection wells to dispose only the water quality volume
associated with the 5 year--24 hour storm.
d. Provision outfall amnection for all proposed drainage systems.
e. Limit rnaxirnum stages for the Syear- 24 hour storm to the luwer of the R/W elevation or
crovdn of existing roadway. Furthermore, the stages will be verified to ensure no adverse
Impact 15 feet from dwellings in instances where the R/W elevation Is lower than the croon
of roadway.
EAC Consulting Inc, will incorporate applicable information related to revised disposak
methodology vdithin the Drainage Documentation report torthe project.
Task 2- Construction DrawinE!s and Technical Specifications
Upon the cornpietion of Task 1, FAC will proceed with arnendrnenfs to the cunstruaian
drawings and technical specifications implementing the recommendations derived. The
recommendations will he verified with the City prior to implementation. The full constructor
drawings related will require additional plan, profilF and details including the following:
a. Mechanical, Electrical and Structural Engineering Design Analyses.

b. Revisions to existing storm water collection system layout to accommodate the
proposed design approach. Please note that based on our project coordination meeting,
the development of construction drawings approach will assume that a typical pump
station layout will be used for all pump statons regardless of size, with a tabulation
showing specific inforrnatlon relative to all the pump stations to be utilized on the
project.
c. Pump Station Civil Engineering Miscellaneous Details and Notes
d. Pump Station Electrical Plans, layout, Service Points, Coordination with FPL and Public
Works, Electrical Details anti all miscellaneous work to achieve complete construction
documents and operable systems.
e. Technical Specifications related to Pump Stations Specifications.
f. Pump Station Mechanical/Structural drawings and applicable details.
g. Modifications seven (7) sheets of 9r)% complete water main (WM) design and drawings
based on revisions to stone water collection system layout.
h. Modifications to four (4) sheets of 90% paving and grading (PG) design and drawings
based on revisions to storm water collection system layout.
The new construction drawings are itemized as the drawing/sheet list provided w(th this fee
proposal submittal.
Please feel free to contact our office for any questions and/or clarification relating to the proposed
improvements planned for the Biscayne Point Neighborhood.
