A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
SUBMIT THE FOLLOWING APPLICATIONS: 1)
TRANSPORTATION ENHANCEMENT FUNDS FROM MIAMI-DADE
COUNTY'S METROPOLITAN PLANNING ORGANIZATION FOR
FUNDING IN AN AMOUNT NOT TO EXCEED $1,000,000 FOR
PHASE 2 OF THE MIDDLE BEACH RECREATION CORRIDOR; 2)
NATIONAL ENDOWMENT FOR THE ARTS FOR FUNDING IN AN
AMOUNT NOT TO EXCEED $100,000 FOR THE CITY'S
"MERMAID" SCULPTURE; 3) AMERICAN RECOVERY AND
REINVESTMENT ACT FUNDING THROUGH THE UNITED
STATES DEPARTMENT OF COMMERCE FOR THE
BROADBAND TECHNOLOGY OPPORTUNITY PROGRAM IN AN
AMOUNT NOT TO EXCEED $5 MILLION FOR THE CITY'S
BROADBAND INITIATIVE; 4) FLORIDA INLAND NAVIGATION
DISTRICT FOR FUNDING IN AN AMOUNT NOT TO EXCEED
$1,000,000 FOR THE CONSTRUCTION PHASE OF SOUTH POINTE
PIER, AND FOR FUNDING IN AN AMOUNT NOT TO EXCEED
$200,000 FOR THE CITY'S SEAWALL IMPROVEMENT PROJECT;
AND, 5) RETROACTIVELY, TO THE STATE OF FLORIDA,
DEPARTMENT OF HEALTH, FOR FUNDING IN AN AMOUNT NOT
TO EXCEED $15,000 FOR EQUIPMENT RELATED TO PRE-
HOSPITAL EMERGENCY SERVICES; APPROPRIATING THE
ABOVE FUNDS, IF APPROVED AND ACCEPTED BY THE CITY,
AND AUTHORIZING THE EXECUTION OF ALL NECESSARY
DOCUMENTS RELATED TO THESE APPLICATIONS
WHEREAS, Miami Dade County makes funds available through the
Metropolitan Planning Organization (MPO) for transportation enhancement programs;
and
WHEREAS, the Middle Beach Recreational Corridor (MBRC) Phase 2 project
consists of the construction of an on-grade pedestrian walkway encompassing eighteen
city blocks and is eligible for these funds; and
WHEREAS, the entire cost of Phase 2 of the MBRC project is $13.3 million, of
which $570,000 is already funded for design; and, the City Administration plans to
submit an application for funding in the amount of $1,000,000 which will go towards the
construction of Phase 2; and
WHEREAS, this program does not require matching funds and the project
supports the key intended outcome: enhance mobility throughout the City; and
WHEREAS, approval is requested to submit an application to Miami-Dade
County's Transportation Enhancement Program, for funding in an amount not to exceed
$1,000,000 for Phase 2 of the Middle Beach Recreational Corridor Project; and
WHEREAS, the National Endowment for the Arts provides funding for public art
through its Access to Artistic Excellence Program; and
WHEREAS, the Administration plans to submit an application in an amount not
to exceed $100,000 for the conservation of its Roy Lichtenstein's sculpture entitled
"Mermaid", which is located on the lawn of the Fillmore Miami Beach at The Jackie
Gleason Theater; and
WHEREAS, Roy Lichtenstein is a leading figure in 20th Century American art
and one of the founders of pop art; and
WHEREAS, the grant program requires a $1:$1 match, and matching funds in
the amount of $100,000 are available from the Art in Public Places Fund; and
WHEREAS, this project supports the key intended outcome: maintain City's
infrastructure; and
WHEREAS, approval is requested to submit an application to the National
Endowment for the Arts for funding in an amount not to exceed $100,000 for the
conservation of Roy Lichtenstein's sculpture entitled "Mermaid"; and
WHEREAS, the Recovery Act appropriated funding and directed the Department
of Agriculture's Rural Utilities Service and the Department of Commerce's National
Telecommunications Information Administration to expand broadband access to
unserved and underserved communities across the country and Round 1 of this funding
was limited to rural areas; and
WHEREAS, Round 2 funding for this program is now available and is open to
areas that are not rural, and the program will provide grants to fund broadband
infrastructure, public computer centers and sustainable broadband adoption projects;
and
WHEREAS, the Administration intends to apply for funding under the Broadband
Technology Opportunity Program for the City's broadband initiatives, which include Wi-Fi
operating costs, as well as other costs, which may include but are not limited to
automated water meter reading; red light traffic cameras; parking pay station; and
maintenance funds for street lights; and
WHEREAS, the City intends to apply for an amount not to exceed $5 million, and
grant recipients must complete projects within three years following award; and
WHEREAS, a 20% match is required; the match is available from the
Information Technology Department's Operating Budget, and will be spread over a
three-year period from Fiscal Year 10/11 through Fiscal Year 12/13; and
WHEREAS, this project supports the key intended outcome: expand e-
government; improve processes through information technology; and
WHEREAS, approval to submit an application for American Recovery and
Reinvestment Act funding through the Department of Commerce for the Broadband
Technology Opportunity Program in an amount not to exceed $5 million for the City's
Broadband Initiative; and
WHEREAS, the Florida Legislature created s. 374.976, Florida Statutes in
recognition of the importance and benefits of inland navigation channels and waterways,
as well as in acknowledgement of the problems associated with the construction,
continued maintenance and use of these waterways and the law authorizes and
empowers each inland navigation district to undertake programs intended to alleviate the
problems associated with its waterways; and
WHEREAS, the Florida Inland Navigation District program that provides funding
for these projects is called the Waterways Assistance Program; and
WHEREAS, the Administration intends to submit two applications under this
program, the first FIND grant application is for South Pointe Park Pier; and
WHEREAS, the City is currently in the design phase of this project and was
previously awarded funding from FIND in the amount of $323,077 for planning, design
and engineering related to rebuilding the existing pier; and
WHEREAS, the total cost of this project is budgeted at $6.6 million and the
Administration intends to request funding in an amount not to exceed $1 million for
construction; and
WHEREAS, matching funds are required for this grant and are available from
previously appropriated South Pointe Capital Funds; and
WHEREAS, the second FIND grant application is in an amount not to exceed
$200,000 for the repair of seawalls and upland improvements to the streetends and the
City has $200,000 in matching funds in the form of 2003 GO Bonds and Stormwater
Bonds; and
WHEREAS, both projects support the key intended outcome: ensure value and
timely delivery of quality capital projects; and
WHEREAS, approval is requested to submit an application to Florida Inland
Navigation District (FIND) in an amount not to exceed $1,000,000 for the construction
phase of South Point Pier and for funding in an amount not to exceed $200,000 for the
City's seawall improvement project; and
WHEREAS, FIND requires the City to execute Attachment E-6, a Resolution for
Assistance under the Florida Inland Navigation District Waterways Assistance Program;
and
WHEREAS, the EMS Matching grant program provides emergency medical
service providers with funds to acquire, repair improve or upgrade emergency medical
services systems; and
WHEREAS, the Administration has requested funding in an amount not to
exceed $15,000 for equipment to allow Emergency Medical Services personnel to
employ a more effective method for delivering chest compressions; and
WHEREAS, the grant requires a 25% match of the total project cost and the
Fire Department has funding available in its operating budget to cover the costs of this
match; and
WHEREAS, this grant supports the key intended outcome: increase community
satisfaction with City government; and
WHEREAS, retroactive approval is requested to submit an application to the
State of Florida, Department of Health for funding in an amount not to exceed $15,000
for equipment related to Pre-Hospital Emergency Services.
NOW THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH hereby approve and authorize the City
Manager or his designee to submit the following applications: 1) Transportation
enhancement funds from Miami-Dade County for funding in an amount not to exceed
$1,000,000 for the Middle Beach Recreation Corridor; 2) National Endowment for the
Arts for funding in an amount not to exceed $100,000 for the City's "Mermaid" sculpture;
3) American Recovery and Reinvestment Act funding through the U.S. Department of
Commerce for the Broadband Technology Opportunity Program in an amount not to
exceed $5,000,000 for the City's Broadband Initiative; 4) Florida Inland Navigation
District for funding in an amount not to exceed $1,000,000 for the construction phase of
South Pointe Pier, and for funding in an amount not to exceed $200,000 for the City's

Supporting Data: 2009 Community Survey: 1) Nearly two-thirds of all respondents, 63.7%, suggested
there are "too few" bicycle paths/lanes throughout the City (64.6% for residents of Mid Beach and the
Islands); 2) 45.5% of residents visit the Fillmore at the Jackie Gleason Theater, where the Mermaid
sculpture is located, on average, at least once per year; 3) "Free wireless Internet" was listed as one of the
responses received when respondents were asked "What two or three changes would make Miami Beach a
better place to live, work, play or visit?"; 4) Residents surveyed reported they attend City parks and
recreational facilities an average of 3.5 times per month and 14.9% of residents and 14.6% of businesses
rated the City's maintenance of parks as fair or poor; 21.4% of residents stated that "Improving
infrastructure" was one of the areas that the City can address to improve public safety; and 5) Of the five
Public Safety Services measured, Emergency Medical Response was ranked third by residents.

ANALYSIS
1. Approval to submit an application to Miami-Dade County's Transportation
Enhancement Program, for funding in an amount not to exceed $1,000,000 for
Phase 2 of the Middle Beach Recreational Corridor Project
Miami Dade County makes funds available through the Metropolitan Planning Organization
(MPO) for transportation enhancement programs. The program has twelve eligible
categories, including provision of facilities for pedestrians and bicycles. The program funds
up to a maximum of $1,000,000 for any single project, during any single application cycle.

The Middle Beach Recreational Corridor (MBRC) Phase 2 project consists of the
construction of an on-grade pedestrian walkway encompassing eighteen city blocks. The
path will run north from approximately 46th Street to Allison Park at 64th Street, or the
southern terminus of the North Beach Recreational Corridor Project. The path will serve as a
portion of the north/south connector in the IargerAtlantic Greenway Network, which supports
the development of alternative means of transportation throughout the City.
The entire cost of Phase 2 of the MBRC project is $13.3 million, of which $570,000 is
already funded for design; the City Administration plans to submit an application forfunding
in the amount of $1,000,000. Funding for this grant, if approved will not be available until
July 2013. If additional funding is available by 2013, then the City will use the total funding
available to construct a portion of, or all of Phase 2; if no other funding is available at that
time, then this grant award will be used to build a portion of the corridor. The Administration
intends to continue applying for additional Transportation Enhancement funds, as well as
additional grants and appropriations in future years.
This program does not require matching funds. This project supports the key intended
outcome: enhance mobility throughout the City.
2. Approval to submit an application to the National Endowment for the Arts for funding
in an amount not to exceed $100,000 for the conservation of Roy Lichtenstein's
sculpture entitled "Mermaid".
The National Endowment for the Arts provides funding for public art through its Access to
Artistic Excellence Program. The program encourages and supports artistic creativity,
preserves diverse cultural heritage, and makes the arts more widely available in
communities throughout the country.
The Administration plans to submit an application in an amount not to exceed $100,000 for
the conservation of its Roy Lichtenstein's sculpture entitled "Mermaid". Roy Lichtenstein is a
leading figure in 20th Century American art and one of the founders of pop art; "Mermaid"
was Lichtenstein's first public art commission.
The sculpture will be studied and its current conditions documented prior to treatment. The
pool the sculpture sits in will be repaired, nearby hedges will be removed to improve view of
sculpture and existing flood lights will be replaced The replacement value of the sculpture is
$500,000. The sculpture is located on the lawn of the Fillmore Miami Beach at The Jackie
Gleason Theater.
The grant program requires matching funds. Matching funds in the amount of $100,000 are
available from the Art in Public Places Fund. This project supports the key intended
outcome: maintain City's infrastructure.

3. Approval to submit an application for American Recovery and Reinvestment Act
funding through the Department of Commerce for the Broadband Technology
Opportunity Program in an amount not to exceed $5 million for the City's Broadband
Initiative
The Recovery Act appropriated funding and directed the Department of Agriculture's Rural
Utilities Service and the Department of Commerce's National Telecommunications
Information Administration to expand broadband access to unserved and underserved
communities across the country, increase jobs, spur investments in technology and
infrastructure, and provide long-term economic benefits. The result is the RUS Broadband
Initiatives Program (BIP) and the NTIA Broadband Technology Opportunities Program
(BTOP). Round 1 of this funding was limited to rural areas.
Round 2 funding for this program is now available and is open to areas that are not rural.
The program will provide grants to fund broadband infrastructure, public computer centers
and sustainable broadband adoption projects.
The Administration intends to apply for funding under the Broadband Technology

requires immediate repair. The City is currently in the design phase of this project.

Last year, the City was awarded funding in the amount of $323,077 from FIND for planning,

Both projects support the key intended outcome: ensure value and timely delivery of quality
capital projects.
5. Retroactive approval to submit an application to the State of Florida Department
of Health for funding in an amount not to exceed $15 000 for equipment related to
Pre-Hospital Emergency Services
The EMS Matching grant program provides emergency medical service providers with funds
to acquire, repair improve or upgrade emergency medical services systems. Funds must be
used for the improvement and expansion of emergency medical services within the list of
eligible activities outlined by the State.
The Administration has requested funding in an amount not to exceed $15,000 for
equipment to allow Emergency Medical Services personnel to employ a more effective
method for delivering chest compressions.
The grant requires a 25% match of the total project cost. The Fire Department has funding
available in its operating budget to cover the costs of this match. This grant supports the
key intended outcome: increase community satisfaction with City government.
CONCLUSION
The Administration requests approval to authorize the City Manager or his designee to
submit the following grant applications: 1) Transportation enhancement funds from Miami-
Dade County for funding in an amount not to exceed $1,000,000 for the Middle Beach
Recreation Corridor; 2) National Endowment for the Arts for funding in an amount not to
exceed $100,000 for the City's "Mermaid" sculpture; 3) American Recovery and
Reinvestment Act funding through the U.S. Department of Commerce for the Broadband
Technology Opportunity Program in an amount not to exceed $5 million for the City's
Broadband Initiative; 4) Florida Inland Navigation District for funding in an amount not to
exceed $1,000,000 for the construction phase of South Pointe Pier, and for funding in an
