Amendment No. 10 to PSA with CH2M Hilla00/ -2y35'6 IC0-o/ AMENDMENT NO. 10 TO THE PROFESSIONAL LANDSCAPE ARCHITECTURAL AND ENGINEERING (A/E) SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND CH2M HILL., DATED MAY 16, 2001 JN AN AMOUNT NOT -TO -EXCEED $11,541.00 FOR THE PROVISION OF ADDITIONAL DESIGN SERVICES TO LOWER THE PROFILE OF THE EXISTING DRAINAGE WELL STRUCTURE LOCATED AT VARDEN STREET END FOR THE RIGHT-OF-WAY INFRASTRUCTURE IMPROVEMENTS PROGRAM NEIGHBORHOOD NO. 3 — NORMANDY SHORES PROJECT This Amendment No. 10 to the Agreement made and entered this 5ikday of 'Yy/G 2010, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existirt'g under the laws of the State of Florida, having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139 (hereinafter referred to as CITY), and CH2M HILL, having its offices at 800 Fairway Drive, Suite 350, Deerfield, Florida 33441 (hereinafter referred to as CONSULTANT). RECITALS WHEREAS, pursuant to Request for Qualifications (RFQ) No. 134-99/00, the Mayor and City Commission adopted Resolution No. 2001-24386, on May 16, 2001, approving and authorizing the Mayor and City Clerk to execute an Agreement with the Consultant, for Professional Services for the Neighborhood No. 3 — Normandy Shores Right -of -Way (ROW) Infrastructure Improvement Project (the Agreement); and WHEREAS, the Agreement was executed for a not -to -exceed amount of $620,800; and WHEREAS, the scope of the Right -of -Way Infrastructure Improvement Program Neighborhood No.3 — Normandy Shores Project (the Project) is comprised of improvements to the following area: Normandy Shores, a residential island with approximately 200 single family homes and 43 apartment buildings surrounding the Normandy Shores Golf course and Fairway Park, which is linked to Miami Beach at 71St Street; and WHEREAS, the project scope of work includes: enhanced landscaping and street lighting consistent with community preferences; repair, extension or widening of sidewalks to comply with ADA — Title III; street resurfacing/pavement markings and improvement of dead end streets with street lighting, landscaping, fencing, and/or parking, where appropriate; bicycle paths and pedestrian access ways; incorporation of traffic calming features, consistent with the community preferences; improved storm water drainage collection and disposal infrastructure; and provision of the necessary infrastructure to accommodate the burial of overhead facilities, in the event the residents consider the creation of a special assessment district to underground electric, cable, and telephone services; and WHEREAS, on May 13, 2005, Amendment No. 1 to the Agreement was executed, to include the provision of additional services necessary to prepare and attend a second pre - community design workshop, and community design workshop (CDW) for the Project, fora not -to - exceed amount of $12,811; and WHEREAS, on October 5, 2004, Amendment No. 2 to the Agreement was executed, to include the provision of additional services necessary to perform underground utility verification for the project, in an amount not -to -exceed $16,325; and WHEREAS, on March 18, 2005, Amendment No. 3 to the Agreement was executed, to include the provision of additional services necessary to install a drainage test well for the Project, for a not -to -exceed amount of $12,750; and WHEREAS, on May 18, 2005, Amendment No. 4 to the Agreement was executed, to include the provision of additional services necessary to incorporate concrete valley gutters to the Construction Documents for the Project, for a not -to -exceed amount of $ 3,500; and WHEREAS, on July 14, 2005, Amendment No. 5 to the Agreement was executed, to include the provision of additional services necessary to install an additional drainage test well for the Project, for a not -to -exceed amount of $ 500; and WHEREAS, on December 6, 2006, Amendment No. 6 to the Agreement was executed, to include the provision of additional services necessary to include the provision of resident project representation and additional construction management services, in a not -to -exceed amount of $550,000; and WHEREAS, on May 12, 2009, Amendment No. 7 to the Agreement was executed, to include the provision of additional services necessary to provide additional permitting services for expanded construction of seawalls on the street ends of Jones Street, Hagan Street and South Shore Drive, for a not -to -exceed amount of $24,607; and WHEREAS, on May 12, 2009, Amendment No. 8 to the Agreement was executed, to include the provision of additional services necessary to incorporate additional storm water on the Normandy Shore Golf course Club House, for a not -to -exceed amount of $24,376; and WHEREAS, on October 14, 2009, Resolution No. 2009-27222 to the Agreement was executed, to include the provision of additional services necessary to provide additional services for the Resident Project Representative from the Period of 12/2008 to the completion of the project, for a not -to -exceed amount of $284,000; and WHEREAS, at this time, the City, has negotiated Amendment No. 10 for the provision of lowering the profile of the existing drainage well structure located at Varden Street end ; and WHEREAS, the Consultant met with the City, and it has been established that this additional service request appears fair and reasonable; and WHEREAS, this Amendment No. 10 increases the previously contracted amount of $1,549,669 by $ 11,541; resulting in a total fee of $ 1,561,210. NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No.10. 2. MODIFICATIONS The Agreement is amended to incorporate Proposal "A", attached hereto. 3. OTHER PROVISIONS All other provisions of the Agreement, as amended, are unchanged. 4. PROPOSAL "A" CH2M HILL Proposal for Vardon Street Mo, PROPOSAL "A" CH2M HILL Proposal for Vardon Street Moi SCOPE OF SERVICES CITY OF MIAMI BEACH RIGHT-OF-WAY INFRASTRUCTURE IMPROVEMENTS PROGRAM NEIGHBORHOOD NO. 8 — NORMANDY SHORES Detailed Design Services — Vardon Street Retention Structure PROJECT DESCRIPTION During construction, the detention box located on Vardon Street was installed south of its original proposed location to avoid a watermain at the direction of the CITY. The structure was installed at its original designed elevations resulting in a steep slope to a resident's driveway. The CITY requested that CH2M HILL (CONSULTANT) prepare a proposal to modify the detention box and the surrounding grades to alleviate the steep slopes to the driveway. SCOPE OF SERVICES Task 1 — Detailed Design As part of this task, the CONSULTANT will provide the following revisions to the construction documents for the Vardon Street modifications. The scope of work is detailed in Option 2 of the attached Memorandum dated February 26, 2010. The following plan sheet revisions will be provided. Paving and Grading Plan (PGD 24): • Revised grades will be shown to accommodate the detention box adjustments. This plan will also show infrastructure to be removed/reconstructed. Stormwater Structure Detail (SW 44B to be created from SW 44): • The detention box detail will be modified to show the adjustments to the detention box to allow lowering of the finished elevation by cutting the sidewalls and reinstalling the top portion of the structure. Deliverables: 1. Revised drawings PGD 24 and SW 44B (electronic submittal) Task 2 -Resident Project Representative and Submittal Review The CH2M HILL Resident Project Representative (RPR) will be on site to observe the work and this level of effort is estimated to require forty (40) hours. The RPR will prepare daily reports during the field work. CH2M HILL will also perform submittal review and work with the Contractor to expedite this effort due to the task schedule. 1 Assumptions: 1. CITY to provide electronic version of drawings of the survey elevations along the portion of Vardon Street which will be revised. 2. The CONTRACTOR will furnish shop drawings and product submittals for the materials which will be used to seal the edges of the revised sidewalls prior to placement of the existing top cover of the structure. PAYMENT AND COMPENSATION The total fee proposed for this scope of work shall be a not -to -exceed amount of $11,541.00. This fee is based on estimated labor hours per task and other direct costs, as shown in the attached fee proposal from CH2M HILL, dated March 9, 2010. The fee is also based on the hourly rates currently in effect for the Normandy Shores project work. Also attached is a sketch of the existing conditions and the proposed change in elevations/slab thickness. Please note that the sketch is for the purpose of communicating to contractor an approach alternative to reduce the slope at the end of Vardon Street. Upon City's direction, existing elevations need to be verified and drawings prepared of the selected alternative prior to contractor commencing work. Proposed Changes Option 1 with detention box flush with road: • Remove the top slab of detention structure E -B2, sawcut the interior and exterior wall to achieve elevations as shown on the attached sketch, sawcut the weir wall to allow 10" of clearance from the bottom of the top slab, cut rebar exposed and patch by sawcutting operation to a 1" below concrete and grout patch, install Ramnek preformed sealer atop the walls, and reinstall the top slab to the elevations shown on attached sketch. • Remove and dispose of existing valley gutter from the north end to inlet structures E-07 and E-05. • Remove and dispose of existing asphalt on Vardon Street from the north end to 5' south of inlet structures E-07 and E-05. • Remove and dispose of approximately 3' (from the back of valley gutter) the driveway to 501 North Shore Drive along Vardon Street. • Install new valley gutter in the location of the removed valley gutter to the elevations shown on the attached sketches. • Re -grade limerock road base to new valley gutter elevations with consideration for the following: 2% slope to center line of road and installation of 3" total asphalt. • Prime and repave the end street with 2" type S-1 asphalt (first lift) and 1" type S-3 asphalt (second lift). • Re -grade limerock road base at driveway to 501 North Shore Drive and repave with 1" type S-3 asphalt. • Re -grade and re -sod swales as necessary to achieve smooth transition to valley gutter. • After final lift of asphalt, coat the top slab of the detention structure with 2 or 3 coats of coal tar epoxy (color black). Each coat shall be allowed full cure time prior to application of the next. Structure will need to be protected until epoxy coats are complete and epoxy has reached full cure time. Proposed Changes Option 2 with detention box below asphalt: • Remove the top slab of detention structure E -B2, sawcut the interior and exterior wall to achieve elevations as shown on the attached sketch, sawcut the weir wall to allow 10" of clearance from the bottom of the top slab, cut rebar exposed by sawcutting operation to a 1" below concrete and grout patch, install Ramnek preformed sealer atop the walls, and reinstall the top slab to the elevations shown on attached sketch. • Procure and install adjusting rings (approximately 2" to 3" tall) at the three (3) manhole covers on the top slab, to raise the covers to match the new crown of road. • Remove and dispose of existing valley gutter from the north end to inlet structures E-07 and E-05. • Remove and dispose of existing asphalt on Vardon Street from the north end to 5' south of inlet structures E-07 and E-05. • Remove and dispose of approximately 3' (from the back of valley gutter) the driveway to 501 North Shore Drive along Vardon Street. • Install new valley gutter in the location of the removed valley gutter to the elevations shown on the attached sketches. • Re -grade limerock road base to new valley gutter elevations with consideration for the following: 2% slope to center line of road and installation of 3" total asphalt. • Prime and repave the end street with 2" type 5-1 asphalt (first lift) and 1" type S-3 asphalt (second lift).
