RESOLUTION NO. 2010-27404 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING GOVERNOR CHARLIE CRIST TO VETO COMMITTEE SUBSTITUTE FOR COMMITTEE SUBSTITUTE FOR HOUSE BILL NO. 971, ENROLLED (CS/CS/HB 971); AN ACT RELATING TO HIGHWAY SAFETY AND MOTOR VEHICLES, AND WHICH WOULD AUTHORIZE A PERSON WITH A PERMANENT DRIVER'S LICENSE OR DRIVING PRIVILEGE REVOCATION FOR HAVING FOUR OR MORE DRIVING UNDER THE INFLUENCE CONVICTIONS TO PETITION THE DEPARTMENT OF HIGHWAY SAFETY AND MOTOR VEHICLES FOR REINSTATEMENT OF THEIR DRIVING PRIVILEGES AFTER FIVE YEARS; AND DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO GOVERNOR CHARLIE CRIST, AND THE CHAIR AND MEMBERS OF THE CITY OF MIAMI BEACH STATE LEGISLATIVE DELEGATION. WHEREAS, Section 322.28(2)(e), Florida Statutes, provides that a court shall permanently revoke the driver's license or driving privilege of a person who has been convicted four times for violation of Section 316.193 or former Section 316.1931 or a combination of such sections; and WHEREAS, the Florida Legislature passed House Bill 971 on April 29, 2010, which would authorize a person whose driving privileges have been permanently revoked because he or she has been convicted four or more times of violating Section 316.193 or former Section 316.1931, to petition the Department of Highway Safety and Motor Vehicles for reinstatement of his or her driving privileges upon the expiration of 5 years after the date of the last conviction or the expiration of 5 years after the termination of any incarceration under Section 316.193 or former Section 316.1931, whichever is later; and WHEREAS, Amendment 169265 to House Bill 971, which contains the applicable drivers license reinstatement language, was added to House Bill 971 without committee review or public input, and would create a new subsection to Section 322.271 which grants the Department of Highway Safety and Motor Vehicles the authority to hold a hearing upon receiving a petition for reinstatement of the driving privilege for a person whom has had their driving privilege permanently revoked for having four convictions for Driving Under the Influence; and WHEREAS, the reinstatement of a person's driving privileges, subsequent to those driving privileges being permanently revoked for being convicted four or more times of violating Section 316.193 or former Section 316.1931, will potentially increase the number of driving under the influence related offenses, accidents and fatalities upon Florida's roadways, and put public safety at risk. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA AS FOLLOWS, that the Mayor and City Commissioners hereby urge Govemor Charlie Crist to veto Committee Substitute for Committee Substitute for House Bill No. 971, enrolled (CS/CS/HB 971); an act relating to highway safety and motor vehicles, and which would authorize a person with a permanent driver's license or driving privilege revocation for having four or more Driving Under the Influence convictions to petition the Department of Highway Safety and Motor Vehicles for reinstatement of their driving privileges after five years; and directing the City Clerk to transmit a cert~ed copy of this Resolution to Governor Charlie Crist, and the Chair and Members of the ~ City of Miami Beach State Legislative Delegation.
