A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA (CITY),
APPROVING A LIST OF PRIORITY PROJECTS TO BE
PRESENTED TO MIAMI-DADE COUNTY (COUNTY) FOR
FUNDING FROM ROAD IMPACT FEE REVENUES IN THE
CURRENT YEAR AND FOR INCLUSION IN THE YEAR 2000
TRANSPORTATION IMPROVEMENT PROGRAM (TIP);
AND REQUESTING MIAMI-DADE COUNTY TO DELEGATE
AUTHORITY TO THE CITY TO IMPLEMENT ITS OWN
PROJECTS TO BE FUNDED FROM ROAD IMP ACT FEES,
UTILIZING A JOINT P ARTICIP A TION AGREEMENT (JP A)
WHEREAS, on February 17, 1999, Miami-Dade County Commissioner Bruno Barreiro
addressed the Mayor and City Commission with respect to the expenditure of road impact fees
within Miami Beach; and
WHEREAS, the City has requested of the County that roadway impact fees be applied to
roadway improvements on minor arterial or collector roads, on municipal, County, and State Roads;
and
WHEREAS, the City has requested of the County to review the definition of roadway
capacity improvements or roadway improvements, as specified in the County's Road Impact Fee
Ordinance, to clarify the use of impact fees in order to determine eligible projects; and
WHEREAS, the City has requested ofthe County to be delegated the authority to implement
its own projects utilizing a Joint Participation Agreement (JP A), as presently used with the Florida
Department of Transportation to accelerate the implementation of proposed road improvement
projects; and
WHEREAS, the City wishes to present to the County a list of proposed projects for roadway
improvements to be funded from Road Impact Fee revenues in the current year and for inclusion in
the year 2000 TIP.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve a list of priority projects, as set forth in the attached Exhibit "A", to be
presented to Miami-Dade County for funding from Road Impact Fee revenues in the current year,
and for inclusion in the year 2000 Transportation Improvement Program; and requesting Miami-
Dade County to delegate authority to the City to implement its own projects to be funded from Road
Impact Fees, utilizing a Joint Participation Agreement.

Thank you for giving the City the opportunity to participate in the County's Impact Fee Ordinance
Workshop held on Tuesday, February 23, 1999. The City was well represented at this meeting by
Commissioner Nancy Liebman and Commissioner Jose Smith, who expressed concerns and
suggestions regarding the use and effect of the County's road impact fees in the City of Miami
Beach.
The County has advised that there is a bala.-:ce of approximately 55.1 million in impact fees available
for the City of Miami Beach from prior years. The current Transportation Improvement Program
reflects $1 - 1.6 million allocated over the next five years, annually.
The City of Miami Beach Commission has expressed its desire to accelerate the road improvement
projects designated for the City of Miami Beach. To date, these funds have been designated for
County roads. Based upon Section 33E-12, of the County Road Impact Fee ordinance, the City
wishes to pursue improvements on rrjnor arterial or collector roads, on municipal, County and on
State roads, as permitted in the ordinance. To that end, the City Commission will submit a list of
priority projects for your favorable and expeditious review and approval.
Secondly, section 33E-5(q) defines roadway capacity improvements or roadway improvements. The
City of Miami Beach requests that the County and/or task force review this definition to assure that
the City has the flexibility to implement road enhancement projects that may not necessarily be
interpreted to be capacity improvements. As you know, the City's aq,.ility to enhance capacity is
limited. -

Thirdly, to achieve an expeditious implementation schedule, we would ask that the City be delegated
the authority to implement its own proposed projects, utilizing some form of a Joint Participation
Agreement (JP A), as we presently enter into with FDOT.
Additionally, the City of Miami Beach would also request that the School Impact Fee Ordinance' be
reviewed relative to the boundaries in which impact fee expenditures are made. It is our
understanding that $2 million has been collected in the City of Miami Beach to date, but these funds
have not been spent on schools within the City limits of Miami Beach.
Lastly, the City has expressed an interest and willingness to participate in any task force the County
Commission creates to review and recommend changes to the Impact Fee Ordinance. To that end,
Commissioner Diaz de la Portilla had requested information as to average trip lengths (a component
of the impact fee calculation) within the City of Miami Beach as a basis of comparison. That
information will be forthcoming and we look forward to positively contributing to this effort.
Please contact me if you require any additional information and we will await your notification of
the creation of the task force to study this fee.

BACKGROUND
On February 17, 1999, Miami-Dade County Commissioner Bruno Barreiro addressed the City
Commission with respect to the expenditure ofroad impact fees within Miami Beach. On February
23, 1999, City representatives, including Commissioners Liebman and Smith, attended an Impact
Fee Ordinance workshop held by the County.
In a letter dated March 3, 1999 to Commissioner Barreiro and County Manager Merrett Stierheim,
the City requested that roadway impact fees be applied to roadway improvements on minor arterial
or collector roads, on municipal, County and on State Roads (Attachment #1). To date, these funds
have been designated for County roads. The City asked that the County review the definition of
roadway capacity improvements or roadway improvements as specified in the Road Impact Fee
Ordinance to clarify the use of impact fees in order to determine eligible projects. Furthermore, to
accelerate the implementation of proposed road improvement projects, the City has asked to be
delegated the authority to implement its own projects utilizing a Joint Participation Agreement
(JP A), as presently used with the Florida Department of Transportation.
On March 4, 1999, the City received a preliminary list of projects identified by the County to be
included in the year 2000 Transportation Improvement Program (TIE) for road impact fees for
Miami Beach (Attachment #2).

ANAL YSIS
The County has advised that there is a balance of approximately $5.1 million in collected impact fees
available for eligible projects within the City of Miami Beach from prior years. The current five-
year TIP projects annual expenditures of $1.3 - 1.6 million for Miami Beach. The County's list of
proposed projects consists primarily of the replacement of existing traffic signals at designated
intersections. The City would prefer that Road Impact Fees be used to fund needed roadway
improvements such as intersection improvements including installation of traffic signals and
pedestrian crossing lights, roadway reconstruction, resurfacing, signage and pavement markings.
To this end, City staff has developed a list of priority projects and associated costs for presentation
to Miami-Dade County for inclusion in the year 2000 TIP and future years (Exhibit "A"). The list
of priority projects was presented to the Transportation and Parking Committee at its April 5, 1999
meeting. The Committee approved the list of projects and requested that the intersection of 16th
Street and Pennsylvania A venue be added to the list. The attached list of priority projects reflects
the Committee's request.
CONCLUSION
The Administration is now seeking the City Commission's approval of the list of priority projects
to be presented to the County for funding from Road Impact Fee revenues in the current year and
for inclusion in the year 2000 TIP. Additionally, the City is requesting Miami-Dade County to
delegate authority to the City to implement its own projects to be funded from Road Impact Fees,
utilizing a Joint Participation Agreement (JP A).
