WHEREAS, :at its March. 14, 2007 meeting, the Mayor and- City Commission-

' . ~ Board) requiring the Board to make certain right-of-way improvements associated with
. ~ the. construction of Miami Beach Senior High School; and: ~...
WHEREAS, the Board has indicated its inability to complete several of the
~- ~ specified improvements; particularly on Prairie Avenue; and ~~

WHEREAS, the. City has agreed that it can undertake and complete the
. ~ ~ unfinished work on Prairie Avenue` in an effort to get the work completed expeditiously;

In March 2007,. the City Commission approved an Interlocal Agreement with the Miami Dade County Public
Schools related to public right-of-way improvements that would be undertaken by the School in conjunction
~. with the construction of MBHS. The_Agreement~provided-for improvements both to the Dade Boulevard
"side of MBHS and to the Prairie Avenue frontage of MBHS. The Prairie Avenue improvements were the
most exten ively discussed and detailed improvements included within the lnterlocal Agreement.
A number of the items` specified in the Interlocal Agreement have .been .completed., completed in .part or
. become unnecessary-because of changed conditions. At the present time, several items still remain to be
completed; which has caused concern by residents in the area, primarily due to the adverse aesthetic
`impact the. uncompleted improvements have on the area.
e ~ In discussing -the most expeditious manner in which to complete the necessary, work on Prairie Avenue
= ' " with~the School, it has become apparent that even though the-City has no obligation to. do so, having the
City undertake and complete the work will result in the most expeditious completion. of the unfinished items
fn order to assist the neighborhood with the completion of the work on Prairie .Avenue, the. City has
assessed the work and believes that it can be undertaken through. a JOC contract primarily over thee.:

ANALYSIS
In March 2007, the City Commission approved an Interlocal Agreementwith the Miami Dade
County Public Schools related to public right-of-way improvements that would be undertaken
by the School in conjunction with the construction of Miarni Beach Senior High School. The
Agreement provided for improvements both to the Dade Boulevard side of Miami Beach
Senior High School. and to the Prairie Avenue frontage of Miami Beach Senior High School.
The Prairie Avenue improvements were the most extensively discussed and detailed
improvements included within the Interlocal Agreement.
Approval of the Interlocal Agreement was the culmination of years of discussion and
negotiation, among and between. the residents in the area, as well as the; Miami Dade
County Public School.
The Miami Beach Senior High School project is now largely completed. A number of the
items specified in the Interlocal Agreement have been completed, completed in part or
become unnecessary because of changed conditions. At the present time, several items still
remain to be completed, which has caused concern by residents in the area, primarily due to
the adverse aesthetic impact the uncompleted improvements have on the area.
In discussing the most expeditious manner in which to complete the necessary work on
Prairie Avenue with the School, it has become apparent that even though the City has no
:obligation to do.so, having the City undertake and complete the work will resu t in the most
. ~ expeditious completion of the unfinished items. At the present time, the School's contractor

- has demobilized and they are in negotiations to finalize the contract and apparently both
:claims and counter claims have been made which make pursuing additionaf work
extraordinarily difficult..
In order to assist. the neighborhood with. the completion of the work on Prairie; Avenue, the
City has assessed the work and believes that it can be undertaken through a JOC contract
~. _ : ' primarily over the summer months that.school is not in~session: -The School has agreed to
take all of the funds which were originally allocated in their construction agreement for the
. ~ uncompleted items and to transfer that amount to the City so the City may complete the
work., The funds that have been :identified by the School total $215,074.

The- sco e of work and
p the budget has been carefully reviewed by the City's Public Works
Department in order to determine if the ~ivork can be completed'by-.the City with the funds
#hat are available. The Public. Works Department has a' comfort level based on a JOC quote
obtained that the required work, can be comp eted by_the City within: the funds that are
. ~ .
available. Th`e only improvement that may-not be possible to address- is a;commitment
made by the School to unstall two (2) brick paver crosswalks on Prairie Avenue. If there are
. sufficient funds available when. the other workelements are completed, the City will proceed .
to install those paver crosswalks under the JOG contract; however, the neighborhood has
: beenadvised that it may not'be .possible of this point in~tirne:
. - ~ -
Th~e design plans and the construction time table- have been reviewed both with the
. ~ neighbborhood and the School. Both the neighborhood and. School are anxious to have the
work completed as soon as possible.. The original landscape design had to be altered by fhe .
City. in;order to provide both the spacing, the appropriate cover material andappropriate tree
size and specie so as riot to interfere .with the City's utilities that are in the swale adjacent to l
the Senior"High School on Prairie Avenue: The original landscape design completed by the ~
School was not permittable by the City and as it would have created- conflicts with the City's I
utilities.. The neighborhood 'has expressed their satisfaction- with the revised design ~
completed by the. City as well as the overall constructionapproach and timing..

In order to lessen the impact on the neighborhood; the City also proposes to;advance the
construction of the Prairie Avenue portion of the neighborhood improvement program that is
currently planned tabe in construction subsequent to the work on Prairie Avenue associated
with fhe high school. As such, the road narrowing that extends from 23~d to 28th Avenue; as
well as. milling arid. resurfacing of the roads and some necessary drainages work will: be
undertaken at the same time and through the same contract so that the neighborhood is not
required to have two (2) different construction periods within their area. The $377,000
necessary to complete this work has been placed in the CIP capital budget for the Bayshore
:Neighborhood in FY 2011. In order to proceed with this portion. of the neighborhood project
consistent.with the work transferred from the School District, it will be necessary to au#horize
the $377,000 to be used from the Storm Water Capital Projects line of credit and to
appropriate those funds as well.
Conclusion
The attached Resolution follows the form that is being pursued by the Miami Dade County
Public ,Schools to approve their end ofi this.#ransaction with~the Gity. Attached: is the memo
that.will be .presented to the School Board at their meeting on-May 12, 201.0. The Resolution
presented for City Commission approval would grant the City Manager authority to execute
the~Agreemenfitransferring the funds from the School to the City and also appropriate the
$215,074 transferred from the School District as well as the $377;000 from the; Storm Water
Capital' Projects 1ine~ of credit so that fhey may be used in .the construction of the designated
improvements. _
