Amendment 1 to PSA Agmt w/ Schwebke-Shiskinx009-~7~~1 AMENDMENT NO. 1 TO THE PROFESSIONAL ARCHITECTURE AND ENGINEERING (A/E) SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND SCHWEBKE-SHISKIN & ASSOCIATES, DATED DECEMBER 18, 2009 IN AN AMOUNT NOT-TO-EXCEED $9,900.00 FOR THE PROVISION OF ADDITIONAL TOPOGRAPHIC SURVEY OF THE SEAWALL WITHIN THE VICINITY OF THE EXISTING OUTFACES THAT ARE PROPOSED TO BE REHABILITATED FOR THE VENETIAN ISLANDS BID PACKAGE 13C RIGHT-OF-WAY NEIGHBORHOOD IMPROVEMENT PROJECT This Amendment No. 1 to the Agreement made and entered this 18th day of December 2009, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing underthe laws of the State of Florida, having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139 (hereinafter referred to as CITY), and Schwebke-Shiskin & Associates, Inc., having its offices at 3240 Corporate Way, Miramar, Florida 33025 (hereinafter referred to as CONSULTANT). RECITALS WHEREAS, pursuant to Request for Qualifications (RFQ) No. 42-08/09, the Mayor and City Commission adopted Resolution No. 2009-27161, on September 9, 2009, approving and authorizing the Mayor and City Clerk to execute an Agreement with the Consultant, for Professional Services for the Venetian Islands Bid Package 13c Right-of-Way Neighborhood Improvement Project (the Agreement); and WHEREAS, the Agreementwas executed fora not-to-exceed amount of $530,160, plus an additional amount of $55,000 for approved reimbursables; and WHEREAS, the scope of the Venetian Islands Bid Package 13c Right-of--Way Neighborhood Improvement Project (the project) is comprised of improvements to San Marino, Di Lido and Rivo Alto Islands. The scope of services provides for the re-design of the project to include additional stormwater infrastructure, additional potable water system infrastructure and additional streetscape / hardscape improvements; and WHEREAS, the project scope of work includes the following level of services: A) stormwater enhancements -The City's 1997 stormwater Master Plan did not recommend stormwater infrastructure improvements to the Venetian Islands since they are not in a priority basin. stormwater Bond funding will now be expended on the re-design plans and will include stormwater infrastructure improvements, B) Water line Replacements- The re-design will provide for a full replacement of all water mains, as well as domestic and irrigation service lines on the three islands, C) streetscape Improvements -Previous workshops held with residents in the affected areas identified a variety of item that would be desirable additions to the community streetscape. The Consultant must evaluate existing conditions of the roadways and identify areas that may need total reconstruction, re-work of the roadway base, or milling and resurfacing; and ,I , WHEREAS, at this time, the City, has negotiated Amendment No. 1 for the provision of additional topographic survey of the seawall within the vicinity of the existing outfalls that are proposed to be rehabilitated for the project; and WHEREAS, the Consultant met with the City, and it has been established that this additional service request appears fair and reasonable; and WHEREAS,. this Amendment No. 1 increases the previously contracted amount of $530,160 by $ 9,900; resulting in a total fee of $ 540,060. NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No. 1. 2. MODIFICATIONS The Agreement is amended to incorporate Proposal "A", attached hereto. 3. OTHER PROVISIONS All other provisions of the Agreement, as amended,, are unchanged. 4. RATIFICATION The City and Consultant ratify .the terms of the Agreement, as amended by this Amendment No. 1.
