A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AMENDMENT TO THE CURRENT FLORIDA
DEPARTMENT OF TRANSPORTATION (FDOT) MAINTENANCE LANDSCAPE
AGREEMENT WITH THE CITY FOR THE MAC ARTHUR CAUSEWAY, TO
REIMBURSE THE CITY IN THE AMOUNT OF $88,800 FOR THE COST OF
REPLACING LANDSCAPE PLANTS THAT WERE DAMAGED AS A RESULT OF
AUTOMOBILE ACCIDENTS, NATURAL DISASTERS AND LETHAL YELLOWING.
WHEREAS, the Florida Department Of Transportation (FOOT) has landscaped the State Road A I A
(Mac Arthur Causeway) from the East end of Watson Island to the West end of the East Channel Bridge; and
WHEREAS, on July 13, 1994, the City entered into a Memorandum of Agreement with the FOOT to
perform the landscape maintenance services on the Mac Arthur Causeway for a total of $150,000 per year, to be
paid to the City; and
WHEREAS, since the installation of this landscape project, the plant material inventory has been
reduced by natural causes such as windstorms and lethal yellowing, as well as by human related causes such as
automobile accidents, theft, and vandalism; and
WHEREAS, in an effort to restore the project to its original appearance and beauty, the City and FOOT
have worked together to develop a list of replacement materials, valued at $88,800; and
WHEREAS, the FOOT has agreed to reimburse the City $88,800, to cover the plant material
replacements; and
WHEREAS, the FOOT requires an amendment to the City's current Agreement to reimburse the City
the lump sum of $88,800. ;
NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Commission hereby authorize
the Mayor and City Clerk to execute the attached Amendment to the current Highway Landscaping Maintenance
Agreement, for the Mac Arthur Causeway with the Florida Department of Transportation (FOOT), to reimburse

automobile accidents, natural disasters and lethal yellowing.

ADMINISTRA TION RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
In 1994, the City Commission approved Memoranda of Agreement with FDOT to provide for
maintenance of landscaping along the MacArthur Causeway. The MacArthur Causeway Landscape
project significantly enhances the beauty to the southern entrance to Miami Beach, and it is to the
City's benefit that it maintains its splendor for the enjoyment of our residents and guests.
Since the installation of this landscape project, the plant material inventory has been reduced by
natural causes such as wind storms and lethal yellowing, as well as by automobile accidents, theft
and vandalism. In an effort to restore the project to its original appearance and beauty, the City of
Miami Beach and FDOT have worked together to develop the list of replacement materials valued
at $88,800, and is the subject of this Amendment.
ANAL YSIS:
In order to receive the FDOT funding in the amount of $88,800 to replace the landscape materials
on the MacArthur Causeway, the City must execute this Amendment. Authorization to receive these
funds will pem1it the replacement of damaged material in this major thoroughfare that serves as a
gateway to our community at no cost to the City.

WHEREAS, the DEPARTMENT and the CITY heretofore on the ~
day of June 1998, entered into an AGREEMENT whereby the DEPARTMENT
retained the CITY to provide turf and landscape maintenance

WHEREAS, the DEPARTMENT has determined it necessary to amend
the AGREEMENT to reimburse the CITY for the cost of' replacina
landscape plants that were damaaed as a result of automobile

both parties and noted in Attachment A and B.
NOW, THEREFORE, this AGREEMENT witnesseth the following
amendments are made;
The DEPARTMENT agrees to reimburse the CITY with a one time
lump sum payment of $88,800.00 as compensation to the CITY for
replacing the landscape plants listed below:
40 Royal Palms with a 20ft wood @ $1,250 ea
2 Medjool Date Palms with a 40ft wood @ $14,000
12 Coconut Palms with a 12ft wood @ $900 ea

EXCEPT as hereby modified, amended, or changed, all of the
