2010-27444 Reso2010-27444 RESOLUTION NO.I A .RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE AN INTER-LOCAL AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, ON BEHALF OF THE MIAMI BEACH POLICE DEPARTMENT, AND THE MIAMI- DADE COUNTY CLERK OF THE COURTS FOR THE MIAMI BEACH POLICE DEPARTMENT TO PARTICIPATE IN THE MIAMI-DADE COUNTY CLERK OF THE COURT'S TRAFFIC E-CITATION INTEGRATION SERVICES. WHEREAS, the Miami .Beach Police Department's traffic enforcement and safety initiatives result in the issuance of approximately 40,000 uniform traffic citations each year to those individuals driving within the City of Miami Beach; and WHEREAS, the Miami Beach Police Department's Records Management Section manually transmits all uniform traffic citations to the Clerk of the Courts, in and for Miami-Dade County, Florida (the "Miami-Dade County Clerk"); and WHEREAS, the Miami-Dade County Clerk is vested with the intergovernmental jurisdiction to manage the Traffic Violations Bureau, and oversees the collection and processing of all traffic court related documents, which include those uniform traffic citations issued by the Miami Beach Police Department; and WHEREAS, the Miami-Dade County Clerk has developed a credible electronic uniform traffic citation transmission process, which is utilized by several municipal police agencies in Miami-Dade County, and has the capability to transfer those citations issued by the Miami Beach Police Department to the Miami-Dade County Clerk's Traffic Information System database without undue delay; and WHEREAS, the E-Citation Integration Services would allow uniform traffic citations that are issued by the Miami Beach Police Department to gain electronic access to its issued citations, and will allow officers with the Miami Beach Police Department to amend charges, correct errors, if any, and lead to more accurate citations, greater efficiency and productivity; and WHEREAS, the Miami Beach Police Department will incur no additional expenses or costs associated with the E-Citation Integration Services process, and will serve to benefit to the City of-Miami Beach, by and through the Miami Beach Police Department, in the processing of uniform traffic citations. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby authorize the City Manager and City Clerk to execute an Inter-local Agreement between the City of Miami Beach, on behalf of the Miami Beach Police Department and the Miami-Dade County Clerk of the Courts for the Miami Beach Police Department to' participate in the Miami-Dade County Clerk of the Court's Traffic E-Citation Integration Services. Item Summarv/Recommendation: Currently, the Miami Beach Police Department as part of the traffic enforcement and safety initiatives issues on a yearly basis in excess of 40,000 Uniform Traffic Citations to drivers who traverse the City of Miami Beach. These Uniform Traffic Citations are transmitted manually by the Miami Beach Police Department's Records Management Section to the Miami-Dade Clerk of the Courts by courier on a regular basis. The Miami-Dade County Clerk of the Courts is vested with the intergovernmental jurisdiction to manage the Traffic Violations Bureau which oversees the collection and processing of aft traffic court related documents including Uniform Traffic Citations. The Miami-Dade County Clerk of the Courts, has developed a credible electronic Uniform Traffic Citation transmission process utilized by several municipal police agencies in Miami-Dade County. This process has the capability to transfer the citations electronically from the Miami Beach Police Department to Miami-Dade Clerk of the Court's Traffic Information System database. This electronic E-Citation process allows access to citations by the Miami Beach Police Department and Miami-Dade County Clerk of the Courts to amend charges, or if errors are discovered, corrections can be made, leading to more accurate citations and greater efficiency. To participate in this process the Miami Beach Police Department must enter into an inter-local agreement with the Clerk of the Court. The Miami Beach Police Department will incur no additional expenses while participating in this process and will benefit greatly by the System's speed and efficienc .
