WHEREAS, Ms. Nerida Ynclan (Owner) is the owner of a real residential property located at
770 W 50T" Street, and legally described as Lot 3 & East 15 feet of Lots 1 & 2 Block 26 Lake View
Heights Subdivision (the Property); and
WHEREAS, the City of Miami Beach, Florida (City) maintains a ten (10) foot utility easement
legally described as: the East 5.00 feet of Lots 1 and 2 together with the west 5.00 feet of Lot 3, all in
Block 26, Lake View Heights Subdivision, as recorded in Plat Book 27, at Page 5, Public Records of
Miami-Dade County, Florida, LESS the south 5.00 feet thereof; located in City of Miami Beach,
Miami-Dade County, Florida, and containing 1240 square feet more or less (City Easement); and
WHEREAS, that portion of the City Easement on, over, under and across the Property has
been physically abandoned by and is of no further use or benefit to the City, the public, and the
public utilities providing services in the City of Miami Beach, Florida; and
WHEREAS, City Resolution No. 2010-27445, enacted on July 14, 2010 (the Resolution),
authorized the execution of this Termination and Abandonment of the Utility Easement for the Lots.
NOW, THEREFORE, in consideration of the premises, and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledge, and by virtue of the
Resolution, this termination and Abandonment of Utility Easement hereby confirms that the City
Easement on, over, under and across the Property shall be and is hereby forever terminated,
vacated and abandoned by the City of Miami Beach.
