A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AMENDMENT TO THE CURRENT FLORIDA
DEPARTMENT OF TRANSPORT A TION (FDOT) MAINTENANCE LANDSCAPE
AGREEMENT WITH THE CITY FOR THE JULIA TUTTLE CAUSEWAY, TO
REIMBURSE THE CITY IN THE AMOUNT OF $57,260 FOR THE COST OF
REPLACING LANDSCAPE PLANTS THAT WERE DAMAGED AS A RESULT OF
AUTOMOBILE ACCIDENTS, NATURAL DISASTERS AND LETHAL YELLOWING.
WHEREAS, the Florida Department Of Transportation (FOOT) has landscaped the Julia Tuttle
Causeway from the East end of the Westernmost bridge to Alton Road; and
WHEREAS, in 1994, the City entered into a Memorandum of Agreement with the FOOT to perform
the landscape maintenance services on the Julia Tuttle Causeway for a total of $150,000 per year, to be paid
to the City; and
WHEREAS, since the installation of this landscape project, the plant material inventory has been
reduced by natural causes such as windstorms and lethal yellowing, as well as by human related causes such
as automobile accidents, theft, and vandalism; and
WHEREAS, in an effort to restore the project to its original appearance and beauty, the City and FOOT
have worked together to develop a list of replacement materials, valued at $57,260; and
WHEREAS, the FOOT has agreed to reimburse the City $57,260, to cover the plant material
replacements; and
WHEREAS, the FOOT requires an amendment to the City's current Agreement to reimburse the City
the lump sum of$57,260.
NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Commission hereby authorize
the Mayor and City Clerk to execute the attached Amendment to the current Highway Landscaping
Maintenance Agreement, for the Julia Tuttle Causeway with the Florida Department of Transportation (FOOT),
to reimburse the City, in the amount of$57,260, for the cost of replacing landscape plants that were damaged
as a result of automobile accidents, natural disasters and lethal yellowing.

BACKGROUND:
In 1994, the City Commission approved Memoranda of Agreement with FDOT to provide for
maintenance of landscaping along the Julia Tuttle Causeway, specifically from the east end of the
westernmost bridge to Alton Road. In accordance with this agreement, FDOT pays to the City
$150,000 annually for landscape maintenance for the areas as designated. The current agreement
for the Julia Tuttle Causeway expires on August 31, 1999.
Since the installation of this landscape project, the plant material inventory has been reduced by
natural causes such as wind storms and lethal yello\ving, as well as automobile accidents, theft and
vandalism. In an effort to restore the project to its original appearance and beauty. the City of Miami
Beach and FOOT have worked together to develop the list of replacement materials valued at
$57,260, and is the subject of the Amendment.

In order to receive the FOOT funding in the amount of $57,160 to replace the lost landscape
materials, the City must execute this Amendment. Authorization to re~ive these funds will permit
the replacement of damaged material in this major thoroughfare that serves as a gateway to our
community, at no cost to the City.

the CITY.

WHEREAS, the DEPARTMENT and the CITY heretofore on the ~
day of June 1997, entered into an AGREEMENT whereby the DEPARTMENT
retained the CITY to provide turf and landscape maintenance
services on I-195. (Julia Tuttle Causeway) ; and
WHEREAS, the DEPARTMENT has determined it necessary to amend
the AGREEMENT to reimburse the CITY for the cost of replacing
landscape plants that were damaged as a result of automobile
accidents. natural disasters and lethal yellowing as agreed to by
both parties and noted in Attachment A and B.
NOW, THEREFORE, this AGREEMENT witnesseth the following
amendments are made;
The DEPARTMENT agrees to reimburse the CITY with a one time
lump sum payment of $57,260.00 in the DEPARTMENT I s fiscal year
1999/2000 as compensation to the CITY for replacing the landscape
plants listed below:
55 Coconut Palms with an 8-10ft wood @ $800 ea
200 Silver Buttonwood Hedges in 3 gal containers @ $9 ea
240 Oleanders in 3 gal containers @ $9 ea
400 Fachahachee Grass in 3 gal containers @ $12 ea

This letter will confirm our convenation regarding the City's request that the Department provide
funding for the replacement oflandscaping within the City. .
The Department has evaluated the request and is offering the following:
1. For the replacement of landscaping on the MacArthur Causeway due to the loss of vegetation
as a result of accidents, storms and lethaJ yellowing. The Department is talcing steps to amend the
