A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING A CHANGE ORDER TO THE CONSTRUCTION
SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND M. VILA &
ASSOCIATES, INC. (MVA), DATED. JUNE 3, 2009, FOR THE CONSTRUCTION OF
THE HISTORIC CITY OF MIAMI BEACH RIGHT OF WAY INFRASTRUCTURE
IMPROVEMENTS PROJECT, NEIGHBORHOOD NO. 9A, CITY CENTER, IN THE
NEGOTIATED NOT TO EXCEED AMOUNT OF $874,193.54 TO PROVIDE FOR
CONSTRUCTION SERVICES FOR RIGHT OF WAY AND INFRASTRUCTURE
IMPROVEMENTS SURROUNDING THE NEW WORLD SYMPHONY BUILDING
(NWS), PENNSYLVANIAAVENUE GARAGE, AND LINCOLN PARK PROJECTS; AND
FURTHER AUTHORIZING THAT $87,419.35 TO BE ADDED TO THE EXISTING
CONTINGENCY; WITH TOTAL FUNDING AVAILABLE FROM THE PREVIOUSLY
APPROPRIATED FUNDS IN THE CITY CENTER BID PACKAGE 9B RDA
CONSTRUCTION FUND 365.
WHEREAS, on April 22, 2009, the City Commission approved the award of a construction
contract to M. Vila & Associates, Inc.(MVA) in the amount of $7,589,825.00, for the construction of
the Infrastructure Improvement Project /City Center Historic District Bid Package 9A; and
WHEREAS, an amount of $758,983.00 was also made available for the Project contingency
fund; and
WHEREAS, the Project limits underway for City Center Bid Package 9A include the area
bounded to the north by Dade Boulevard, to the south by Lincoln Road, to the west by Washington
Avenue, and to the east by Collins Avenue; and
WHEREAS, the New World Symphony project consists of the Pennsylvania Avenue Garage,
New World Symphony building, and Lincoln Park; and
WHEREAS, the New World Symphony building is scheduled to be opened priorto the end of
the calendar year and the City is responsible for completing the adjacent streetscape, right of way
improvements, and drainage work; and
WHEREAS, in order to prosecute and complete the aforestated work in time for the opening
of the New World Symphony building, the Administration hereby recommends issuing a change
order to the existing construction contract with MVA, in the negotiated not to exceed amount of
$874,193.54; and
WHEREAS, funding, in the amount of $961,612.89 (which includes an additional amount of
$87,419.35 to be added to the existing project contingency), is available from previously
appropriated funds in the City Center Bid Package 9B Project.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission thereby approve
a Change Order to the existing Construction Services Agreement between the City and M. Vila &
Associates, Inc., for the construction of the City Center Historic District PB-9A Project Infrastructure
Improvements, to provide construction services for right of way and infrastructure improvements
surrounding the New World Symphony Building, Pennsylvania Avenue Garage, and Lincoln Park
projects, in a negotiated not to exceed amount of $874,193.54; and further authorize $87,419.35 to
be added to the existing project as a construction contingency; with total funding available from
previously appropriated funds from the adjacent City Center Bid Package 9B Project.

Item Summa /Recommendation:
As part of the City's objective to open the New World Symphony, Pennsylvania Avenue garage and Lincoln Park
projects, prior to the end of the calendar year, all adjacent infrastructure, streetscape and right of way
improvements need to be completed. The specific items that must be added are as follows: beautification and
enhancements along Pennsylvania Avenue, from 17th Street to Lincoln Lane North; Lincoln Lane North
reconstruction, between Pennsylvania and Washington Avenues; and 17th Street improvements, from
Pennsylvania Avenue to Washington Avenue. On August 4th, 2010, the CIP Office reached out to a Job Order
Contractor to price the additional requested work. After the initial meeting, the contractor raised concerns about
their ability to submit a timely estimate based upon the plans issued to them, as well as the possible impact of
discovering unforeseen conditions within a utility intensive street such as Lincoln Lane North. Given these
conditions, and since time was of the essence to complete the right of way work under the New World
Symphony project schedule, a decision to seek another alternative was pursued. As a result, the CIP Office
requested MVA to provide a proposal for the required work. MVA is the contractor for the adjacent BP-9A
Project, currently at approximately 50% completion. MVA had also been subcontracted by the Lincoln Park
contractor, Valley Crest Landscape Development, to construct the Park's underground- drainage and utilities.
At the BP-9A Project, M. Vila has demonstrated an excellent ability to resolve conflicts with complex
underground utility work such as what has been recently uncovered at Lincoln Lane North. M. Vila has also
secured a Class V dewatering permit, and has an excellent Public Information Officer on staff to ensure prompt
and proper communication with the Lincoln Road businesses,. particularly the restaurants. In order to expedite
completion of the work, it is recommended that the required improvements be added to the MVA contract for the
City Center BP-9A project. The negotiated prices submitted by MVA for the above scope of work have been
reviewed by the groiect team and found to be fair and reasonable.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
FUNDING
Project funding in the amount of $874,193:54 is available from the previously appropriated
funds for construction in the City Center Bid Package 9B (BP-9B), of which the work is a
component allocated in Account No. 365-2327-069357. Funding in the amount of
$87,419.35 is also available from the previously appropriated funds for contingency in the
City Center Bid Package 9B (BP-9B) in Account No. 365-2327-000356.
ANALYSIS
On April 22, 2009, the City Commission approved the award of a construction contract to M.
Vila & Associates, Inc. (MVA) in the amount of $7,589,825.00 for the construction of the
Infrastructure Improvement Project City Center Historic District Bid Package 9A (BP-9A).
Project contingency in the amount of $758,983.00 was also made available for the Project
contingency fund.

The scope of the Project in BP-9A is limited to the City right-of--way along Washington
Avenue and east of Washington Avenue in the City Center Historical District. The scope of
improvements includes storm water collection and disposal systems, water distribution
system, roadway milling and resurfacing, streetscape enhancements, landscaping, irrigation,
traffic calming installations such as bump-outs and pedestrian crosswalks, traffic signage,
pavement markings, additional pedestrian lighting, and enhanced pedestrian linkages.
Construction of the project is currently underway and is approximately 50% complete.
The Project limits for the BP-9A Project include the area bounded to the north by Dade
Boulevard, to the south by Lincoln Road, to the west by Washington Avenue and to the east
by Collins Avenue.
The New World Symphony campus. consists of the Pennsylvania Avenue Garage, New
World Symphony building and Lincoln Park. These facilities are intended to be opened prior
to end of the calendar year and the City is responsible for completing the streetscape, right
of way improvements, and drainage work adjacent to the New World Symphony campus.
The scope of the improvements adjacent to the New World Symphony campus is included in
the City Center Commercial District Bid Package 9B project.

Road businesses, particularly the restaurants.
The scope of work to be added to the BP-9A contract includes the rights of way surrounding
the Pennsylvania Avenue Garage, New World Symphony Building, and the Lincoln Park
projects. This includes Pennsylvania Avenue from 17th Street to Lincoln Lane North, Lincoln
North from Pennsylvania Avenue to Washington Avenue and along 17th Street from
Washington Avenue to Pennsylvania Avenue. The specific items that must be added areas
follows:
Beautification and Enhancement along Pennsvlvania Avenue from 17t" Street to
Lincoln Lane North
This scope of work includes the construction and installation of hardscape to the west of
Pennsylvania Avenue between 17th Street and Lincoln Lane North in order to complement
the east side of Pennsylvania Avenue. Work consists of demolition of existing curbs,
sidewalk and asphalt roadway, new Type "D" curb along the west side, adjustment of

existing storm water inlets, new ADA accessible ramps, pavement markings, landscaping
and irrigation on the west side of Pennsylvania Avenue to match the east side. Lighting
improvements along the west side of Pennsylvania Avenue also include six (6) landscaping
uplights, six (6) Poulsen pedestrian light poles and relocation of a Cobra luminaire.
The work also includes the installation of new brick pavers set over an 8" reinforced concrete
slab in lieu of asphalt paving along Pennsylvania Avenue, sealing of the pavers and
installation of paver crosswalks at the intersection of 17t" Street and Lincoln Lane North.
The vehicular ingress / egress to the 17t"Street Garage will also be improved with this work.
The total cost of this scope of work is $287,619.93.
Lincoln Lane North Reconstruction between Pennsylvania and Washington Avenues
This scope of work includes the construction and installation of hardscape, drainage
collection and conveyance, and asphalt paving of Lincoln Lane North from Pennsylvania
Avenue to Washington Avenue. The work also includes two (2) new paver intersections at
the intersections of Lincoln Lane North and Drexel Avenue and at Washington Avenue,
electrical improvements to add eight (8) Poulsen pedestrian light fixtures and five (5) Cobra
luminaries. In addition, the scope includes the installation of two empty (2") conduits from
the Pennsylvania Avenue Garage to the 17t" Street Garage to interconnect parking
operations as requested by the Parking Department. Hardscape. improvements along
Drexel Avenue from Lincoln Lane North to Lincoln Road are also included, as well as
irrigation along the Lincoln Lane pedestrian areas. Pedestrian areas will be landscaped
with sixteen (16) new Sabal Palms, turf grass and eight (8) Pink Tabebuia ,trees will be
relocated. The total cost of this scope of work is $440,570.48.
17th Street Improvements from Pennsylvania Avenue to Washington Avenue
On January 14t", 2009, the City requested that MVA submit a cost proposal for the
installation of approximately 735 linear feet of 8" water main and 33 LF of 6" water main
and 1 Fire Hydrant assembly. This work was required to be installed and placed into
service to support the New World Symphony Campus construction activities. The work
included roadway restoration associated with the water main construction, maintenance of
traffic, construction survey and as-built drawings.
On June 25t", 2010, the City requested that MVA remove an existing traffic signal mast
arm located at the southwest corner of the 17t" Street & Washington Avenue intersection
and deliver same to the Miami Dade County Public Works Department. This work was
done at the request of the NWS as it was interfering with their concrete plaza
construction and was required as part of the new crosswalk design. Removal of all
foundations was also included in the scope.
In addition to the work already completed along 17t" Street, the scope of this request will
include the construction of hardscape and drainage improvements along 17t" Street from
Washington Avenue to Drexel Avenue. The work will only be performed along the south
side of 17t" Street. Pedestrian signalization at the Drexel Avenue crosswalk will also be
included..The total cost of this scope of work is $146,003.13.
The negotiated prices submitted by MVA for the above scope of work have been reviewed
by the project team and found to be fair and reasonable.

Contingency
A construction contingency of 10% has been allocated for unforeseen conditions which
may arise during construction: The total contingency cost is $87,419.35.
A summary of the additional funding request is as follows:
Pennsylvania Avenue improvements: $287,619.93
Lincoln Lane North improvements: $440,570:48
17th Street improvement: $146,003.13
Contingency: $ 87,419.35
Additional project funding requested: $961,612.89.
CONCLUSION:
The. Administration recommends that the Mayor and City Commission authorize the City to
execute an Amendment to the existing construction services agreement between the City of
Miami Beach and M. Vila & Associates, Inc., for the construction of the City Center Historic
District PB-9A Project infrastructure improvements, to provide construction services for right
of way. and infrastructure improvements surrounding the New World Symphony Campus,
Pennsylvania Avenue Garage, and Lincoln Park projects, in a negotiated not to exceed
amount of $874,193.54; and further authorizing $87,419.35, as a project construction
contingency; with funding available from previously appropriated funds from the adjacent
City Center 6 9B Project..
