2010-27485 ResoRESOLUTION NO.' 2010-27485 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER, PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO.34-09110, TO AWARD A CONCESSION AGREEMENT FOR THE MANAGEMENT AND OPERATION OF A CONCESSION FACILITY WITHIN THE STRUCTURE .COMMONLY REFERRED TO AS THE "PAVILION BUILDING," LOCATED IN SOUTH POINTE PARK; AND AUTHORIZING THE ADMINISTRATION, TO ENTER INTO NEGOTIATIONS WITH THE RESPONSIVE .PROPOSER, BLISSBERRY, LLC.; AND FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT, UPON CONCLUSION OF SUCCESSFUL NEGOTIATIONS. WHEREAS, on May 12, 2010, the Mayor and City Commission approved the issuance of Request for Proposals (RFP} No. 34-09/10, for the management and operation of a concession facility commonly referred to as the "Pavilion Building," located in South Pointe Park (the "RFP"); and WHEREAS, on June 22, 2010, the RFP was issued with: an opening date of August 11, 2010; and WHEREAS, notices were sent to over 200 prospective prosposers resulting in the receipt of two (2) proposals from Blissberry, LLC, and Paradigm Hospitality, LLC; and WHEREAS, during the review process performed by the Procurement Division, Paradigm Hospitality was- deemed non-responsive as it did not meet the minimum requirement for failing to include prices for the proposed food and beverage items; and WHEREAS, the City Manager, via Letter to Commission (LTC) No. 221-2010, ("The Committee") appointed the following individuals to the RFP Evaluation Committee: • Aaron. Swimmer, Miami Beach Resident, Leadership Academy;. • Clotilde Luce, Miami Beach Resident, Leadership Academy; • Gary Farmer, Cultural Affairs Program Manager, Cultural Arts; • John Oldenburg, Assistant Director, Parks and Recreation; • Jim Nourse, Food and Beverage Manager, Miami Beach Golf Course; • Manny Marquez Jr., Revenue Manager, Finance; and WHEREAS, on August 26, 2010, the Committee convened to listen to the presentation and taste samples from the proposed menu by the responsive proposer, Blissberry, LLC ("Blissberry"), and a quorum was attained; and WHEREAS, a motion was made by committee member John Oldenburg, and seconded by committee member Aaron Swimmer, and unanimously approved by the Committee, to recommend that the Administration enter into contract negotiations with Blissberry; and WHEREAS, the City Manager has reviewed and concurs with the Evaluation Committee's recommendation. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,, that the Mayor and City Commission hereby accept the recommendation of the City Manager, pursuant to Request for Proposals (RFP) No. 34-09/10, for the Management and Operation of ~ a Concession Facility within the structure commonly referred to as the "Pavilion Building," located in South Pointe Park; and authorize the Administration to enter into. negotiations with the Blissberry, LLC.; and further authorize the Mayor and' City Clerk to execute an agreement upon conclusion of successful negotiations. It is the City's intent to enter into a concession agreement, by means of this RFP process, to grant to the successful proposer the right during the term of the concession agreement to manage and operate the concession facility within the structure commonly referred to as the "Pavilion Building", located in South Pointe Park. The .Pavilion Building includes City field offices, as well as a Community Room which will be available to the public to rent, but will not be part of the concession agreement. The term of this Agreement will be for a period- of two (2}years with the sole option and discretion of the City, to renew for an additional three (3), one (1) year periods. On June 22, 2010, the RFP was issued with an opening date of July 22, 2010 and notices were sent to prospective proposers resulting in the receipt of two (2) proposals from Blissberry, LLC; and Paradigm Hospitality LLC. Paradigm did not provide pricing for their menu items, which was a minimum requirement for consideration. Therefore, they were deemed non-responsive. The City Manager, via a Letter to Commission (LTC) No. 221-2010, appointed the Committee which convened on August 26, 2010 to listen to the presentation and conduct a questions and answers session with the responsive proposer. After discussing their individual perceptions of the proposer's qualifications, experience, and competence, the Committee members unanimously approved a motion, to recommend to the Commission that the Administration enter into contract negotiations with Blissberry. KEY INTENDED OUTCOMES SUPPORTED Increase Community Satisfaction with City Government BACKGROUND At the conclusion of an approved Request for Proposals (RFP) process, on July 15, 2009, the Mayor and City Commission accepted the City Manager's recommendation, authorizing the Administration to enter into negotiations with the top-ranked firm of SB Cafe, LLC, D/B/A Touch Catering Services, Inc. for the management and operation of a concession facility commonly referred to as the "Pavilion Building," located in South Pointe Park. The City Administration began its negotiations with SB Cafe, Inc. in late July, 2009. After several months of negotiation SB Cafe terminated negotiation of the concession agreement in December, 2009. Upon failure to mutually agree to the terms, negotiations were deemed as unsuccessful In light of the level of use and popularity of the park, and to enhance the park's amenities for users, it was recommended that a new competitive process be initiated to identify a concessionaire's for this location. On May 12, 2010, the Mayor and City Commission approved the issuance of Request for Proposals (RFP) No. 34-09/10, for the management and operation of a concession facility commonly referred to as the "Pavilion Building," located in South Pointe Park (the "RFP"). September 15, 2010 SCOPE OF SERVICES It is the City's intent to enter into a concession agreement, by means of this RFP process, to grant to the successful proposer the right during the term of the concession agreement to manage and operate the concession facility within the structure commonly referred to as the "Pavilion Building", located in South Pointe Park. .The Pavilion Building includes City field offices, as well as a Community Room which will be available to the public to rent, but will not be part of the concession agreement. Any agreement entered into by the City will be for an initial term of two (2) years, with an'option to renew for three (3) additional one (1) year terms, with said renewal terms being at the City's sole option and discretion. The successful proposer will be authorized to conduct the following kinds of business(es) within the concession area, as provided herein, all at it's sole cost and expense: PERMITTED USE(S): Operate and manage the concession area, which shall sell and/or provide the following: a) Non-alcoholic beverages. b) Pre-packaged and/or prepared foods with limited heating requirements will be negotiated based on the proposed menu. By way of example, the City has allowed the following in other concession agreements: the use of steamers, warmers, microwaves, sandwich press and coffee maker. ~ MENUS: Proposer shall develop menus for the sale of food and non-alcoholic beverages. Proposer is advised that the City has an existing "Concession Agreement for Operation of Vending Machines", dated October 19, 2005, which entitles the vendor to the placement of up to six (6) vending machines within South Pointe Park. Therefore, proposer shall at all times price products of similar type and/or volume in a manner equal or greater to the pricing of the vending machine items. At no time shall proposer's items be sold at a lower price than similar items sold in the i ending machines. SCHEDULE OF OPERATION: The successful proposer's operation shall be open in accordance with an agreed upon schedule. The City and successful proposer will negotiate the days of operation as well as the starting and closing hours of operation.. Any changes to the agreed upon days or hours of operation will require the prior written consent of the City Manager. CONCESSION FEES: 1 Performance Bond or Alternate Security: The successful proposer shall furnish the City with a security deposit, as agreed to by the City. Said security shall serve to secure the successful proposer's performance in accordance with the provisions of the concession agreement. Minimum Guarantee (MG): In consideration of the City executing a concession agreement and granting the rights provided in the agreement, the successful proposer shall guarantee and pay to the City an annual minimum concession fee. Percentage of Gross (PG): During the initial term and any approved renewal term, the successful proposer shall pay the City a percentage of its gross receipts. During any term of the concession agreement, if the amount of the annual PG is greater than the annual MG, then the successful proposer shall pay to the City the difference between the PG amount and the MG amount. In the event that the City chooses Ito extend the term of the concession agreement for any renewal term(s), the renewal term(s) MG shall be increased in a manner to be negotiated between the City and successful proposer. RFP PROCESS On June 22, 2010, the RFP was issued with an opening date of August 11, 2010. A Pre proposal meeting to provide information to prospective proposers was held on July 27, 2010.1 Anon- mandatory site visit was held on July 28, 2010; BidNet sent notices to 14 prospective proposers; BidSync sent notices to prospective proposers of which 13 viewed the RFP. Additionally, postcard mailings were sent to all restaurant businesses operating at the City. The following two (2) proposals were received by the RFP deadline for receipt of proposals: • Blissberry, LLC. • Paradigm Hospitality, LLC. The City Manager, via Letter to Commission (LTC) No. 221-2010, appointed an Evaluation Committee ("The Committee") consisting of the following individuals: • Aaron Swimmer, Miami Beach Resident, Leadership Academy • Clotilde Luce, Miami Beach Resident, Leadership Academy • Gary Farmer, Cultural Affairs Program Manager, Cultural Arts • John Oldenburg, Assistant Director, Parks and Recreation • Jim Nourse, Food and Beverage Manager, Miami Beach Golf Course • Manny Marquez Jr., Revenue Manager, Finance During the review process for responsiveness performed by the Procurement Division, Paradigm Hospitality was deemed non-responsive as they did not meet the minimum requirement for failing to include prices for the proposed food and beverage items. The Minimum Requirements required proposers to provide a menu of all proposed food and beverage items, including prices for same, to be offered for sale. Proposers were to provide evidence of operating a comparable concession operation of similar size or other food and beverage business. EVALUATION PROCESS On August 26, 2010, the Committee convened to listen to the presentation by the resj proposer, Blissberry, LLC ("Blissberry") and conduct questions and answers session. September 15, 2010 unanimously agreed to nominate Gary Farmer as Committee Chair. Manny Marquez was iot able to participate as he had to attend another meeting. I The Committee discussed the proposal, taking into consideration the benefits and- challenges presented by the location of the Concession Area. The Committee also discussed the apparent marketing knowledge and success despite the current economic market of the vendor. Blissberry, which has been operating in South Beach since 2008, included an operational plan that addressed marketing goals, customer service, and their priced menu for the operation of the concession; their proposed Minimum Guarantee (MG) is $9,000 annually, and a Percentag i of Gross (PG) of 15% of its concession/food and beverage sales, whichever is greater. See attached proposal. Ms. Pham began her career as a production manager then shifted her attention towards the business and sales environment. She is actively co- managing all areas of Blissberry and assists Blissberry's clients with their varying needs. Ms. Namiko Rodrigues has over ten years of restaurant and hospitality experience. Additionally, has several years of experience in food management and preparation in accordance with USDA Department of Health guidelines. Ms. Namiko Rodrigues has managed sales analysis forecasting and reporting activities to include menu design and event planning. Ms. Rodrigues js experienced in facilities safety management in restaurant environments. She is fluent in English, French and extensive knowledge of Spanish. Also, involved ,with the operations is Mr. R a n d a l l E. T r u e s d a l e S r. has a wealth of experience in -event management;` business development; hospitality; and restaurant r consultancy. Mr. Truesdale's restaurant experience includes Blissberry Yogurt Bar in South Beach. Since 2008, he has facilitated computer and web environment administration. He manages budget and purchasing controls through implementation of inventory control system, -and assisted with the development of the Blissberry employee training and handbook. 5 Mr. Truesdale was the Co-Owner 8~ General Manager, Richard's Grill, located in St John, U.S. Virgin Islands. Mr. Truesdale successfully managed an upscale family ~ style restaurant, increased sales by 40% through quality food, exceptional service, and family value. 6 Maximum Guarantee & Percenntage of Gross Sales Minimum Guarantee: We propose to pay the City a Minimum Guaranteed Annual -Concession Fee of $9,000. Percentage of Gross: We propose to pay the City 15% of our gross receipts. We will partner with other accounts in the area to drive business into the Community Room as well as mine the local and regional market for meeting and social event opportunities. And, we will deliver results because we know that serving food is actually the end of a process that begins with an assessment of opportunities and customer preferences. To begin; we look at the overall features and the benefits of the South Pointe Park (the "Park"), study the primary market segments, understand the neighborhood's. needs and desires, and understand the City's goats and objectives. We will. provide exquisite meals accompanied by impeccable service. We believe our success in helping sell the- Pavilion for an event will be the result of our analysis and business plan development and will be supported through our participation in and coordination with the City's Parks and Recreation Department. Our staff will work closely with the "South of Fifth" homeowners to ensure that all noise ordinances are adhered to, and that the residents' needs and wants are addressed. Marketing Plan We believe strongly that our ability to provide marketing expertise is critical in our continued success at the Pavilion. Our commitment to marketing directly benefits the City by creating a web of connections through our customers and other clients. As well as impacting the overall customer experience by enhancing the meeting and event planning process, providing hands on contact to all our customers. and enabling us to more fully understand and therefore appreciate and better serve the residents and visitors. We project that even in the first year -sales will be be greater than the initial current location. There is more foot traffic, and with an expanded menu, more employees, and extensive marketing plan . Sales should exceed current location. We have contracted with The Beach Channel commercials which reached 116,000 households. 20,000 hotel rooms and 11 million annual viewers. x Commitment to Customer Excellence We are driven by our desire to continually improve customer satisfaction. Satisfied customers translate into a greater appreciation of the Park and the City's efforts for excellence customer service. The success of our marketing strategy is dependant on the close working relationship between the.`City of Miami Beach, especially, the Parks and Recreation Department. Understanding the Customer To create a positive and memorable experience for the customer at every venue is the focus of Blissberry. We valve, our customers and residents, and we understand that they are the reason for the success or failure of the Pavilion. Food Sanitation and Safety Before the selection of any recipe, .before the purchase of one ingredient, and before any meal is served, we will take every precaution to ensure that our safety and sanitation procedures are in compliance with or exceed federal, state, and local health codes. Excellence sanitation and. food safety practices are essential for operating a successful food and beverage program. .Our food safety requirements for our employees are stringent. We require constant employee training on sanitation practices, procedures, and policies. We demand each employee to clean as they go to reduce the risk of food contamination. Employees are monitored to ensure that hand washing is constant and that gloves are frequently changed to prevent ,any contaminations. ._ Most importantly, we will ensure that the safety and integrity of the food is protected from the time of its delivery, and throughout its storage and preparation and transportation from our kitchen into the hands of the customer. Now, we focus on -the creation of a great meal. Selecting the freshest ingredients is the first step to preparing delicious meals.
