2010-27528 Reso RESOLUTION NO. 2010 -27528 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER, AND THE CITY CLERK TO EXECUTE A VOLUNTARY COOPERATION AND OPERATIONAL ASSISTANCE MUTUAL AID AGREEMENT WITH THE TOWN OF GOLDEN BEACH, FLORIDA, FOR THE PURPOSE OF COORDINATING LAW ENFORCEMENT PLANNING, OPERATIONS, AND MUTUAL AID BENEFIT BETWEEN THE CITY OF MIAMI BEACH AND THE TOWN OF GOLDEN BEACH, FLORIDA. WHEREAS, it is the responsibility of the respective governments of the City of Miami Beach and the Town of Golden Beach, Florida to ensure the public safety of their citizens by providing adequate levels of police service to address any foreseeable routine or emergency situation; and WHEREAS, the existence of, and continuing possibility that there may be the occurrence of law enforcement problems, and other natural and man -made conditions which are, or are likely to be, beyond the control of services, personnel, equipment, or facilities of the City of Miami Beach Police Department and the Town of Golden Beach Police Department; and WHEREAS, it is necessary to ensure that these law enforcement agencies will have adequate resources to address any and all of these conditions, to protect the public peace and safety, and to preserve the lives and property of the people of the City of Miami Beach and the Town of Golden Beach, Florida; and WHEREAS, the City of Miami Beach and the Town of Golden Beach, Florida have the authority under Chapter 23 of the Florida Statutes, known as the "Florida Mutual Aid Act," to enter into the attached Voluntary Cooperation and Operational Assistance Mutual Aid Agreement. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby authorize the City Manager and the City Clerk to execute a Voluntary Cooperation and Operational Assistance Mutual Aid Agreement with the Town of Golden Beach, Florida, for the purpose of coordinating law enforcement planning, operations, and mutual aid benefit between the City of Miami Beach and the Town of Golden Beach, Florida. Supporting Data (Surveys, Environmental Scan, etc.): According to the Center For Research and Public Policy, and Business Residential Satisfaction Survey of City of Miami Beach residents in 2009, ' ; indicated that their three top most important areas of for the City of Miami Beach to address in an effort to improve public safety throughout the City is Preventing Crime 44.9 %, Enforcing Traffic Laws 36.1% and Increasing Visibility of Police in Neighborhoods 32.4 %. Issue: Shall the Commission adopt this Resolution? Item Summary /Recommendation: The City of Miami Beach and the Town of Golden Beach, Florida because of the existing and continuing possibility of the occurrence of law enforcement problems and other natural and man - made conditions which are or are likely to be beyond the control, personnel, equipment or facilities of thel Miami Beach Police Department or the Town of Golden Beach Police Departments believe that it is beneficial for each to participate in a Mutual Aid Agreement as authorized by Chapter 23, Florida States. The Mutual Aid Agreement will allow for the sharing of law enforcement resources and the rendering of assistance both during routine and intensive law enforcement situations. It is recommended that the Mayor and City Commission adopt this Resolution and authorize the signing of the Mutual Aid Agreement that will allow for the sharing of law enforcement resources.
