A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING
THE THIRD AMENDMENT TO THE POLICE
CONFISCATION TRUST FUND FOR FISCAL YEAR
1996/97, IN THE AMOUNT OF $113,668, TO BE
FUNDED FROM THE PROCEEDS OF CONFISCATED FUNDS
($112,000 FROM STATE FUNDS AND $1,668 FROM
FEDERAL FUNDS).
WHEREAS, Section 932.705, Florida Statutes, addresses the
purposes and procedures to be utilized for the appropriation and
expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach has
determined that the need for expenditures and appropriation
exists and the expenditure or appropriation of forfeiture fundB
is in compliance with Section 932.705, Florida Statutes, and w:_t 1
Federal guidelines; and
WHEREAS, such funds are available in the Police Confiscat:_ol
Trust Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor
and City Commission hereby adopt the Third Amendment to the 96/91
Police Confiscation Trust Fund Budget for the City of Miami
Beach, in the amount of $113,668, as reflected in the attached
Exhibit "A".

POLICE CONFISCATION TRUST FUND
THIRD BUDGET AMENDMENT
FISCAL YEAR 96/97
STATE FUNDS:
CONSTRUCTION OF A "RETIREE WALL" WITHIN
THE POLICE STATION BUILDING. The wall will
honor those officers who have served and retired from
the Police Department. This contribution will match
funds already collected by the Police Retirees Association.
CONTRIBUTIONS TO THE LAW ENFORCEMENT
GAY/LESBIAN CONFERENCE - The Fourth International
Conference of Gay and Lesbian Criminal Justice
Professionals will be held in Miami Beach -
September 10 - 14, 1997. The Conference is expected to
bring between 400-500 criminal justice professionals from
all over the world to Miami Beach. The Police Department
wishes to support this Conference by providing seed funding
in the amount of $10,000 for use by the sponsoring entity,
Florida L.E.G.A.L. to provide training seminars and other
conference related events..
TO REFURBISH THE POLICE GYM: To replace
equipment that is 10 years old and defective
(See Attachment # 1 for additional justification)

REPLACEMENT OF GYM EQUIPMENT
When we moved into this building some 10 years ago, all of the equipment in the gym
was purchased with funds from the Police Confiscations Account. Over the years, whell
we have replaced or added new equipment, it was with funds from the Police
Confiscations Account or it was donated to the City at no cost to the taxpayers.
The gym is used by employees of the Police Department as well as employees from
other city departments such as the Fire Department and the City Manager's Office.
We intend to replace approximately $40,000 worth of existing gym equipment. In
addition, we intend to purchase rubber shower mats. The gym equipment we intend ':0
replace is out of date and/or defective. It is just not cost effective to repair this
equipment due to its age and the cost of the repairs. The rubber shower mats will assist
in preventing slipping due to the surface of the shower floor.
High incidences of Heart Disease and High Blood Pressure have been directly
associated with law enforcement. Under State law, should a police officer contract a
heart or blood pressure condition, it is presumed that it is job related and therefore all
Injury Service Connected (ISC) issue.
The City Safety Officer, Mr. Ron Caplan fully supports this and has emphasized the
need to our personnel to fully utilize the gym facilities to aid in preventing heart and ~ !ig 1
blood pressure conditions. He advises us that the full use of our gym would aid in
decreasing IS claims. Moreover, one of the primary treatments used for persons with
these afflictions is a regimen of physical exercise.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
BACKGROUND
Expenditure of forfeiture funds for law enforcement purposes unde~
federal guidelines is a proper expenditure for Law Enforceml~n:
Facilities and Equipment; Law Enforcement Training; As:::e:
Accounting and Tracking; and contribution to an Organization ~la:
benefits the youth of Miami Beach.
Florida statute 932.705 provides for, but is not limited ":0,
expenditure of forfeiture funds for crime prevention and other lav
enforcement purposes.
The Chief of Police of the City of Miami Beach has reviewed ani
identified the need for the expenditures and appropriation 0:
forfeiture funds in compliance with Section 932.705, Florida Stiit~
statutes and federal guidelines.
ANALYSIS
The Administration requests authorization to adopt the Thir 1
Amendment to the operating budget for the FY 96/97 Pol:iLc~
Confiscation Trust Fund in the amount of $113,668 from state and
Federal funds to be used to provide funds for the expenditure::
listed in Exhibit "A".

In accordance with Florida state statute 932.705 and fedE!r.ll

I, Richard Barreto, Chief of Police, City of Miami Beach, do
hereby certify that the aforementioned proposed request for
expenditures from the City of Miami Beach Police Confiscation
Trust Fund, for the 1996/97 fiscal year providing funds for
