RESOLUTION NO. 400-2001
A RESOLUTION OF THE CHAIRMAN AND MEMBERS OF THE
MIAMI BEACH REDEVELOPMENT AGENCY, AUTHORIZING THE
EXECUTIVE DIRECTOR, OR HIS DESIGNEE TO AWARD AND
SIGN ALL CONTRACTS, AGREEMENTS, PURCHASE ORDERS,
CHANGE ORDERS AND GRANT APPLICATIONS THAT MAY
AFFECT THE HEALTH, SAFETY, OR WELFARE OF THE CITY;
RENEW EXISTING CONTRACTS WHICH MAY EXPIRE;
TERMINATE EXISTING CONTRACTS AS NEEDED; AND TOLL
ALL ACTS RELATIVE TO ADMINISTRATIVE APPEALS PROVIDED
FOR IN SUBPART B, LAND DEVELOPMENT REGULATIONS OF
THE CODE OF THE CITY OF MIAMI BEACH, FROM THE CITY
COMMISSION MEETING OF OCTOBER 17, 2001, UNTIL CITY
COMMISSION MEETING OF NOVEMBER 28, 2001, SUBJECT TO
RATIFICATION BY THE CITY COMMISSION AT ITS MEETING ON
NOVEMBER 28, 2001.
WHEREAS, the Chairman and Members of the Miami Beach Redevelopment
Agency (RDA) may not be in session between October 17, 2001, and November 28, 2001;
and
WHEREAS, the Chairman and Members of the Miami Beach Redevelopment
Agency meeting on November 7 or 14, 2001, will be essentially organizational in nature
and is when the successful candidates are sworn in; and
WHEREAS, there is a period up to six weeks between RDA Board meetings where
RDAlCity business is conducted; and
WHEREAS, the Chairman and Members of Miami Beach Redevelopment Agency
historically have, during such periods in past years, assigned approval authority to the
Executive Director or his Designee, to award and sign all contracts, agreements, purchase
orders, change orders, and grant applications that may affect the health, safety or welfare
of the RDAlCity, subject to ratification by the RDA Board; and
WHEREAS, there may be existing contracts which may expire and require renewal,
or may need to be terminated by the RDA Board between its meeting on October 17, 2001
and November 28, 2001, which should receive RDA Board approval for renewal for an
appropriate period of time; and
WHEREAS, any administrative appeals to the RDA/City, as provided in Subpart B,
Land Development Regulations of the Code of the City of Miami Beach, would be unable
to be held between October 17, 2001 and November 28, 2001, therefore, the time for the
RDA Board to perform any required acts relative to such administrative appeals should be
tolled during said period; and
WHEREAS, the Executive Director will report back to the RDA Board, at its
November 28, 2001, seeking ratification of any actions relating to the aforestated
authorizations.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CHAIRMAN AND
MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY, that the Executive
Director, or his Designee, is hereby authorized to award and sign all contracts,
agreements, purchase orders, change orders, and grant applications that may affect the
health, safety, or welfare of the City, to renew any existing contracts for an appropriate
period of time, and terminate existing contracts as needed, and to toll all RDA Board
required acts relative to administrative appeals provided for in Subpart B, Land
Development Regulations ofthe Code of the City of Miami Beach, from October 17, 2001
until November 28, 2001, subject to ratification by the RDA Board at its first meeting on
November 28, 2001.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Between the Redevelopment Agency (RDA) Board meeting of October 17, 2001, and until
the RDA Board meeting of November 28, 2001, the Chairman and Members of the Miami
Beach Redevelopment Agency may not be in session. While there is a meeting scheduled
for November 7'" and if there is a run-off Election, the meeting will take place on November
14th. This meeting is essentially organizational in nature and is when the successful
candidates are sworn in. Traditionally, no RDA/City business is considered. Thus a period
of 6 weeks exists between the meetings where RDA/City business is conducted. During
this period of time there may be contracts in excess of the $25,000 limitation, which may
need to be awarded or terminated. The RDA Board has historically, during such periods,
assigned approval authority to the Executive Director subject to ratification by the RDA
Board.

Additionally, administrative appeals to the RDA Board, as provided in Subpart B, Land
Development Regulations of the Code of the City of Miami Beach, would be unable to be

28,2001. Therefore, any required acts relative thereto should be tolled during said period.
It is therefore requested that the Executive Director, or his designee, be authorized to
award and sign all contracts, agreements, purchase orders, change orders, and grant
applications that may affect the health, safety, or welfare of the City; renew any existing
contracts, for an appropriate period of time; terminate existing contracts, as needed and
toll all acts relative to administrative appeals provided for in Subpart B, Land Development
Regulations of the Code of the City of Miami Beach, from RDA Board meeting of October
17,2001, until RDA Board meeting on November 28,2001, subject to ratification by the
RDA Board at its first meeting in November 28, 2001.
