ORDINANCE NO. 2001-3323
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
ORDINANCE NO.789, THE CLASSIFIED EMPLOYEES' SALARY
ORDINANCE, FOR THE GROUP I CLASSIFICATION, BEING THE
CLASSIFICATIONS COVERED BY THE MIAMI BEACH
MUNICIPAL EMPLOYEES, AFSCME LOCAL NO. 1554, IN
ACCORDANCE WITH THE NEGOTIATED AGREEMENT;
RETROACTIVELY INCREASING ON THE FIRST PAY PERIOD
STARTING APRIL 23, 2001 THE MINIMUM OF THE RANGES BY
APPROXIMATELY 14.6% AND THE MAXIMUM OF THE RANGES
BY 4% TO REFLECT THE CURRENT CLASSIFICATION AND PAY
SYSTEM; INCREASING THE SALARY OF EACH EMPLOYEE,
RETROACTIVELY BY 4% EFFECTIVE WITH THE FIRST PAY
PERIOD STARTING ON OR BEFORE APRIL 23, 2001;
BARGAINING UNIT EMPLOYEES SHALL RECEIVE AN ACROSS
THE BOARD INCREASE OF FOUR PERCENT (4%) WITH THE
FIRST PAY PERIOD STARTING ON OR BEFORE APRIL 22, 2002,
AND A FOUR PERCENT (4%) INCREASE TO THE MINIMUM AND
THE MAXIMUM OF THE RANGES; AND AN ACROSS THE BOARD
INCREASE OF FOUR PERCENT (4%) WITH THE FIRST PAY
PERIOD STARTING ON OR BEFORE APRIL 30, 2003, AND A FOUR
PERCENT (4%) INCREASE TO THE MINIMUM AND THE
MAXIMUM OF THE RANGES; PROVIDING FOR A REPEALER,
SEVERABILITY, CODIFICATION AND EFFECTIVE DATES.
WHEREAS, there is a need to change the salary ranges of certain classifications in order to
ensure that the City has an employee classification and compensation system which is fair and
equitable; and
WHEREAS, there will be a retroactive increase on April 23, 2001, ofl4.6% to the minimum
of the salary range, 4% to the maximum of the salary range and an across the board increase of 4%
for each classification represented by the AFSCME bargaining unit, being Group I in the classified
service, in order to ensure that the City has an employee classification and compensation system
which will achieve internal equity and external competitiveness. Effective with the first pay period
ending in April 22, 2002, and the first pay period ending in April 30, 2003, the minimums and
maximums shall be increased by 4% and there shall be an across-the-board wage increase of 4%.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: That as of April 23, 2001, the following Section 1 of the Classified Salary ordinance
No. 789 as amended by Ordinance No. 2000-3304 shall be deleted in its entirety as follows:

SECTION 3: REPEALER
That all ordinances or parts of ordinances in conflict herewith be and the same are
hereby repealed.
SECTION 4: SEVERABILITY.
If any section, subsection, clause, or provision of this ordinance is held invalid, the
remainder shall not be affected by such invalidity.
SECTION 5: CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach,
and it is hereby ordained that the provisions of this ordinance shall become and be
made a part of the Code of the City of Miami Beach, Florida. The sections of this
ordinance may be renumbered or re-Iettered to accomplish such intention, and the
word "ordinance" may be changed to "section", "article", or other appropriate word.
SECTION 6: EFFECTIVE DATES.
Section I will be effective as of April 23, 2001.

CITY OF MIAMI BEACH, FLORIDA, AMENDING ORDINANCE NO.789,
THE CLASSIFIED EMPLOYEES' SALARY ORDINANCE, FOR THE
GROUP I CLASSIFICATION, BEING THE CLASSIFICATIONS COVERED
BY THE MIAMI BEACH MUNICIPAL EMPLOYEES, AFSCME LOCAL
NO. 1554, IN ACCORDANCE WITH THE NEGOTIATED AGREEMENT;
RETROACTIVELY INCREASING ON THE FIRST PAY PERIOD
STARTING APRIL 23, 2001 THE MINIMUM OF THE RANGES BY
APPROXIMATELY 14.6% AND THE MAXIMUM OF THE RANGES BY 4%

BACKGROUND:
On August 30, 2001, after seven sessions, negotiators for the City and the Miami Beach Municipal
Employees, AFSCME Local No. 1554, successfully concluded negotiations for a three year
collective bargaining agreement. The AFSCME bargaining unit has 268 employees in 39
classifications in the following departments: Building, Fleet Management, Parks, Parking, Police,
Fire, Public Works, and Recreation.
The Association membership has reviewed the proposed Agreement and voted to ratify it as
presented. While negotiators for the City and the Association were obliged to represent the best
interests of their "clients," the shared goal was to produce an Agreement that provided equitable and
competitive compensation and working conditions. In addition, the Administration worked to
include flexibility to the contract to allow for creative and innovative approaches to address changes
in the workforce and marketplace in an expeditious manner. Language has been developed that will
preserve management rights and create reasonable methods to meet recruitment and retention
challenges.
The following is a summary of the most significant issues in the Agreement.

The AFSCME bargaining unit will get a four percent (4%) across the board cost of living increase
effective retroactively with the first pay period starting on or before April 23, 2001, and an across
the board increase of four percent (4%) with the first pay period starting on or before April 22, 2002,
and an across the board increase of four percent (4%) with the first pay period starting on or before
April 30, 2003.
In addition, the minimums of each range will increase in accordance with the City's Class and Pay
System, which is approximately fourteen percent (14%). In addition, increases will be made in
accordance with the implementation of the Living Wage Ordinance so that all employees will be
making a minimum of $8.56 an hour.
The bargaining unit will also adopt the City's classification and pay system with this contract. This
includes salary range changes, job audits, and market classification studies. This does not include
cost-of-living increases. This change will allow the City to react to market conditions and remain
competitive with our pay plan for all classifications in the unit. This contract will also include the
reclassification of thirteen (13) classifications within the bargaining unit. These upgrades will help
make the City of Miami Beach more competitive in recruiting qualified employees, particularly for
"hard to fill" positions.
The anticipated cost for the 2001 cost of living increase is approximately $267,000. The anticipated
cost for the second year cost of living increase is approximately $292,122, and the anticipated cost

for the third year is approximately $304,000.
The cost to adopt and implement the classification and pay system within the AFSCME unit for
Fiscal Year 2000/2001 will be approximately $361,821. This includes the increases to the ranges,
increases to the minimums and implementation of the Living Wage Ordinance, which was previously
adopted by the City Commission. (The cost of the Living Wage Ordinance is approximately
$112,000.) The total cost of the wage proposal for the first year will be approximately $628,792.
Other Economic Issues
In the interest of pay for performance, the City has agreed to expand upon the performance appraisal
system. The new appraisal will have a three step reward system vs. the current two step system. The
new system will reward employees with a performance appraisal score of 90 or above with a 4%
merit increase; those that score less than 90, but more than eighty will receive a 3% merit increase;
and those who score less than eighty, but more than sixty shall receive a 2% merit increase. The old
system was a two step system with a 4% or a 2% merit increase. The new system gives more
flexibility.
In an effort to compensate our retirees in accordance with the cost of living, the City agreed to an
increase from 1.5% Simple Cost of Living to a 2.5% Compounded Cost of Living increase for
employees who retire after October 1,2000.
The Shift Differential, where a majority of an employee's regularly assigned shift hours fall between
3:00 p.m. and 11:00 p.m., was negotiated at forty five cents (45c;z:) per hour (previously twenty-five
cents (25ct) per hour) and fifty five cents (55ct) per hour (previously thirty cents (30ct)) where a
majority of an employee's regularly assigned shift hours fall between 11:00 p.m. and 6:30 a.m.
The meal allowance for employees who work three or more hours of overtime that is contiguous with
their shift will increase from six dollars to seven dollars.
Working out of Classification pay was increased to a dollar ($1.00) (previously ninety cents (9Oct)).
Hazard Pay, which is new, includes; 1) Spraying hazardous chemicals, 2) Diving with scuba gear,
3) Working in trenches five (5) feet or greater, 4) Working in raw sewage, 5) Working forty (40) feet
or higher on aerial lift operations. Employees will be paid one dollar ($1.00) an hour for hours
actually worked in these activities.

Non-Economic Issues
The contract also expands the definition of reasonable suspicion drug testing. This will allow the
City to require an employee to submit to a blood analysis, urinalysis, and/or breathalyzer when it has
a reasonable suspicion as defined in the Horida Statues 440.102 (N). This allows the testing of an
employee that has caused, contributed to, or been involved in an accident.
The termination payout for sick leave has been increased from 360 to 480 the second year and from
480 to 600 hours the third year.
The "Must Use" cap has been changed so that an employee can accrue up to 360 vacation hours and
upon retirement can receive a payout up to 480 hours.
Changes were made in the grievance process so that both parties have ten (10) days to submit a
grievance and ten (10) days to discuss the grievance. In addition, written reprimands can only be
grieved through Step ill of the grievance procedure and not to arbitration.
The Agreement will extend for a three-year term, thus ending on April 30, 2004.
CONCLUSION:
Adopt the attached Ordinance which implements the salary changes which are part of the collective
bargaining agreement that was ratified by the City of Miami Beach and Miami Beach Municipal
Emplo~~& AFSCME Local No. 1554.
