ORDINANCE NO. 2001-3324
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 2, ARTICLE
III, OF THE MIAMI BEACH CITY CODE, ENTITLED "AGENCIES,
BOARDS AND COMMITTEES"; AMENDING DIVISION 28, SECTION 2-
190.127 THEREIN, WHICH ESTABLISHED THE MEMBERSHIP AND
PURPOSE OF THE GENERAL OBLIGATION BOND OVERSIGHT
COMMITTEE; SAID AMENDMENT CHANGING THE MEMBER FROM
THE COMMUNITY DEVELOPMENT ADVISORY COMMITTEE AND THE
MEMBER FROM THE CITY'S HISTORIC PRESERVATION BOARD,
RESPECTIVELY, FROM NON-VOTING MEMBERS, TO VOTING
MEMBERS OF THE COMMITTEE; PROVIDING FOR SEVERABILITY;
CODIFICATION; REPEALER; AND AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 99-3214 established the General Obligation Bond Oversight
Committee for the purpose of providing guidance and assurance that the proposed General
Obligation Bond funded projects are implemented in accordance with the project list approved by
the Mayor and City Commission; and
WHEREAS, as originally established, the Committee was composed of thirteen (13)
members; all voting members except for one member from the Community Development Advisory
Committee, and one member from the City's Historic Preservation Board, both of which were
designated by Ordinance to be non-voting members; and
WHEREAS, at a recent regular meeting of the General Bond Oversight Committee, the
Committee voted unanimously to recommend to the Administration that the City amend the enabling
legislation creating the Committee to provide that the aforestated non-voting members from the
Community Development Advisory Committee and the City's Historic Preservation Board,
respectively, be voting members.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that:
SECTION 1. The Mayor and City Commission hereby amend Chapter 2, Article III, of the Miami
Beach City Code entitled "Agencies, Boards and Committees"; amending Division 28, Section 2-
190.127 therein, which established the membership and purpose of the General Obligation Bond
Oversight Committee; said amendment changing the member from the Community Development
Advisory Committee and the member from the City's Historic Preservation Board, respectively, from
non-voting members, to voting members of the Committee.
SECTION 2. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder
shall not be affected by such invalidity.
SECTION 3. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made a part of the Code
of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or relettered
to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or
other appropriate word.
SECTION 4. REPEALER.
All other ordinances of the City of Miami Beach or any part of said ordinances, in conflict
herewith, be and the same are hereby repealed.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on theZ7th day of October, 2001.
