2010-27427 Reso RESOLUTION NO. 2010 - 27427 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO.1 TO THE PROFESSIONAL ARCHITECTURAL AND ENGINEERING (A/E) SERVICES AGREEMENT BETWEEN THE CITY AND WOLFBERG ALVAREZ AND PARTNERS, IN THE AMOUNT OF $77,720, FOR ADDITIONAL PROFESSIONAL SERVICES FOR THE FLAMINGO PARK PROJECT; WITH FUNDING FROM 1999 GO BOND PARKS & BEACHES FUND 377 FOR DESIGN, IN THE AMOUNT OF $22,162, PREVIOUSLY APPROPRIATED IN THE FISCAL YEAR (FY) 2006 -2007 CAPITAL BUDGET, AND FROM THE MDC CDT INTERLOCAL -CDT RESORT TAX FUND 388 FOR DESIGN, IN THE AMOUNT OF $55,558, PREVIOUSLY APPROPRIATED IN THE FY 2009 -2010 CAPITAL BUDGET. WHEREAS, on September p er 05, 2007, the Mayor and City Commission adopted Resolution No. 2007 - 26609, approving and authorizing the Mayor and City Clerk to execute an Agreement with Wolfberg Alvarez and Partners (WA) for professional services for the Flamingo Park Project (the Project), pursuant to Request for Qualifications No. 15- 06/07; and WHEREAS, the Agreement was executed in the not -to- exceed amount of $443,000; and WHEREAS, throughout the planning process, there have been a series of additional public meetings and revisions to the Master Plan as well as Tennis Center, not originally contemplated when the scope of services was negotiated with WA; and WHEREAS, Amendment No. 1 to the Agreement includes plans revisions, research, expert advice, additional meeting attendance, as well as preparation of additional presentation materials; and WHEREAS, Amendment No. 1 has been negotiated, in the amount of $77,720; resulting in a revised contract fee of $520,720. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby approve and authorize the Mayor and City Clerk to execute Amendment No.1 to the professional Architectural and Engineering (A/E) Services Agreement between the City of Miami Beach, Florida and Wolfberg Alvarez and Partners, in the amount of $77,720, for additional professional services for the Flamingo Park Project; with funding from 99 GO Bond Parks & Beaches Fund 377 for design, in the amount of $$22,162, previously appropriated in the fiscal year 2006 -2007 Capital Budget (FY), and from the MDC CDT Interlocal -CDT Resort Tax Fund 388 for design, in the amount of $55,558, previously appropriated in the FY 2009 -2010 Capital Budget. Issue: Shall the City Commission Adopt the Resolution? Item Summary/Recommendation: Wolfberg Alvarez and Partners (WA) was retained to prepare a Master Plan for the Flamingo Park facility on March 27, 2008. Also included as a component of the Master Plan, was the development of a new Tennis Center and Courts. Throughout the planning process, there have been a series of public meetings and revisions to the Master Plan as well as Tennis Center. All of these meetings where the Flamingo Park Master Plan was discussed require some involvement by the Architect. Many of these committee meetings request additional meetings, cost estimates, planning scenarios and investigations to occur and this level of effort was not originally contemplated when the scope of services was negotiated with WA. These Additional Design Services are outlined in Attachment No.1 — Schedule A -1. Amendment No.1, in the amount of $77,720 includes plans revisions, research, seeking expert advice, additional meeting attendance as well as the preparation of presentation materials. ADMINISTRATION RECOMMENDATION Adopt the Resolution. FUNDING Funding, in the amount of $22,162, is available from the GO Bonds — Parks & Beaches account 377 - 2320 - 061357, previously appropriated for Design and Engineering in the Fiscal Year 2006 -2007 Capital Budget. Funding, in the amount of $55,558, is available from the MDC CDT Interlocal — CDT Resort Tax account 388 - 2320 - 061357, previously appropriated for Design and Engineering in the Fiscal Year 2009 -2010 Capital Budget. ANALYSIS Wolfberg Alvarez and Partners (WA) was retained to prepare a Master Plan for the Flamingo Park facility on March 27, 2008. Also included as a component of the Master Plan, was the development of a new Tennis Center and Courts. Throughout the planning process, there have been a series of meetings and revisions to the Master Plan as well as Tennis Center, not originally contemplated in the WA's original Scope of Services. These Additional Design Services are outlined in Attachment No.1 — Schedule A -1. WA presented the City with fee proposals for the additional design services totaling $90,254, which have been negotiated down to $77,720 with the assistance of the Special Assistant to the City Manager, Emanuel Mayer. Commission Memorandum — Wolfberg Alvarez and Partners — Amendment No. 1— Flamingo Park July 14, 2010 Page 2 of 4 Background / Chronology of Issues On August 6, 2008, the Consultant conducted a community design charrette, wherein five (5) design options (A, B, C, D, & E) for the Flamingo Park Master Plan were presented. Input from the community was obtained and the Consultant developed an additional two (2) Master Plan options (F & G), and subsequently presented all seven (7) options during the November 6, 2008 Community Design Workshop (CDW). These subsequent Master Plan Options presented the following concepts: Option F - Reflects a plan without the Property Management Facility. Includes 18 tennis courts (13 clay courts and 5 hard courts). Option G - Reflects a plan with the Property Management Facility remaining in its current location. Includes 18 tennis courts (13 clay courts and 5 hard courts). Presentations to the FCWPC were made on February 11, March 10, April 14, and June 25, 2009. An additional five (5) master plan design options (H, 1, J, K, and L) were developed and are summarized below: Option H - Reflects a plan with minor renovations to the existing Tennis Center building with 17 tennis courts in total (12 clay courts and 5 hard courts). The reduction in one (1) court is due to the current location of the existing tennis center building. Option I - Reflects a plan with a new 4,970 square -foot Tennis Center building not aligned with the Pool building, and 18 tennis courts in total (13 clay courts and 5 hard courts). Option J - Reflects a plan with all the features of Master Plan Option I, with the exception of a new smaller 4,232 square -foot Tennis Center building not aligned with the Pool building and with 17 tennis courts in total (12 clay and 5 hard courts). Aligning the Tennis Center building with the Pool building resulted in the reduction of one tennis court. Option K - Reflects a plan with a new bike path along Michigan Avenue, renovated existing softball field restrooms, new northern walkway from north parking lot to Meridian Avenue, a new community garden, and also includes the new smaller, 4,232 square -foot Tennis Center building, and 18 tennis courts in total (13 clay and 5 hard courts). Option L - A new 4,232 square -foot Tennis Center facility aligned with the Pool building and the construction of 17 new clay tennis courts; an enhanced rotunda plaza along the Park's north -south axis; a new restroom building with a Park office component centrally located within the area of the softball fields and handball courts. The approved master plan in Option L also explores the potential future usages for the Lodge House building, and shade kiosks between the courts. The City Commission ultimately approved "Option L" at its September 09, 2009 meeting. The Flamingo Park scope of work was also expanded to include the construction of five (5) new hard tennis courts, at Polo Park, to replace the four (4) existing courts or alternatively at the Par 3 Golf Course. However, the Commission ultimately directed the Administration to restore the four (4) existing hard courts at Polo Park and to construct five (5) new hard surface tennis courts at the Par 3 facility. During the February 3, 2010 City Commission meeting, staff was directed to revise the previously approved Master Plan Option "L "and explore two options. First, revert back to the original Master Plan with five (5) hard courts and twelve (12) clay courts. Secondly, review Commission Memorandum — Wolfberg Alvarez and Partners — Amendment No. 1— Flamingo Park July 14, 2010 Page 3 of 4 the possibility of adding five (5) hard courts to the area just north of the existing courts (previously occupied by the Abel Holtz Stadium) thus resulting in a total of 22 tennis courts - 17 clay surface courts and 5 hard surface courts. In addition, staff was also directed to only provide two (2) hard courts at the Par 3 facility. These revisions to the Master Plan were presented to the Neighborhoods / Community Affairs Committee on February 16, 2010. Staff was required to explore the following: • A reduced number of courts in the open field of Flamingo Park • Adding four (4) tennis courts without lighting, at Normandy Shores Park • Adding three (3) tennis courts at Fairway Park • Consider the potential to expand the number of courts at North Shore Park Consensus was not reached amongst the Committee members and the Committee requested the Administration to place the item on the March 10, 2010 Commission agenda. The item was deferred and the Commission requested the Administration to place an item on the Neighborhoods / Community Affairs Committee meeting of April 14, 2010 and to return to the May 12, 2010 Commission meeting. During the May 12, 2010 Commission meeting, the item was subsequently tabled to the June 9, 2010 Commission meeting. During the June 9, 2010 Commission meeting, a motion was approved to return to the original master plan option approved in September 2009 which is to provide twelve (12) clay tennis courts and five (5) hard courts at Flamingo Park. WA's Agreement contemplated a total of three (3) public meetings during the Planning Phase as follows: • one (1) Community Design Workshop • one (1) BODR presentation to Historic Preservation Board (HPB) • one (1) BODR presentation to City Commission. To date, WA have attended a total of nine (9) public meetings as follows: • two (2) Community Design Workshops / Charettes • two (2) presentations to HPB • four (4) presentations to Finance and Citywide Committee • one (1) presentation to the City Commission. All of the above meetings, as well as the various Neighborhood / Community Affairs Committee meetings where the Flamingo Park master plan was discussed require some involvement by the Architect.
