A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CI OF
MIAMI BEACH, FLORIDA, FOLLOWING A DULY NOTICED PUBLIC HE ING
ACCEPTING THE RECOMMENDATION OF THE HISTORIC PRESERV ION
BOARD AND GRANTING A CERTIFICATE OFAPPROPRIATENESS FO THE
DEMOLITION OF THE 53RD STREET RESTROOMS, A NON- CONTRIBU ING
FACILITY LOCATED AT 5301 COLLINS AVENUE.
WHEREAS, the 53 Street Restroom Facility was previously identified as one of the six (6)
beachfront restroom facilities to be in critical need of replacement; and
WHEREAS, the availability of safe, clean ty ea and accessible restrooms facilities is ‘afital to beach
tourism and the economic well being of our community, the Administration initiate) an effort to
replace the deteriorated facilities with new standardized facilities; and
WHEREAS, on April 18, 2001, Corzo, Castella, Carballo, Thompson and Sajman (C3TS)
was awarded a contract, via Resolution No. 2001 - 24348, for architectural, engineering and
construction administration services, required to construct five (5) oceanfront restrooms /concession
facilities located at 64 53 46 29 and 21 Streets; and
WHEREAS, on November 10, 2004, the City Commission Co mission adopted Resolute No. 2004 -
25741 authorizing the City to enter into a Design -Build Agreement with Tran Coistruction to
construct the beachfront restrooms and concession facilities located at 21 46 and' 64 Streets;
and
WHEREAS, due to limited funding, the facility on 53 Street, which was originally part of the
package, was eliminated; and
WHEREAS, funding for the 53 Street Restroom Facility Project became available in FY
09/10; and
WHEREAS, on September 20, 2010 a Notice to Proceed was issued to C3 1S for the full
review and reconciliation of 60% documents against the new Florida Building Code, presentation to
the Historic Preservation Board (HPB), 100% construction documents issuance, lo4al and state
permitting assistance, bidding assistance and construction administration services for 53 Street
Restrooms Project; and
WHEREAS, the scope of services also includes re- designing the concessi n building to
accommodate the Ocean Rescue office, which currently occupies a section of the exis ing restroom
facility; and
WHEREAS, on January 11 2011, the Historic Preservation Board (HPB) voted to
recommend that the request for the Certificate of Appropriateness for demolition of the existing 53rd
Street Restrooms facility be granted; and
WHEREAS, on January 19 2011, the City Commission approved Resolution No. 2011-
27572, setting a Public Hearing to consider its issuance.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that, following a duly noticed public hearin , the Mayor
and City Commission hereby accept the recommendation of the Historic Preservatio Board and
grant a Certificate of Appropriateness for the demolition of the 53 Street Restroom , located at
5301 Collins Avenue.

the City's public buildings as good or excellent. Completing this Project will improve overall rating.

Street Restrooms located at 5301 Collins Avenue be approved?
Item Summary /Recommendation:
The 53 Street Restroom facility was previously identified as one of the six (6) beachfront restroom facilities which
were in critical need of replacement.
On November 10, 2004, the City Commission adopted Resolution No. 2004 -25741 authorizing the City to enter into
a Design -Build Agreement with Tran Construction to construct the beachfront restrooms and concession facilities
located at 21 46 and 64 Streets. Due to limited funding, the facility on 53 Street, which was originally part of
the package, was eliminated.
Funding for the Project became available in FY 09/10. On September 20, 2010, a Notice to Proc ed was issued to
C3TS, via the Miami -Dade County School Board Contract, for the full review and reconcili tion of the 60%
documents against the new Florida Building Code; HPB presentation; 100% construction doc ments issuance;
local and state permitting assistance; bidding assistance; and construction administration se ices for the 53

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
The Administration previously identified six (6) beachfront restroom /concession faci ities, which
were in critical need of replacement. The subject facilities are located east of Collin Avenue at
21 29 46 53 64 and 72 Streets. Because beach tourism is vital to the e nomic well
being of our community, and the availability of safe, clean and accessible res ooms and
concession facilities is vital to beach tourism, the Administration initiated an effort to replace the
deteriorated facilities with new standardized facilities.
On November 10, 2004, the City Commission adopted Resolution No. 2004 -25741 = uthorizing
the City to enter into a Design -Build Agreement with Tran Construction to co struct the
beachfront restrooms and concession facilities located at 21 46 and 64 Streets, in
accordance with the sixty percent (60 %) design plans prepared by Corzo, Castell.- , Carballo,
Thompson and Salman (C3TS) and the City's Design Criteria Specification Packa.e. Due to
limited funding, the facility on 53 Street, which was originally part of the pa•kage, was
eliminated. The construction of these facilities was completed in 2007.
In 2007, Tran Construction was authorized, by an approved change order to th - it existing
contract with the City, to proceed with the design of the 35 Street Restrooms facili , based on
the 60% documents previously designed for the 29 Street facility.
On May 14, 2009, Invitation to Bid (ITB) No. 39 -08/09 for the construction of the 35 Street
Restrooms facilities was issued, and on September 09, 2009, the Commission a •proved the
rejection of all bids since the use of a Job Order Contract would result in considera • le savings.
The construction of these facilities was completed on May, 2010.
Funding for the 53 Street Restroom Facilities became available in FY 09/10. On Se tember 20,
2010, a Notice to Proceed was issued to C3TS, via the Miami -Dade County Sc ool Board
Contract for: the full review and reconciliation of 60% documents against the ew Florida
Building Code; presentation to the Historic Preservation Board (HPB); 100% c nstruction
documents issuance; local and state permitting assistance; bidding assistance; and nstruction

On January 1 1 th , 2011, the HPB voted to recommend that the request for the Certi icate of
Appropriateness for demolition of the existing 53 Street Restrooms facility be gra ted, and
on January 19 2011, the City Commission approved Resolution No. 2011 -27572 setting a
Public Hearing to consider its issuance.
CONCLUSION:
The Administration recommends that the City Commission grant a Certificate of Appr'P priateness
for the demolition of the 53 Street Restrooms, a non - contributing facility located at 401 Ocean
Drive.
